The Portable Retirement Gratuity Fund in Mauritius is intended to preserve qualifying gratuity value as a worker moves between employers. Employers report and pay contributions through the Mauritius Revenue Authority, while employment exits generate further reporting and comparison steps. Portability does not mean every past job automatically appears correctly, so the worker’s own records still matter.
Portability preserves value across job changes
Before portability, a worker’s retirement position could depend heavily on staying with one employer. The Workers’ Rights Act 2019 created the Portable Retirement Gratuity Fund so that qualifying value can follow the worker’s employment history. The system is supported by the Workers’ Rights (Portable Retirement Gratuity Fund) Regulations 2020.
The account is not an ordinary savings account available whenever employment ends. Contributions, preserved service and the statutory payment event must be distinguished. Changing jobs may cause an exit statement, but not necessarily a cash payment to the worker.
This distinction matters during a secondment between group companies. A group may describe the move as internal, yet the payroll record may show a change of legal employer.
Check which workers and service periods qualify
Coverage should be checked against the Act, the regulations and the worker’s actual terms. The fund rules contain definitions and exclusions. An employer-sponsored private pension arrangement may also affect whether PRGF contributions are due for a particular worker.
Start dates are equally important. The MRA introduced monthly PRGF return and payment services following the 2020 regulations, with current monthly filing applying from 2022. Past-service mechanisms exist, but they should not be mistaken for proof that all pre-fund employment has been credited.
Non-citizen status may require a separate coverage analysis as well as a valid right to work. The permit issue is outlined in work permits for foreign employees in Mauritius.
Employers record entry, pay and exit
Accurate reporting begins when employment starts. The employer should use the worker’s correct identity number, legal name, entry date and remuneration details. Monthly returns then create the contribution history used later by the administrator.
When employment ends through termination, resignation, retirement or death before retirement age, the Act requires an exit return with specified service and remuneration information. The worker or legal representative is to receive a copy. The exit return should state the true reason for the departure, since retirement, death, termination, resignation and a move to an approved private pension scheme are treated as separate categories under the fund’s records. The employer must therefore retain payroll material capable of supporting that return.
The point most often missed is the reason for exit. A resignation, redundancy and retirement should not share one vague code. If the job ended for economic reasons, the separate guide to redundancy and economic dismissal explains why that characterisation matters.
Contributions remain attached to the worker
The MRA collects employer PRGF returns and contributions electronically. It also provides the return tools for past service, exit statements and gratuity payments on retirement or death. The statutory records connect contributions to the individual worker rather than leaving them in a general company ledger.
When the worker leaves one employer, the next employer starts its own reporting for that person. The accumulated record can therefore span several businesses. It is the identity details, employment dates and returns that join those periods together.
Do not treat an employer’s deduction on a payslip as proof that the MRA received the correct return. Conversely, an absent payslip label does not alone prove non-payment. Compare the official worker statement, employer records and banked remuneration.
Resolve contribution and employment mismatches
A missing month can have several causes. The employer may have omitted a return, used the wrong identity number, reported the worker under an old surname or disputed that employment had started. A transfer between related companies can also leave overlapping or empty periods.
Define the discrepancy precisely. Write down the expected employer, start and end dates, months absent and documents supporting each month. Send that schedule with copies, while retaining the originals.
In practice, a correction request framed as “my fund is wrong” often stalls because nobody knows which return to inspect. A dated schedule makes the necessary correction identifiable. If an administrative or judicial decision later needs review, appeals in Mauritius require attention to the particular decision and applicable route.
Payment may follow retirement or death
Retirement and death are among the events for which the MRA provides gratuity-return procedures. The employer’s exit statement supplies service and recent remuneration data. The fund record and statutory calculation are then compared, with any employer shortfall or surplus addressed under the governing rules.
Death requires the legal heirs or representative to establish authority and identity before payment can be dealt with. A death certificate alone may not answer who may receive or administer the entitlement. Succession documentation may be needed alongside employment records. The administrator typically compares the reported service and pay against the accumulated contribution record before releasing any balance, so a delay at this stage does not necessarily point to an error.
Other exits can preserve value without triggering the same payment route. A worker should ask what has been reported, whether a shortfall exercise occurred and what statement will be issued, rather than assuming all exits produce identical outcomes.
Gather documents before querying the record
Put the evidence in employment order. Useful documents include contracts, appointment letters, payslips, statements of emoluments, bank credits, MRA worker statements and exit letters. Add any notice of a company transfer, private pension membership or change of identity details.
Ask the former employer for the exit statement copy and the basis used for the final remuneration data. Where the employer has closed, preserve Companies Register information identifying the legal entity. Former colleagues can confirm context, but payroll and statutory records usually prove more.
The employment and workers’ rights practice covers disputes about service, contributions and exit payments. A focused record review should separate a clerical mismatch from a contested legal obligation.
Frequently asked questions
Can I keep my retirement gratuity when I change jobs in Mauritius?
The portable system is intended to preserve qualifying gratuity value when a worker changes employer, rather than making service disappear at each move. Coverage and the treatment of earlier service still require checking. This is general information; advice on your record depends on the relevant periods and employers.
How do I check whether my employer paid into the portable gratuity fund?
Compare your worker statement with payslips, employment dates and the employer’s PRGF information. Ask the employer to explain any absent month and correct identifiers before treating the gap as resolved. This is general information; specific advice may be needed if the employer disputes liability or the records conflict.
What can I do if years of service are missing from my fund record?
Prepare a month-by-month employment schedule and attach contracts, payslips, bank credits, tax documents and contribution statements. Send a focused query identifying the employer and exact missing period. This is general information; advice should address whether the problem is a filing error, unpaid contribution or excluded service.
