Can a Mauritius employee work remotely abroad?

This is not legal advice. This guide is general legal information for Mauritius and does not replace a consultation with a lawyer who has the full context of your case.

A Mauritius employee can work remotely from another country only after the employer and employee have checked more than the laptop connection. Consent, immigration permission, employment terms, tax, social contributions, data security and insurance may all change when the work location crosses a border. A short stay is not automatically exempt from those questions.

Obtain employer consent before leaving

An employment contract often names the normal workplace or requires attendance in Mauritius. Working from another country changes availability, supervision, security and sometimes the employer’s regulatory exposure. The employee should therefore request approval before booking travel or beginning work abroad.

Mauritius has Workers’ Rights (Working from Home) Regulations 2020, which use a written agreement and identification of the proposed work location. An overseas arrangement raises issues beyond ordinary homeworking. The written approval should name the country, address, dates and permitted duties. Those regulations were designed for a home address within Mauritius, so an employer approving work from a foreign country should still use the same written form and add any extra terms the overseas location requires.

Silence is not reliable consent. Nor is a manager’s casual message necessarily authority to change payroll or immigration arrangements. Employers should state who approves the request and what information must first be cleared.

Check the destination country’s permission

A tourist or visitor status should not be assumed to permit ordinary employment activity. Each destination defines work and its exemptions differently. The employee’s nationality, immigration status, length of stay and purpose can alter the answer.

France illustrates the point. Official French guidance states that a non-European foreign employee generally needs work authorisation unless a particular status or exemption applies. France-Visas also distinguishes salaried work and temporary assignments. Remote work for a Mauritius employer should be checked against the worker’s actual French status.

If the employee is already a citizen or resident of the destination, that may answer immigration but not payroll, social-security or employment questions. For the reverse situation, see employment rights for expatriates in Mauritius.

Identify the employment laws in play

Keeping a Mauritius contract does not necessarily exclude mandatory rules where the employee physically works. The destination may apply local minimum protections, working-time rules, safety duties or dismissal requirements. The answer depends on its conflict-of-laws rules and the circumstances.

The Mauritius employer should still examine its duties under the Workers’ Rights Act 2019 and the contract. Record which public holidays apply, how time zones affect ordinary hours and who may instruct the employee. Avoid offering two inconsistent leave calendars.

A dispute can raise questions in more than one country. The general structure of the Mauritius courts does not determine whether a foreign forum also has jurisdiction. Forum and governing-law clauses deserve review before approval.

Review tax, payroll and social contributions

The Mauritius Revenue Authority operates PAYE for chargeable employment income. Physical work abroad may affect the income’s source, the employee’s residence position and the employer’s reporting. The destination may also impose payroll withholding or employer registration.

Two possible charges do not automatically mean final double taxation. A tax treaty or domestic credit may provide relief, but its conditions must be checked. The employer should obtain current advice for both countries and keep the written analysis supporting payroll treatment.

Social-contribution rules require their own answer. They do not always follow income-tax residence. Neither party should promise continued Mauritius-only deductions until the foreign position and any coordination arrangement have been confirmed.

Control data, equipment and confidentiality

Remote access can move personal data outside Mauritius even when files stay on a Mauritius server. Remote access to Mauritius systems from abroad can itself amount to a transfer of personal data outside the country, which the Data Protection Act 2017 and the Data Protection Office’s transfer rules govern. The Act therefore belongs in the employer’s approval review.

Specify the device, approved connection, storage location, printing restrictions and response to loss or theft. Some work should not be performed from shared accommodation or public wireless networks. Client secrecy and contractual confidentiality may demand controls beyond ordinary staff data.

Equipment responsibility must be practical. State who pays for secure connectivity, repairs and return shipping. The employee should know whether local technical support may access the device and what happens if customs retains it.

Plan for accident or illness abroad

The Occupational Safety and Health Act 2005 sets workplace safety duties in Mauritius, while the destination may impose its own duties. The employer should assess the actual overseas work setting rather than treat it as private travel. Emergency contacts and reporting routes should work across time zones.

Travel insurance frequently differs from employment or work-injury cover. Read territorial limits, excluded activities and maximum trip periods. Confirm whether medical evacuation, sick pay and replacement travel are covered, and who bears any uninsured amount. A short written note from the insurer confirming that work abroad is covered is more useful during a claim than the general wording of the policy alone.

In practice, the gap appears after the event. The employee reports an accident to a travel insurer, while the policy excludes work. Written confirmation from the insurer is more useful than assuming the word “worldwide” answers every condition.

Put the arrangement and return date in writing

The approval should state the overseas address, start and end dates, working hours, duties, salary currency and reporting line. Add tax cooperation, data controls, equipment, insurance and the circumstances for early recall. Make clear that any extension requires fresh written approval.

The return date matters. It allows the employer to plan office attendance and keeps a temporary arrangement from becoming indefinite by drift. A review date can address a changing immigration status without promising renewal.

Working abroad without permission may prompt disciplinary action, but process and proportionality still matter. Employees can read about unfair dismissal in Mauritius, while employers should consider the lawful dismissal guide. The employment and workers’ rights practice covers cross-border work terms and disputes.

Frequently asked questions

Can I work from France for my Mauritius employer without changing my contract?

Do not rely on the unchanged contract alone. Your employer should approve France as the work location, and your French immigration status must permit the proposed work. This is general information; advice should be taken in Mauritius and France before departure.

Could my employer dismiss me for working overseas without permission?

Unauthorised overseas work may breach location, instruction, security or attendance terms and can lead to disciplinary action. Dismissal is not automatic, and the employer should identify the allegation and follow the applicable process. This is general information; advice depends on the contract, policies, conduct and response.

Who pays for equipment and insurance when I work abroad temporarily?

The written arrangement should allocate equipment, connectivity, repairs, travel cover and work-injury insurance before the employee leaves Mauritius. Existing policies may exclude work or extended stays abroad. This is general information; the contract and policy wording must be checked for the proposed country.
