Divorce can end the basis of a Mauritius residence permit obtained through a spouse. It does not necessarily remove every possible route to remain, but another route must stand on its own requirements. The permit category, the stage of the divorce and the official record of status all matter.
Divorce may remove the basis of spousal residence
The current Immigration Act 2022 gives a non-citizen civilly married to a Mauritian citizen a route first to temporary residence and then, if the statutory conditions are met, to a residence permit. It separately provides for people who derive resident status from a non-citizen spouse holding another qualifying permit. In each case, the marriage is the stated connection.
Where resident status comes from marriage to a Mauritian citizen, the Act says it ceases six months after the marriage is terminated. It also addresses loss of status where a marriage to the non-citizen sponsor ends. The printed card should therefore be read with the legal basis on which it was issued.
Termination of the marriage is not the same event as a spouse leaving the home or filing a petition. Still, separation can affect an application that depends on the couple’s shared marital life. Early review gives time to distinguish the present right from a hoped-for future route.
Which permit and divorce stage determine your position?
Begin with the full permit name. A temporary residence permit as the spouse of a citizen is different from a dependent residence permit linked to an Occupation Permit holder. Permanent residence, an independent Occupation Permit and a Premium Visa also rest on different conditions.
Next, identify what the divorce papers actually show. A filed petition proves proceedings have begun. An interim court step may not be the final termination of the marriage. The final decree and the updated civil-status record are the documents from which the relevant date should be confirmed.
A foreign divorce adds a recognition question. The respective roles of barristers, attorneys and notaries may affect the family-law work, while the immigration decision stays with the competent authority. No private professional can extend a permit by treating an overseas decree as effective without review.
Documents showing an independent right to remain
An alternative application needs evidence for its own category, not merely proof that the marriage lasted for a long time. Employment may require a professional Occupation Permit application supported by the employer and contract. Retirement, investment and other residence routes have separate statutory and administrative tests.
Collect the current permit, passport, marriage certificate, divorce petition and every decree already issued. Add correspondence from the Passport and Immigration Office. If another route is proposed, include the documents that create it, such as an employment contract or the approval papers relating to qualifying property.
Property routes require care. An ordinary home purchase does not automatically confer residence, and qualifying schemes carry their own conditions. The legal guide to buying property in Mauritius explains the separate approval work without turning ownership into an immigration promise.
Updating the Passport and Immigration Office
Tell the Passport and Immigration Office the accurate procedural stage and ask what it requires next. Provide the permit number, spouse’s status, filing date and any final decree. If the divorce was granted abroad, identify the country and whether the Mauritian civil-status record has been updated.
Do not describe a separation as a completed divorce. Do not omit a final decree from a renewal application either. The authority can only give a useful written answer if the chronology and documents match.
In practice, uncertainty often comes from using the word “spouse visa” for several different permissions. Quote the wording on the permit itself. That allows the office to address the actual legal basis rather than a label used in conversation.
Children, work and property do not automatically confer status
A child living in Mauritius does not by itself convert a former spouse’s permit into an independent one. Custody, contact and maintenance remain important family-law matters, but they do not substitute for immigration permission. The child’s nationality and own permit documents should be checked separately.
Employment is similar. Holding a job offer is not the same as holding permission to take that employment. A prospective employer must use the current process for the applicable work or Occupation Permit, and the proposed start date should await clear authority.
Estate planning also answers another question. A will or expected inheritance can protect property intentions, yet it does not continue a marriage-based permit. For cross-border families, expat wills and succession in Mauritius deals with that distinct planning exercise.
Choosing a lawful immigration route after divorce
Compare each possible route against what you will genuinely do in Mauritius. A job-based application needs qualifying employment. A retired route should not be used to conceal work, and a visitor status should not be treated as work permission.
Timing matters. The six-month provision for a non-citizen divorced from a Mauritian citizen is a statutory end point for that marriage-based status, not a promise that another application will succeed. Any notice from the Director-General of Immigration requires prompt attention because it may specify when the person must leave.
If the family is separated but no divorce has been completed, the dependent permit after separation guide addresses the earlier stage. The Mauritius expat legal hub brings the immigration issue beside family, work and property. The final plan should rest on written permission, not an assumption drawn from family ties.
Frequently asked questions
After divorce, can a foreign spouse stay in Mauritius?
Possibly, but not merely because the former spouse remains in Mauritius. The Immigration Act 2022 addresses when marriage-based resident status ends, while a person who qualifies independently may apply under another route. This is general information; advice requires the divorce date, present permit and any alternative application to be examined.
Will filing for divorce cancel my Mauritius residence permit?
Filing starts proceedings but does not itself terminate the marriage. Separation may still affect an application that depends on living with a citizen spouse, and the authorities should receive accurate information. This is general information; advice on your status turns on the permit category, court stage and any notice issued by immigration.
Can I renew a spouse permit while the divorce is pending?
A pending divorce does not create a right to renewal. For the statutory spouse route, the immigration authority examines conditions including the marital and residential facts, so separation may be material before the marriage ends. This is general information; obtain advice before applying because an inaccurate or incomplete account can affect the decision.
