Retirement gratuity and pension benefits answer different questions in Mauritius. A gratuity is generally a service-related employment payment, while a pension provides benefits under a state, occupational or private scheme. An employee may have rights under more than one arrangement, but one statement should not be used as proof of another.

Gratuity and pension are different entitlements

The Workers’ Rights Act 2019 contains the statutory framework for retirement gratuity and the Portable Retirement Gratuity Fund. The MRA administers contribution and return services for that fund. Private pension schemes sit under their own rules and are regulated by the Financial Services Commission.

These labels matter. A monthly pension forecast may show an income payable under scheme rules. It does not necessarily show the service-related gratuity due from an employer or fund. Likewise, a gratuity calculation does not establish what a separate pension policy will pay.

Ask for each benefit by name. Obtain the scheme booklet, employment agreement, contribution statement and retirement calculation rather than relying on a single figure described as “retirement money”.

Identify the employment history that counts

Service analysis begins with the entry date, exit date, interruptions and identity of each employer. A transfer within a group may look continuous to the employee yet appear as two employers in payroll records. A merger or name change may create the opposite problem.

The statutory scheme was designed to preserve gratuity value across changes of employer, but its application depends on the worker, the period and any exemption. Older service may require a different calculation or evidence route. Do not assume a modern fund statement contains every earlier year.

Periods of unpaid absence, casual engagement, part-time work and successive fixed-term contracts require the underlying documents. The employment rights of expatriates also deserve separate checking where the worker was a non-citizen during part of the service.

Collect records before the retirement date

The most useful file starts with appointment and promotion letters, contracts, payslips and annual statements of emoluments. Add MRA contribution statements, pension benefit statements, leave records and any letter acknowledging prior service. Bank statements may corroborate pay, although they seldom explain its components.

Check that the name and National Identity Card number match across the records. A changed surname, transposed digit or old payroll number can split one career into separate entries. Correcting that mismatch before retirement is usually easier than doing so while a payment is pending.

In practice, the delay often sits in an unexplained gap between two payroll systems. Ask the employer to identify the gap in writing and to state which entity carried the service during it.

Employer schemes and statutory rights

Some employers sponsor private pension schemes. The Financial Services Commission describes these as benefits over and above state pension arrangements. The MRA’s PRGF guidance also recognises that an employer contributing to an approved private pension scheme may be treated differently for fund contributions. The statutory fund also excludes certain categories of worker, including some non-citizens and migrant workers, and treats pay above a stated wage ceiling differently for contribution purposes; the current ceiling and any exemption should be confirmed with the MRA rather than assumed from an earlier year.

That does not make the scheme label conclusive. Read the admission rules, employer and worker contribution terms, vesting conditions, retirement events and benefit formula. Confirm whether the particular worker was actually enrolled for each disputed year.

A contractual promise may also be more favourable than the statutory floor. The agreement, staff handbook and scheme rules should therefore be compared side by side. Avoid deducting one benefit from another without identifying the legal or contractual basis.

Deal with missing or changed-employer records

A closed business does not erase the employment history, but proof becomes harder. Search for appointment letters, payroll emails, tax documents, bank credits and social-contribution records. Former supervisors may identify the period, although documentary evidence will usually carry more detail.

Where a business was sold, identify whether the legal employer changed. The brand above the door is not enough. Company numbers, payslips and transfer letters may show which entity accepted responsibility at each stage.

For portable-fund periods, compare the employment chronology with the annual worker statement and any exit information. The connected guide explains how portable retirement gratuity works in Mauritius. Record discrepancies by month and employer, not as a general allegation that the whole account is wrong.

Retirement after another exit event

Retirement may follow ordinary service, incapacity, redundancy or an earlier resignation. Those events are not interchangeable. The reason and date of the employment ending can affect whether payment is due then, remains preserved, or must be addressed under another remedy.

A resignation should not be rewritten as retirement merely because the employee is older. Nor should a redundancy payment be assumed to include every retirement benefit. The termination letter and calculation must name each component. Where redundancy compensation and gratuity both arise from the same exit, the calculation should show each entitlement separately rather than a single combined figure.

If the exit was contested, read the retirement issue alongside the rules governing dismissal. The guides to unfair dismissal in Mauritius and instructing counsel through an attorney-at-law explain the separate litigation route.

Check and challenge the calculation

Begin with the employer’s written calculation. It should identify the service period, remuneration basis, scheme credit, fund payment and any proposed deduction. Ask which document supports every adjustment. A rounded lump sum without workings cannot be checked properly.

Compare that calculation with the MRA or scheme statement. If years are missing, provide the relevant payslips and contribution evidence. If the parties disagree about legal entitlement rather than data entry, the dispute may require advice and the appropriate employment forum.

Do not sign a discharge simply to obtain an undisputed amount without understanding its scope. A settlement may affect later claims. The employment and workers’ rights practice describes the chambers’ work on unpaid benefits and employment disputes.

Frequently asked questions

Am I entitled to a retirement gratuity if I resign in Mauritius?

Resignation is not automatically the same event as retirement, so an immediate retirement-gratuity payment should not be assumed. Contributions or protected service under the portable arrangement may still matter later. This is general information; advice on your position requires the dates, reason for exit and scheme records.

What is the difference between a pension and retirement gratuity in Mauritius?

A pension is generally an income benefit paid under a state, occupational or private arrangement. A retirement gratuity is a service-related lump-sum employment entitlement, subject to the statutory and scheme rules that apply. This is general information; advice should identify each benefit and its governing documents.

How can I prove old years of service when my former employer has closed?

Gather payslips, appointment letters, contribution statements, bank credits, tax records and any reliable correspondence showing the employment dates. Records held by the MRA, a pension administrator or another public authority may assist, depending on the period. This is general information; advice is needed on the proof available in your particular case.
