The Judge in Chambers is a Supreme Court judge dealing with applications assigned to chambers by law or requiring prompt judicial attention. The procedure is still a court process. It requires an available remedy, proper papers and fair treatment of the person affected.
The Judge in Chambers handles urgent or specifically assigned applications
Mauritius Judiciary’s published charter describes matters requiring celerity and urgency as being dealt with by a Judge sitting at Chambers. Statutes also send particular applications there, even when the dispute is not an emergency in the everyday sense. The source of the judge’s power must therefore be identified first.
The Judge in Chambers is not a separate lower court or an informal appointment with a judge. The judge exercises judicial authority within the Supreme Court framework. The structure of the Mauritius courts places that work in context.
Urgency is practical and legal. A threatened transfer tomorrow may require a different response from a continuing dispute known for months. The papers must explain what will happen before an ordinary hearing can protect the applicant.
Which applications may be brought in chambers?
The Courts Act confirms that a judge may grant an injunction in term time or vacation. It also provides for a rule or summons to show cause to be issued by the Master and Registrar and made returnable before the Judge in Chambers. Other enactments assign particular matters to chambers.
Examples across the statute book include specified evidence-gathering, civil-status, property, family and public-law applications. The legal test differs for each. The phrase “chambers application” describes the forum and procedure, not one universal remedy.
A claimant should begin with the right said to be threatened and the order that could lawfully protect it. A commercial applicant may also need to consider whether the substantive claim belongs in the Commercial Division of the Supreme Court.
The affidavit and supporting exhibits required at the outset
An affidavit sets out facts on oath or affirmation. It should identify the deponent, explain how that person knows each material fact and exhibit the source documents. Argument belongs in submissions; an affidavit should not hide gaps behind conclusions such as “unlawful” or “urgent”.
Exhibits should show the operative agreement, decision, notice, title or communication. Put them in date order and make each reference traceable. An incomplete screenshot, unsigned draft or forwarded message may fail to prove the threatened act.
In practice, the weak point is often causation. The applicant describes serious harm but does not connect it to an act the respondent is about to take. Guidance on evidence in Mauritius courts explains how documents and witnesses perform different jobs.
Notice to the other party and truly urgent without-notice requests
Fair procedure generally requires notice to a person whose rights may be affected. The form and timing come from the law and rules governing the application. Service must be planned with the attorney and, where required, the court usher.
A request without notice is exceptional. The applicant must identify the procedural basis and disclose material facts candidly, including points that may assist the absent party. A judge may refuse relief, narrow it or require prompt service and a return date.
Secrecy is not a strategy for improving a weak application. It may be justified where notice would defeat the lawful purpose of the order, but that proposition needs evidence. The guide to instruction through a Mauritius attorney explains the professional roles in filing and service.
What happens at the first chambers appearance?
The judge first needs to understand the application, its legal basis and its urgency. The respondent may appear, ask for time, oppose the order or offer an undertaking. Preliminary questions about service, standing and the sufficiency of the affidavit may arise before the merits.
The court can refuse the request, make a limited interim order, direct service or set a timetable for further affidavits and argument. An adjournment is not an implied victory for either side. It may simply preserve fair procedure while the record is completed.
Counsel should be able to state the exact order sought. Vague language transfers too much uncertainty to the judge and makes later enforcement difficult. Bring a workable draft, but expect the court to alter it.
Undertakings, interim orders and return dates
An undertaking is a formal promise given to the court, not a casual assurance between parties. It may support or replace temporary relief. Breach can have serious consequences, so the person offering it must understand its wording and be able to comply.
An interim order operates pending the next stage or another specified event. Read its scope carefully. It may restrain one transaction without deciding ownership, liability or the ultimate claim.
A return date brings the matter back before the judge after service or further evidence. Record what must happen before then, including affidavit filing and service. The point most often missed is that a temporary order does not prepare the main case by itself.
Challenging, varying or enforcing a chambers order
The route depends on the order and its statutory basis. Under the current injunction provision in the Courts Act, an application for review to set aside the injunction is made to the Supreme Court within 21 days after it was granted. The Supreme Court may set aside or modify it.
Do not assume that every chambers order uses that same route or time limit. Obtain the sealed order, note when and how it was served, and identify the enabling provision. A request to vary because circumstances changed differs from a challenge alleging that the order should not have been made.
Enforcement also depends on precise wording and valid service. Preserve proof that the person bound knew the order and what it required. If a substantive dispute continues, the Supreme Court’s Mediation Division may become relevant. The chambers’ Mauritian legal system practice is the starting point for individual advice.

Frequently asked questions
Can I go directly to the Judge in Chambers for an urgent order?
Urgency alone does not allow a private approach to a judge. The application must use the procedure for the available remedy, usually through an attorney in a civil Supreme Court matter, with counsel where instructed. This is general information; the correct route for your facts must be identified before filing.
Will the other side be told before a chambers application in Mauritius?
Ordinarily, a person affected should receive the notice required by the applicable process. A without-notice request needs a lawful procedural basis and full, candid disclosure, and the judge may decline it or limit any order. This is general information; notice depends on the remedy and demonstrated urgency in the actual application.
What documents should I bring for an urgent Supreme Court application?
Bring the operative agreement or decision, the latest correspondence, proof of the threatened event and every existing court paper. Include names, dates and evidence showing why ordinary timing would not protect the position. This is general information; an attorney and barrister should settle the affidavit and exhibits required for your remedy.
