Mauritius Occupation Permits after dismissal

Dismissal puts a Mauritius Professional Occupation Permit at risk because that permit rests on the approved employment. It does not become a general right to work for another business. The ending of the job, the permit cancellation and any challenge to the dismissal therefore need separate attention.

Dismissal puts an employment-based Occupation Permit at risk

The Immigration Act 2022 treats a professional as a non-citizen employed in Mauritius under a contract and registered with the Economic Development Board. The employer applies through the EDB for the permit authorising that employment. Those features explain why a dismissal affects more than salary.

Official permit guidance says an employer terminating a Professional Occupation Permit holder’s contract should inform the EDB’s Chief Executive Officer in writing. It also describes a cancellation letter and the return of original permit documents to the Passport and Immigration Office. Do not assume that the expiry date printed on the card survives the loss of its employment basis unchanged.

Most often, the missed point is the division of responsibility. Your former employer reports the termination, while the immigration authorities control the permit position. A private assurance from human resources cannot replace written confirmation from the responsible office.

Which dismissal documents should you obtain immediately?

Ask for the dated termination letter, the stated reason, the effective date and a copy of the signed employment contract. Keep recent payslips and any notice, disciplinary invitation or outcome letter. These records show exactly when the approved employment ended and whether the employer describes the event as dismissal, resignation or expiry.

Retain a clear copy of the Occupation Permit, passport identity page and UID card before any original is surrendered. If family members hold linked permits, copy those too. The wider Mauritius Occupation Permit guide explains why the permit category and supporting contract must be read together.

A cancellation letter matters for the next application. EDB guidance for changing company says the former employer’s cancellation letter accompanies the new application, and its date should cover the submission date. If the employer will not provide a copy, record the request and ask the EDB what evidence it will accept.

Notifying the EDB and Passport and Immigration Office

The official guidance gives the former employer an immediate reporting role when it terminates a professional’s contract. It directs the cancellation letter to the EDB. It also states that original Occupation or Residence Permit documents and the UID card should be returned to the Passport and Immigration Office.

Ask both offices to identify the status they have recorded and any document still required. Use the permit number, employer name and termination date in the enquiry. This is especially important if the employer says it has sent notice but cannot produce an acknowledgement.

The EDB administers and registers the professional application, while the Passport and Immigration Office issues and controls immigration permission. That institutional split is part of the Mauritian legal system’s division of functions. Correspondence addressed only to one office may not answer what the other has recorded.

Can a new job preserve your immigration position?

A new job can support a fresh Professional Occupation Permit application, but the old permit does not transfer. Under the current Immigration Act 2022 process, the employer may apply to the Director-General of Immigration through the National Electronic Licensing System. The EDB and Passport and Immigration Office verify completeness before the statutory approval process continues.

Official guidance says the signed contract should identify the applicant, company, job title, contract duration and basic salary. Current eligibility criteria and documentary requirements should be checked on the day of filing. They can change, and an old approval is not evidence that a new role qualifies.

Do not begin the replacement role merely because papers were uploaded. Seek written confirmation of permission to work and the approved start position. The practical sequence is examined in changing employer on a Mauritius Occupation Permit.

What happens while the dismissal itself is disputed?

A dismissal may be contested under the Workers’ Rights Act 2019 or another applicable employment framework. That challenge concerns the employment relationship and available remedies. It does not, by filing alone, recreate the approved job or compel the immigration authorities to keep the permit open.

Keep the two files aligned without confusing them. A termination letter, disciplinary record or later settlement may be relevant to the employment dispute. For immigration, the central questions remain whether the approved employment continues and what lawful status has been granted in its place.

In practice, difficulty arises when one adviser is shown the claim form and another sees only the permit card. Give each the complete chronology. If dismissal affects a spouse’s ability to remain, the separate guide to foreign divorce recognition and linked status questions illustrates why personal status and immigration permission must not be treated as one issue.

Planning lawful status before the permit is closed

First establish whether the authorities still record the permit as valid and on what conditions. Then identify the route that genuinely fits the next activity. It may be a new professional application, another category for which you independently qualify, or permission connected with a family member.

None is an automatic conversion. A pending job interview, property ownership or unresolved dismissal claim does not itself authorise work or residence. Dependants also need their linked position checked because the Passport and Immigration Office states that their permission cannot exceed the main holder’s permit.

Allow the written response to govern travel and start dates. The expat legal matters hub gathers the related family, employment and residence issues. The safest practical result is a dated written record showing which permission applies after the old employment ended.

Frequently asked questions

What happens to my Mauritius permit when my job ends suddenly?

A Professional Occupation Permit is tied to the employment on which it was granted, so sudden dismissal places its basis at risk. The employer should notify the Economic Development Board, and cancellation involves the Passport and Immigration Office. That is general information; advice on your position requires the permit, termination letter and any new application to be checked together.

Does an unfair dismissal claim keep my Occupation Permit valid?

No automatic protection arises merely because the dismissal is challenged. Employment rights and immigration status are separate, although the same termination documents may matter to both. This is general information, and advice on a particular claim must consider its procedural stage and the written position of the immigration authorities.

What should my employer give me when cancelling my permit?

Ask for the signed termination letter and the cancellation letter sent to the Economic Development Board, each showing the relevant date. Keep copies before original permit documents or the UID card are returned to the Passport and Immigration Office. This is general information; advice on what else is required depends on your contract, permit category and next immigration route.
