A frozen bank account in a Mauritius criminal investigation cannot be dealt with until you know the legal source and exact scope of the restriction. The bank may have imposed its own temporary compliance hold, or it may be obeying an order affecting the money. Those positions require different responses. Neither should be inferred from a declined card alone.
First establish who froze or restricted the bank account
Ask the bank whether the whole account is blocked, only certain transactions are paused, or a stated amount is unavailable. Request the effective date and a reference number. Also ask whether the restriction comes from the bank, an investigating body or an order.
The bank may not be able to reveal every investigative detail. That does not prevent it from confirming routine facts such as which account is affected and whether standing orders will be honoured. Keep screenshots of error messages and copies of unanswered payment instructions.
Do not assume that an investigation means arrest is inevitable. If police action does follow, the guide on being arrested in Mauritius addresses the first decisions in custody.
A bank compliance hold differs from a court-backed restraint
Banks supervised by the Bank of Mauritius must perform customer due diligence and transaction monitoring under the anti-money-laundering framework. A bank may therefore ask about a payment or update identification before deciding what service it can provide. Its account terms and regulatory duties shape that process.
A court-backed restraint has a different source. The Financial Crimes Commission Act 2023 allows the Commission to seek criminal or civil attachment orders from a Judge. Such an order can preserve property during an enquiry or proceeding and may direct how it is held.
The distinction changes the remedy. A missing identity document may be resolved through the bank's compliance team. An attachment order normally requires engagement with the order and the legal route available to an affected person.
Obtaining the order, notice and reasons that can lawfully be disclosed
Ask for any notice served on you and identify the order's date, issuing authority and case reference. Read its operative terms. The title alone will not show whether deposits, withdrawals, interest or only a specified sum are covered.
The 2023 Act contains notice provisions for attachment orders and routes concerning further orders, exclusion, variation or rescission. Whether a copy can be obtained immediately depends on the process and your status. Counsel can seek the material needed to understand and respond to the restriction.
Some restrictions arise outside that Act, including banking-law or sanctions measures. Do not label every blocked account a Financial Crimes Commission order. The document or bank confirmation should identify the correct regime.
Evidence showing salary, business receipts and other legitimate funds
Trace deposits individually. Salary can be supported by employment terms, payslips, payroll records and matching transfers from the employer. Business receipts should connect invoices and delivery evidence to the business account and its ledger.
For a loan, gift or family transfer, obtain the sender's bank statement, source record and contemporaneous explanation. Cash requires closer work because the bank trail begins only at deposit. Receipts, withdrawals from another account and accounting entries may help.
In practice, a label such as “family support” proves little without the source behind it. A short, documented chain is stronger than a long witness statement unsupported by records. The aim is to distinguish legitimate money from the property identified in the allegation.
What happens to rent, wages and ordinary living expenses?
An automatic debit may fail even though the underlying rent, loan or wage obligation continues. Tell the landlord, lender or employee only what is necessary, without speculating about criminal liability. Ask the bank whether incoming credits will also be trapped.
Under the Financial Crimes Commission Act 2023, a Judge may make provision for reasonable living expenses in connection with an attachment order. The statutory route depends on whether the order is criminal or civil. The applicant may need to show that other property cannot meet the expense.
Prepare a realistic schedule supported by the lease, utility bills, school costs and account history. For a business, separate personal outgoings from wages and essential trading payments. The law does not treat every requested transfer as a living expense.
Third-party and joint-account interests in restrained money
A joint account gives more than one person banking rights, but it does not prove that each owns half of every deposit. Trace the spouse's salary, sale proceeds or savings into the account. Retain the account mandate and any agreement about beneficial ownership.
The 2023 Act permits a person with an interest in attached property to apply for exclusion in stated circumstances. The questions include the property's character, the applicant's involvement and what the applicant knew when acquiring the interest. The exact test depends on the order.
A supplier or employee expecting payment is not necessarily an owner of the balance. Their contractual claim may still matter, but it should not be confused with a proprietary interest. Early classification keeps the application focused.
Applying to vary or challenge the restriction
Choose the application from the document, not from the word “frozen”. A bank review, request for further reasons, expense application, exclusion claim and challenge to an order are different steps. Each needs evidence directed to its legal test.
For an attachment order under the 2023 Act, an affected person may have a route to seek further directions, exclusion, variation or rescission. Do not transfer funds through another account to defeat the restriction. That can create a new evidential problem.

Frequently asked questions
Why has my Mauritius bank frozen my account without warning?
The restriction may arise from the bank's compliance checks, a suspected-fraud response or an order obtained during an investigation. The bank may be limited in what it can disclose immediately, but you can ask for the restriction's scope and the documents it may lawfully provide. This is general information; advice requires the bank's notice, account terms and any order.
Can I access money for living expenses during a criminal investigation?
Possibly. The Financial Crimes Commission Act 2023 permits a Judge to provide for reasonable living expenses in connection with criminal or civil attachment orders, subject to statutory conditions. This is general information, and any application must be framed around the actual order, available unfrozen property and documented needs.
What can my spouse do if our joint account is frozen in Mauritius?
Your spouse should obtain the order or bank explanation, prove their interest and trace their own contributions to the account. The 2023 Act provides routes through which a person with an interest may seek exclusion or variation, depending on the order involved. Those are general routes; advice depends on ownership, knowledge, the source of deposits and the wording of the restriction.
