Preparing for Supreme Court mediation in Mauritius

Preparing for Supreme Court mediation in Mauritius means knowing the case, the settlement range and who can bind each party. The process concerns a civil matter already pending before the Supreme Court. A Judge assists the parties to seek agreement or reduce the issues that must be tried.

Mediation preparation starts with authority and realistic settlement objectives

Begin with the referral to mediation, the mediation notice and the latest pleadings. They identify the parties and the dispute placed before the Court. The Supreme Court Mediation Division is not a fresh lawsuit, so the pleaded case remains the starting point.

Write down three outcomes before the session. The first is the result sought. The second is an acceptable compromise. The third is the point beyond which no agreement can responsibly be made. For a company, test each outcome against board authority, insurance conditions, tax treatment and cash flow. Personal preference is not settlement authority.

The Supreme Court (Mediation) Rules 2010 require good-faith participation. They do not compel a party to accept an offer. In practice, the missed point is often internal approval. A promising discussion stalls because the person in the room must telephone someone who has never read the proposal.

What the Supreme Court mediator needs to understand about the dispute

The mediation Judge needs the shortest accurate explanation of what happened, what remains contested and what could resolve it. Separate liability, value and remedy. A party may strongly dispute fault yet still examine a commercial settlement. That distinction makes the conversation useful.

Explain the pressure points honestly. A weak document, an unavailable witness or a disputed calculation matters. So does an ongoing relationship that a judgment cannot repair. The Judge may conduct joint or separate meetings, make recommendations and request a document considered necessary for resolution.

Use the terminology of the actual proceeding. The Mauritius legal glossary can help a client distinguish pleadings, evidence and orders before the conference. If the dispute touches another Supreme Court function, the guide to the Supreme Court divisions supplies the wider court context.

Building a concise chronology and agreed document bundle

A useful chronology records each material event, its date and the document that proves it. It should expose gaps rather than hide them. If the date of an oral instruction is disputed, label it disputed. Do not present argument as an agreed event.

The Rules allow the mediation Judge to request a position paper and documents critical to the unresolved issues. A focused bundle might contain the contract, pleaded amendments, key correspondence, expert material, payment records and prior orders. Include only what assists the decision under discussion. Hundreds of unsorted pages obscure the point.

Try to agree the neutral documents with the other side before the session. Keep separate copies of material shown only in a private meeting. The distinction matters because mediation material receives specific confidential and without-prejudice treatment, while a party's pre-existing documents do not become unusable merely because they were discussed there.

Valuing money claims and non-financial settlement terms

A settlement figure needs a visible calculation. Separate principal, interest claimed, costs, tax consequences and any sum already paid. Then show which components are contested. A single round number gives the Judge little help in testing the distance between the parties.

Value litigation risk as well as the pleaded maximum. Consider the evidence likely to be accepted, the remedies legally available and the practical cost of continuing. No percentage can replace that analysis. The result may instead involve instalments, delivery, rectification, confidentiality, an apology, release terms or an agreed future course of dealing.

Non-financial wording deserves equal care. Define who must do what, by which verified date, and what happens to the pending case. Check whether a third party must consent. A settlement that depends on an unidentified document or an unwilling outsider is not ready to sign.

Who should attend and who may approve a settlement?

The mediation notice governs attendance. Under the Supreme Court (Mediation) Rules 2010, a party must either attend personally or, in its absence, be represented by an attorney. A party who attends may be assisted by an attorney, a barrister or both. An absent party's attorney needs full written authority to settle and may instruct a barrister. A party that fails without good cause to comply, or unreasonably refuses to take part, risks an order for an early hearing and, after trial, a costs order.

For a company or other organisation, identify the natural person who can make the decision. Bring the resolution, delegation or other written authority on which that person relies. Confirm any financial ceiling and any approval that cannot be delegated. The Judge may also ask an interested third party to attend if that participation could help resolve the dispute.

Remote participation should be raised beforehand, not assumed. A director's availability by telephone does not itself answer whether the Court's direction is satisfied. Confirm the arrangement through the legal representatives and the Court process before the appointed session. What happens to confidential offers if mediation does not settle?

The Rules state that mediation takes place in private and is confidential. Documents, communications, information and proposals made specifically for the process are treated as privileged and without prejudice. Notes and records made by or before the mediation Judge are confidential too.

If no settlement follows, the case is ordinarily returned for trial. Statements and mediation records are generally inadmissible, subject to the limited situations stated in the Rules. Those include a challenge to a settlement for fraud, specified criminal or contempt proceedings, and reliance on a binding agreement as a bar to another claim.

Confidentiality is not a licence to mishandle existing evidence. A party may still use its own documents and information in later court proceedings without referring to mediation. Marking an ordinary business record “without prejudice” after the event does not change what it is.

Recording and implementing an agreement reached at mediation

Once agreement is reached, precision becomes decisive. The mediation Judge records a memorandum setting out the terms. The parties and the Judge sign it, and the agreement may be executed like a judgment by consent between those signatories. It can also address costs.

Read every operative term before signing. Check names, amounts, property descriptions, performance dates, releases and the treatment of related proceedings. The Judge may make consequential orders for a stay, discontinuance or withdrawal of the Supreme Court case. If only some issues settle, a signed memorandum can identify what no longer requires trial.

Implementation may require more than payment. A deed, corporate approval or delivery protocol may still need preparation. Allocate responsibility for each item in the settlement itself. Frequently asked questions

Do I have to speak during Supreme Court mediation in Mauritius?

You should be ready to answer the mediation Judge directly, although your barrister or attorney can assist you. The format is flexible, and the Judge may meet the parties together or separately. That is general information; your legal representative should advise you on how to address the issues in your own case.

Can my company settle at mediation if a director attends remotely?

Do not assume remote attendance will be accepted. The notice and any direction from the mediation Judge govern attendance, while an absent party represented by an attorney must give that attorney full written settlement authority. This is general information, and the company should obtain advice on the required authority and attendance arrangements before the session.

What should I put in a mediation position paper for a Mauritius case?

State the issues that need resolution, the essential facts, the documents supporting them and the outcome you propose. Distinguish points already agreed from those still disputed, and explain any calculation briefly. This is general information; the contents and treatment of a position paper should be settled with your legal representative for the particular proceedings.
