International secondments to Mauritius

An international secondment to Mauritius temporarily assigns an employee to work with a Mauritius host while preserving some relationship with the overseas employer. It should identify who employs, directs, pays and may dismiss the secondee. The assignment must also fit the permit granted for the Mauritius role before work begins.

Name the employer and avoid conflicting duties

A secondment commonly involves three documents: the existing home contract, an agreement between the two companies and a letter or agreement with the employee. They should tell the same story. If one document promises continuous home employment while another gives the host an unrestricted dismissal right, the structure is unstable.

State whether the home contract continues, is varied or is suspended for the assignment. Identify which entity owes salary, leave, benefits, payroll deductions and return travel. The document should also distinguish ending the secondment from ending the underlying employment.

The Mauritius employment-contract guide covers the core terms. A secondment schedule then adds the cross-border allocation instead of replacing those essentials.

Allocate day-to-day direction

The host will usually need authority over workplace hours, reporting lines, systems and local safety rules. The home employer may retain decisions about career, base pay or disciplinary action. Write down that division. Managers should know who approves leave and who handles a complaint.

Actual conduct can undermine the paperwork. If the host controls every aspect of the work and presents the secondee as its ordinary employee, a label alone may not resolve employer status. Control, integration, pay and termination powers all deserve review. Written job descriptions for the host role and the home role can also help show which entity actually directs the day-to-day work if that question is later disputed.

In practice, confusion first appears during absence or alleged misconduct. The local manager acts immediately, while the home employer expects prior approval. A short decision matrix prevents the employee from receiving incompatible instructions.

Secure the Occupation Permit before starting

The Passport and Immigration Office describes the Occupation Permit as a combined work and residence permission for qualifying foreign nationals. For the Professional category, the employer submits the application. Current official guidance specifically addresses professionals seconded for duty.

That guidance asks the Mauritius employer to provide the secondment agreement between the companies and a supporting letter. The letter identifies the job title, contract duration and monthly basic salary. Current thresholds and document lists should be confirmed with the Economic Development Board and Passport and Immigration Office. A secondee who continues to be paid and taxed partly in the home country should also keep evidence of that filing, since current guidance asks for proof of tax return when the permit is renewed.

Do not use a visitor entry to bridge a delayed employment permission. A planned assignment date is not authority to work. The broader legal setting is outlined in the Mauritian legal system explained.

Define pay, benefits and relocation support

The package may contain home salary, Mauritius payroll, housing, school costs, travel, medical cover and tax preparation support. Allocate each item to a payer and state its currency. Explain which items continue during sickness, leave or an early return.

Tax equalisation wording needs precision. It should say who prepares filings, who pays advisers, how hypothetical tax is calculated and how a later assessment is handled. It should not promise a tax outcome that depends on two countries’ laws and any applicable treaty.

The Mauritius Revenue Authority operates PAYE for chargeable employment income and requires employee information in employer returns. Cross-border residence, source and social contributions require current advice in both countries. Avoid copying day counts or rates from an earlier assignment. Both employers should also confirm which social-contribution scheme applies for the assignment period, since a Mauritius host and an overseas home employer may otherwise both assume the other is making the correct payment.

Protect information and intellectual property

A secondee may access the host’s client files while reporting into the home group. The agreement should define permitted access, authorised recipients and return or deletion of material. Confidentiality duties owed to one company must not require disclosure to the other.

New work product also needs an ownership route. Identify which entity receives intellectual property created during the assignment and whether further documents are required. Existing inventions, tools and know-how should be separated from new output.

The Data Protection Act 2017 governs personal-data handling in Mauritius. Moving personal data outside Mauritius generally requires that the receiving country protect it adequately, or that another safeguard in the Act applies, and the Data Protection Office administers that regime. Map where personnel and client data travel before granting group-wide access.

Separate assignment ending from dismissal

The host may no longer need the role, while the home employer still employs the individual. Equally, alleged misconduct in Mauritius may affect both relationships. The documents should state who investigates, who hears the employee and who makes each decision.

Set notice rules for the assignment and cross-reference the home contract. An immediate removal from host systems may protect information, but it is not itself a completed employment process. Salary, housing and immigration consequences still need lawful treatment.

The Workers’ Rights Act 2019 guide explains the Mauritius framework in general terms. Which rules apply to a particular secondee turns on status, documents and the work actually performed.

Document repatriation and the return role

A return clause should name the destination, target role or method for identifying it, reporting line and treatment of assignment allowances. State which party funds travel and removal costs. Deal separately with a family’s reasonable departure arrangements and the employee’s work obligations.

Promises such as “a comparable role” need measurable content. Location, seniority, pay basis and reporting level may matter more than job title. If no role is assured, the document should not imply otherwise.

The point often overlooked is timing after an early end. Permit status, housing and school terms may not finish together. For the reverse arrangement, see a Mauritius employee working remotely abroad. The employment and workers’ rights practice covers secondment drafting and disputes.

Frequently asked questions

Who is my employer while I am seconded to a Mauritius company?

The documents may keep the home employment alive while giving the Mauritius host defined operational duties. The legal answer depends on the contracts and how control, pay and termination work in practice. This is general information; advice on your facts requires the home contract, secondment agreement and host terms.

Do I need a new permit for a group-company secondment to Mauritius?

A group relationship does not itself authorise work in Mauritius. The current Occupation Permit guidance asks the Mauritius employer for the inter-company secondment agreement and a supporting letter for a seconded professional. This is general information; the permit route should be confirmed for the proposed role before work starts.

Can my home employer end my overseas role before the secondment finishes?

Early termination may be possible under the home contract and secondment terms, but ending the assignment and ending employment are distinct decisions. Notice, return work and permit consequences should be addressed separately. This is general information; advice depends on the signed documents and stated reason.
