What happens after a money-laundering allegation in Mauritius?

A money-laundering allegation in Mauritius concerns property said to come from crime and the way a person dealt with it. The enquiry may begin with a bank transfer, cash, a vehicle, company receipts or another asset. It can proceed separately from any charge for the alleged original crime. The transaction history and the person's state of knowledge are usually central.

A money-laundering allegation focuses on property and suspected criminal origin

The Financial Crimes Commission Act 2023 contains the current money-laundering offences. Its definition of property is broad and includes tangible assets, bank balances and interests in property. The allegation should therefore be tied to identified property and a suspected criminal source, not treated as a general criticism of wealth.

The Financial Crimes Commission is the present body responsible for detecting and investigating financial crimes under that Act. It took over relevant functions previously held by ICAC and other bodies when the Act commenced on 29 March 2024. Older correspondence may still carry a former body's name.

Ask what property is in issue, which transactions are questioned and what criminal origin is suspected. That framing prevents a response from becoming an unfocused account of every financial event in your life.

The first request for interview, documents or account information

A request may come from investigators, the police, a bank or another institution performing legal duties. Establish who made it, whether it is voluntary or compulsory, its stated legal basis and the time allowed. Preserve the complete notice and envelope.

Do not ignore a lawful demand. Equally, do not send an unstructured archive without understanding its scope. Personal, company and third-party records may have different owners and confidentiality concerns.

If an interview is proposed, obtain legal advice before it begins. A careful response can distinguish memory from documents and personal knowledge from information supplied by an accountant. The guide to police custody and detention rules in Mauritius addresses the separate position after arrest.

Tracing the transaction from source to beneficial recipient

Begin with the asset that investigators identify. Trace it backwards to the payer and forwards to the person who ultimately benefited. Intermediate accounts, currency conversion and payments to suppliers should remain visible rather than collapsed into one net figure.

The bank statement shows movement, but rarely the whole purpose. Match each entry with the underlying invoice, loan, dividend, sale, gift or reimbursement. Note who authorised the payment and who controlled the receiving account.

In practice, unexplained gaps cause more difficulty than a long chain. A missing cash deposit slip or unsigned loan document may break an otherwise coherent account. It is better to identify the gap honestly than invent a date or purpose.

Bank statements, contracts and business records that explain the funds

Obtain statements from the source account and receiving account, not screenshots of selected transactions. Keep transfer confirmations with their reference fields. For a sale, retain the agreement, ownership proof, invoice, delivery evidence and any tax or accounting entry.

Company money requires the company's records. Board minutes, ledgers, payroll data and contracts may show why funds moved through a director's account or to a related entity. A later explanation cannot safely replace records created at the time.

Where the payment came from abroad, use records from that jurisdiction and arrange an accurate translation if needed. The structure of the Mauritian courts becomes relevant only if investigative steps lead to applications or criminal proceedings.

What happens when accounts or assets are restrained?

The Financial Crimes Commission Act 2023 provides criminal and civil asset-recovery routes. An attachment order preserves property while an investigation or proceeding is ongoing. It does not by itself determine that the owner committed money laundering.

Obtain the order and identify the property it covers. Check whether it extends to substituted assets, income or jointly held funds. The person affected may need a variation for a defined payment rather than a blanket request to restore every transaction.

Do not move or disguise property after learning of a restriction. If a bank account is affected, the separate guide to a frozen bank account in a Mauritius investigation explains how to distinguish a compliance hold from a court-backed order.

Parallel exposure for companies, directors and professional advisers

A transfer through a company can prompt questions about the company and the individuals directing it. The 2023 Act contains provisions concerning obligations and liability of legal persons. The precise exposure depends on acts, authority and evidence, not job title alone.

Directors should preserve minutes, mandates and delegated authorities. Employees should keep instructions and contemporaneous queries. Professional advisers must consider their own duties before disclosing client material or continuing an engagement.

Joint representation can create conflict. A company may need to explain its controls while an officer gives a different account of authorisation. Separate advice should be considered before accounts are aligned informally.

Preparing a documented response without contaminating evidence

Preserve original files and create working copies for review. Do not backdate a contract, complete an old blank form or ask a witness to adopt your wording. A correction should be openly dated and explained.

Build the response around the allegation's actual components. Identify the property, legitimate source, transfer purpose, decision-maker and ultimate recipient. Mark what remains unknown and who may hold the missing record.

Bail may become an immediate issue if the investigation leads to arrest. The overview of bail under the Bail Act 1999 explains the general framework. The criminal-law practice covers representation during the investigation and any resulting proceedings.

Frequently asked questions

Can I be accused of money laundering without being charged with the original crime?

Yes. A money-laundering enquiry may focus on property alleged to derive from crime even where you are not charged with committing that underlying crime. The prosecution must still establish the offence it alleges. This is general information; advice depends on the charge, the suspected criminal source and your knowledge or grounds for suspicion.

Should I answer questions about a bank transfer during a Mauritius investigation?

Obtain legal advice before a formal interview, then decide how to address the request using accurate records. Do not guess about the sender, purpose or route of funds, and do not alter related messages. That is general information, not advice on whether to answer a particular question or exercise a right in your case.

How do I explain legitimate funds sent to me by a relative overseas?

Show the relationship, the relative's source of funds, the reason for payment and the route into your account. Useful records may include payslips, sale papers, inheritance documents, bank statements and the original transfer instruction. These are general evidential points; advice on sufficiency requires review of the actual transaction and allegation.
