Allegations of false permit documents in Mauritius

A false-permit allegation in Mauritius requires close attention to the precise document, how it was created and how it was used. A forged approval, an altered supporting certificate and a genuine permit used outside its conditions are different allegations. The accused person’s knowledge may be central, but the exact offence and evidence must be identified before any defence account is given.

A false-document allegation turns on the document and the user's knowledge

Obtain a clear copy of the item said to be false. Is it a permit, an approval email, a portal screenshot, a medical certificate, a qualification or an employer letter? The Criminal Code contains offences concerning forgery and use of forged writing or certificates. The Immigration Act 2022 separately addresses false or misleading statements connected with admission or departure.

Do not assume that all those provisions require the same state of mind. The prosecution theory may concern making, altering, submitting, possessing or using the document. Ask which act is attributed to you and when it allegedly occurred.

A person who received a polished PDF from an agent may have a different account from a person who supplied altered source material. Yet saying “the agent did everything” is not evidence by itself. Messages, payments and portal activity must support it.

Work, residence and business permit records must be separated

A work permit is not interchangeable with an occupation permit or residence permit. Work permits for non-citizens are governed by the Non-Citizens (Employment Restriction) Act, and new and renewal applications are generally filed through the National E-Licensing System by the prospective employer.

An occupation permit combines authority to work and reside for the relevant category. The Economic Development Board’s published material directs occupation-permit applications through its online portal, while the Passport and Immigration Office has responsibility for immigration and permit services. Identify which authority’s record is in question.

A company registration or business licence does not prove that an individual may work. Nor does a residence document necessarily authorise the employment described by an employer. Put each approval beside the activity it was supposed to permit.

Who prepared, submitted and paid for the application?

Map the participants. Record who opened the portal account, held the password, scanned each document, translated it, clicked submit and received the approval. Then trace the payment from a bank statement or receipt to the agent, employer or authority.

The applicant may have signed an authority allowing another person to file. That document matters, but it does not answer what the representative uploaded. An employer’s human-resources officer may also hold correspondence never sent to the worker.

In practice, the disputed point often sits between two versions of the application. Preserve both. A draft sent for approval may differ from the final upload, and the file name alone will not establish who changed it.

Emails, portal records and original documents that trace the application

Keep the original email in its mailbox and export it in a form that retains header information. Save the attachment as received. Forwarding it repeatedly, printing it or taking a screenshot can strip useful data about its source and time.

Portal records may show an application number, account holder, submission time, document list, status changes and messages from the authority. Request the available record through the proper channel. Do not attempt to enter someone else’s account after the dispute begins.

Original passports, qualifications and civil-status records should be preserved safely. If police retain an item, ask for the applicable acknowledgement or inventory. A later criminal case depends on what was seized and examined, not on a recreated folder assembled months afterwards.

What happens when an agent supplied the disputed document?

Keep the engagement message, invoice, proof of identity supplied by the agent, advertising, voice notes and the complete conversation. Preserve the words used when the permit was delivered. A statement that it was “approved” may be relevant if the authority says no corresponding application exists.

Do not alert the agent by demanding a confession or proposing matching explanations. That can prompt deletion or produce communications capable of being misunderstood. Give the unedited material to the lawyer advising you.

The point most often missed is the applicant’s own contribution. Record which supporting documents you supplied, whether you checked the finished application and whether any inconsistency was raised. A defence should confront an uncomfortable message rather than leave investigators to discover it first.

Immigration consequences alongside any criminal investigation

A criminal allegation and current immigration status are separate, although they may arise from the same file. The Passport and Immigration Office may need to decide whether an asserted permission exists and what status now applies. A criminal court considers the offence charged and the evidence presented.

Do not treat a genuine-looking card as continuing authority once the issuing body disputes it. Ask the authority, through the appropriate process, for confirmation of status. The guide to the criminal court process in Mauritius explains the route from an allegation to a hearing without deciding the immigration question.

Parallel consequences are common in other criminal matters too. A fatal road accident, for example, may involve a criminal investigation and a separate insurance claim. Here, the separate track is the permit or residence decision. Evidence should be organised for each purpose.

Preserving a defence before giving a detailed account

Ask for the suspected offence and the document relied upon. Prepare a private chronology with the application steps, payments, travel, employment and every contact from the authority. Mark what comes from memory and what is supported by a record.

Legal advice should precede a detailed written explanation where a false document is alleged. If proceedings result in a conviction, appeal questions are governed by their own procedure and short time limits. The guides to a criminal appeal in Mauritius and Mauritian appeals generally explain those later stages; they are not substitutes for preserving the trial defence now.

The criminal law practice covers advice during investigation and representation in court. Status confirmation remains a matter for the responsible public authority. Keep those roles distinct from the first interview onward.

Frequently asked questions

What if my Mauritius permit agent submitted a fake document without telling me?

Preserve the instruction, invoice, payment, messages, uploaded files and every version the agent sent you. Do not delete an awkward exchange or contact the agent to agree a common account. This is general information; whether lack of knowledge answers the particular allegation depends on the charge and the evidence.

Can a false work permit allegation lead to arrest in Mauritius?

Yes, an allegation involving a false permit can lead to a criminal investigation and arrest, although neither is automatic in every case. Ask what offence is alleged and seek legal assistance before a detailed statement. That is general information, not advice on whether arrest or release is likely in your case.

How do I prove that a permit document was genuine when I received it?

Keep the original electronic file with its metadata, the portal notification, application reference and correspondence from the issuing authority. A screenshot or printed copy alone may not reveal its source. This general answer cannot determine authenticity; the authority record and, where disputed, technical examination may be required on your facts.
