Mauritius dependent permits after separation

Separation can affect a Mauritius dependent permit because the permission may rest on the holder’s relationship to a sponsor. It does not automatically produce the same result as divorce, and the sponsor cannot personally make an immigration decision. The permit and the authority’s written record remain the starting points.

Separation can undermine a relationship-based dependent permit

The Immigration Act 2022 recognises residence routes for a spouse, dependent child, parent or other dependent of certain principal permit holders. The relationship is not background detail. It is part of the eligibility on which residence was granted.

A married couple who starts living apart remains married until the marriage is legally terminated. Yet the factual change may matter to a renewal, investigation or request for supporting information. A spouse should not state that family life continues unchanged if the parties have established separate homes.

There is no universal “dependent visa” result. A spouse of a Mauritian citizen may hold a temporary or residence permit under the statutory spouse route. The dependant of an Occupation Permit holder has a different source of status, while a Premium Visa family member holds visa permission on that scheme’s terms.

Separation, divorce and permit expiry are different events

Write down the date of physical separation, any family-court filing, the date of a final divorce decree and the permit expiry date. They may be months apart. Only the final legal event ends the marriage, but an earlier separation can still explain why documents or addresses no longer match.

For a person whose resident status derives from marriage, the Act addresses what follows when that marriage is terminated. It also addresses loss of status where the person no longer satisfies the requirements on which a permit was issued. These provisions should not be collapsed into an assumption that moving out cancels a card overnight.

If the marriage was dissolved abroad, first establish whether and how that event is effective for the Mauritian purpose in question. The guide to recognition of a foreign divorce in Mauritius separates authentication, civil-status registration and disputed legal effect.

Evidence the immigration authorities may request

Keep the permit, passport, marriage certificate and the principal holder’s permit details. Add proof of the present address, any written separation agreement, court application or decree, and correspondence in which the sponsor or authority discusses the permit. Documents should show dates, not simply allegations.

If safety or access to the family home affects what can be obtained, tell the Passport and Immigration Office which originals the other spouse holds. Do not manufacture joint-address evidence. A clear explanation of separate addresses is better than a document that gives a false picture.

Evidence prepared for family proceedings serves a different decision-maker. The guide to evidence and witnesses in Mauritian courts explains court proof, whereas immigration officers decide the administrative permit record. The same message or bank statement may be relevant for different reasons.

What happens to a child’s dependent status?

A child does not cease to be a child because the parents separate. Under the Immigration Act 2022, however, a dependent child must meet defined conditions concerning age, dependency, marriage and gainful activity. The child’s permit may also be linked to the principal holder’s continuing status.

Check which parent is named as the principal permit holder. Then ask whether the child remains attached to that permission and what happens if the child changes household. A custody order decides care and parental arrangements; it is not itself a residence permit.

Do not use an immigration application to settle a parental dispute. If a proposed move crosses a border, legal advice may be needed before travel. The immigration office should receive the child’s true living arrangements, while the family-law forum addresses custody and consent.

Moving from dependency to an independent permit

An independent route must match the person’s own activity. Employment may support an Occupation Permit application. A person working remotely for an overseas business may need to consider the conditions discussed in the Mauritius Premium Visa remote-work guide.

Neither route follows automatically from separation. The new application needs its own eligibility and documents, and work should not begin on the strength of a dependent permit unless that permission expressly allows it. Ask the authority how any change should be timed against the existing status.

A business or contract disagreement with the sponsor does not decide immigration status either. Where money, company interests or a foreign contracting party are involved, contract disputes involving a foreign party are analysed separately. Keep that claim out of the permit application unless the underlying document is genuinely relevant.

When to update the Passport and Immigration Office

Contact the office before renewal, before relying on the permit for travel, or when a sponsor says that cancellation has been requested. Give the permit numbers and exact relationship. Ask for the present recorded status and the documents needed to regularise any change.

The point most often lost in a difficult separation is who has legal authority. A sponsor may report facts or stop supporting an application. The Passport and Immigration Office and the responsible Minister exercise the statutory functions, and any notice should come through that official process.

The expat legal matters hub places immigration beside the related family and commercial issues. Keep the final correspondence. A dated answer from the authority is more reliable than either spouse’s interpretation of the card.

Frequently asked questions

Can I keep my dependent permit if we are separated but not divorced?

Separation does not itself end the marriage, but it can be material where permission was granted because you are the sponsor’s spouse. The Passport and Immigration Office should confirm how it records the change and whether the existing permission continues. This is general information; advice depends on the permit wording, sponsor’s status and the facts of the separation.

Does my sponsor have the power to cancel my Mauritius permit?

A sponsor can notify the authorities and may withdraw support for an application, but does not personally exercise the statutory power to end resident status. The decision belongs to the competent immigration authority under the legal process. This is general information; advice on a sponsor’s letter or threat requires the actual permit file and official response.

Will separation affect my children’s dependent permits too?

It may, particularly if the children’s permission derives from the same main permit, but a child’s eligibility is distinct from the spouse’s relationship question. The principal holder’s continuing status, the child’s dependency and the custody arrangements may all matter. This is general information; each child’s passport and permit should be reviewed before any conclusion is drawn.
