Changing employer on a Mauritius Occupation Permit

Changing employer on a Mauritius Professional Occupation Permit requires a new application. The existing permit belongs to the approved employment arrangement and does not follow the worker automatically. Dates should be coordinated before resignation so that permission to reside and work is not assumed during a gap.

An Occupation Permit does not transfer automatically

The Immigration Act 2022 defines a professional by reference to employment under a contract and registration with the Economic Development Board. Under the current process, the employer may apply to the Director-General of Immigration through the National Electronic Licensing System. A new company therefore brings a new applicant employer, contract and assessment.

EDB guidance describes this as applying with a different company, not amending the old employer’s name on the card. It calls for a cancellation letter from the previous employer. The EDB or Passport and Immigration Office may also ask for a no-objection letter or further information from that employer.

This distinction matters even where both companies belong to one group. The legal employer named in the contract and application must match the proposed role. A group transfer letter should not be treated as immigration approval.

When should the new employer apply to the EDB?

Application planning should begin once the new contract terms are settled and before the old permission is surrendered. The aim is to have the new file ready when the former employer’s cancellation letter can properly cover its submission. Official guidance expressly says the cancellation-letter date should cover the date the new application is submitted.

That does not mean the two approvals overlap. Ask the EDB how it wants the sequence handled for the particular change. The current permit number, proposed final working day, notice period and intended new start date should appear in the enquiry.

In practice, the delay often sits between the commercial hiring decision and a contract suitable for filing. A verbal offer is not enough. The new employer must take responsibility for the professional application and the undertaking required by the Immigration Act 2022.

Documents linking the new role to the application

The published guidelines say the signed contract should state the professional’s passport name, company name, job title, contract duration and monthly basic salary. The employer submits through the licensing system and signs the prescribed undertaking. A secondment also needs documents linking the companies and the assignment.

Prepare the passport identity page, existing permit and UID card, old and new contracts, resignation acceptance or termination letter, and former employer’s cancellation letter. Check the current online checklist before filing. Salary criteria and document formats are administrative requirements that may change.

Other personal commitments do not replace this evidence. Buying a home under an approved route is a different legal question, explained in the guide to non-citizen property restrictions. Property ownership should not be presented as permission to take the new job.

Resigning before the replacement permit is approved

Resignation may start the contractual notice period, but it does not approve the next employment. If the former employer cancels promptly and the new application is incomplete, the worker may face a period without the expected basis of status. The printed expiry date alone does not resolve that risk.

Do not work for the new company on the strength of an upload receipt or appointment booking. Ask for written confirmation of what the present permission allows. If an application is refused or the existing status ends, travel and continued residence may need immediate review.

An immigration disagreement is not automatically a court case. The first record usually lies with the responsible authorities. If proceedings do become necessary, the structure of the Mauritian courts explains the separate roles of the courts, but it does not replace the permit application route.

What happens to dependants during the change?

The Passport and Immigration Office states that dependants of an Occupation or Residence Permit holder may apply for residence permission lasting no longer than the main holder’s permit. A spouse’s or child’s position is therefore not safely assessed by looking only at the date on their own card. The main permission matters.

List every linked family permit when asking about the employer change. Include passport details and expiry dates, and ask whether fresh or linked applications are required. A child’s school attendance does not itself extend immigration permission.

Parental responsibility and immigration status also answer different questions. Where travel or living arrangements are contested, see the separate discussion of cross-border child custody in Mauritius. If a family relationship is itself changing, residence after divorce requires its own analysis.

Coordinating notice, cancellation and the new start date

Put the three dates on one page. Record the final day under the old contract, the cancellation letter’s effective date and the proposed first day with the new company. Add the submission date and every written response from the EDB or Passport and Immigration Office.

There is no benefit in making the chronology look tidier than it is. If the employer brought a date forward, or an application was returned for missing information, state that plainly. The authorities need the real sequence.

The legal hub for expatriates in Mauritius links the permit issue with employment, family and property questions. Before starting the replacement role, obtain a clear written basis for both work and residence. That single point prevents most of the ambiguity created by an employer change.

Frequently asked questions

Can I start my new job before my new Occupation Permit is approved?

Do not treat submission of an application as permission to start. A Professional Occupation Permit authorises the approved employment, and the replacement role needs its own approval. This is general information; advice on your proposed start date must be based on written confirmation from the EDB or Passport and Immigration Office.

Will my old employer have to cancel my Mauritius permit?

The official guidance requires a cancellation letter from the former employer when a professional applies with a different company. It also says an employer terminating the approved contract should notify the EDB in writing. This is general information; advice on a reluctant former employer depends on the documents and the authorities’ response.

Can I change employer without leaving Mauritius?

An in-country change may be possible where you retain valid status and the authorities accept the new application, but it should never be assumed. A refusal or gap in permission can alter the position quickly. This is general information; obtain advice on your dates, current permit and travel plans before resigning.
