Overstaying and immigration offences in Mauritius

An immigration overstay in Mauritius occurs when a non-citizen remains after the permission recorded for that person has expired or been cancelled. The Immigration Act 2022 treats remaining without the required status, without reasonable excuse, as a criminal offence. The first task is to establish the exact permission and date, then approach the Passport and Immigration Office with accurate records rather than testing the issue at the departure desk.

An overstay begins with the actual permission and expiry record

A passport stamp, visa approval, extension letter or electronic permit record should show the authority to remain and its end date. The date on an airline ticket, hotel booking or insurance policy does not extend immigration status. Nor does an unanswered renewal request necessarily amount to permission.

Collect every passport used for the trip, including an expired one. Add the arrival stamp, visa email, extension application, submission receipt, and any message from immigration. If two records conflict, do not choose the more favourable date without explanation. The original record matters.

Section 36 of the Immigration Act 2022 expressly addresses a person who remains after a permit or visa has expired or been cancelled without reasonable excuse. It also covers remaining without citizenship, residence or a visa. That wording makes both status and explanation relevant, but neither should be guessed.

Visa, Premium Visa and residence permissions must not be confused

A visitor visa, its extension, a Premium Visa and a residence or occupation permission serve different purposes. The Passport and Immigration Office publishes separate routes for visa extensions and Premium Visas. It also deals with residence and occupation permits, while occupation-permit applications involve the Economic Development Board.

Check the title printed on the approval. A remote worker holding a Premium Visa should not describe it as a work permit. Equally, a person whose employment ended must identify whether that event affected a work permission, residence permission, or both.

In practice, the difficulty often begins with a label used casually in emails. The immigration record, not the label chosen by an employer or agent, controls the enquiry. Alleged alterations or fabricated approvals raise a distinct issue addressed in the guide to false permit documents in Mauritius.

Contact with the Passport and Immigration Office before departure

The Passport and Immigration Office is the public authority responsible for immigration services and border control. Its published visa-extension checklist asks for the passport biographical page, the arrival-stamp page, travel reservation, financial evidence and accommodation evidence. It also states that applicants should call personally.

If the authorised stay has already ended, ask the office what it requires in that situation. A late application is not the same as an application made before expiry. Give the real dates. A misleading account can create a separate allegation under the Immigration Act 2022.

Going straight to the airport can leave too little time to examine a disputed date, retrieve a missing approval or obtain advice. It may also turn an intended departure into questioning at the border. Contacting the authority does not secure regularisation, immunity or permission to travel, but it permits an informed next step.

Documents explaining illness, cancelled travel or administrative error

A claimed reasonable excuse needs evidence tied to the period of overstay. For illness, obtain contemporaneous medical certificates, admission and discharge records, travel-fitness advice and proof of when you recovered sufficiently to act. A diagnosis alone may not explain why no extension request could be made.

For cancelled travel, retain the original itinerary, cancellation notice, rebooking exchanges and refund record. If an online application failed, preserve the confirmation screen, reference number and technical correspondence. Where an employer or agent said that renewal was complete, keep the unedited message and ask for the filing receipt.

The point most often missed is timing. Evidence should explain not only why the permission expired, but what happened from that date until contact with the authority. Do not manufacture a later explanation or alter a document. The resulting allegation may be more serious than the initial overstay.

What happens during questioning, arrest or a court appearance?

An immigration officer may ask for identity, travel and status records while investigating the suspected breach. Answering without preparation can be risky where dates are uncertain or an agent handled the application. Ask to understand the allegation and obtain legal assistance before giving a detailed written account.

Arrest is possible in a criminal investigation, but it is not an inevitable result in every late-stay case. If a provisional charge or formal charge follows, the court deals separately with release and any conditions. The general principles are explained in the guide to bail under the Bail Act 1999.

Keep the charge sheet, release document, summons and any condition concerning a passport or travel. Missing a court date because a flight was booked earlier can worsen the position. An attorney advises and drafts pleadings as well as conducting procedure, filing and service; a barrister advises, drafts and litigates. The guide on instructing a barrister through an attorney explains that division.

Leaving Mauritius does not erase future immigration consequences

Departure ends the physical period of remaining, but it does not rewrite the record. A later visa form, carrier check or border examination may require an accurate account of previous immigration difficulties. Whether another visit is allowed depends on the current law, the information held and the decision made on that occasion.

Ask for a copy or clear note of any written outcome before leaving. Retain proof that a fine, court requirement or reporting condition was addressed, if applicable. Never answer a future question as if the overstay did not happen merely because no one stopped the departure.

There can also be consequences beyond immigration. A missed flight may produce an insurance or compensation dispute, though that claim does not determine lawful status. The separate guide to a road accident compensation claim illustrates why criminal, administrative and civil questions should be kept distinct.

Correcting status and obtaining criminal advice promptly

Start with the date the permission ended, the reason it was not extended and the date the problem was discovered. Ask the Passport and Immigration Office what administrative route, if any, remains open. Then obtain criminal advice if there has been questioning, a warning, an arrest or a request for a statement.

Do not submit competing explanations through an employer, agent and personal email. One accurate account, supported by original records, is easier to assess. The criminal law practice addresses immigration-linked investigations and court proceedings, while the public authority decides status and admission.

Frequently asked questions

I overstayed my visa in Mauritius, should I go straight to the airport?

Do not assume that presenting yourself at departure will resolve an expired permission. Contact the Passport and Immigration Office first, disclose the true dates and ask what process applies before you book or change travel. That is general information; advice on whether you should attend an office, an airport or a police station depends on your documents and any existing contact with the authorities.

Can illness excuse an immigration overstay in Mauritius?

The Immigration Act 2022 frames remaining after a visa or permit has expired or been cancelled as an offence where there is no reasonable excuse. Medical records may therefore matter, but illness is not an automatic exemption and the dates must show how it prevented timely action. This is general information, and a barrister must assess the evidence and the statutory test on your facts.

Will a Mauritius overstay stop me coming back as a tourist?

A later admission decision may take account of the earlier immigration history and the explanation given, so departure should not be treated as wiping the record clean. Keep the written outcome and disclose the history accurately whenever an application asks for it. This general answer cannot predict the decision on a future application or admission at the border.
