Foreign residents employing household staff in Mauritius

A foreign resident who directly hires a nanny, cleaner, gardener, carer or household driver in Mauritius generally becomes that person’s employer. The arrangement is not made informal by cash payment, part-time hours or work inside a private home. Written terms, lawful work status, pay records and Mauritius Revenue Authority contributions should be settled from the start.

A household hirer becomes an employer

The Workers’ Rights Act 2019 uses a broad idea of an employment agreement, which may be oral, written, implied or express. What matters is the working relationship. Regular personal service under the householder’s direction may carry employment duties even if both parties use the word “helper”.

Agency arrangements require a different reading. If an agency selects, pays and directs the worker, it may be the employer. A mere introduction does not necessarily have that effect. Ask who fixes hours, approves leave, bears payroll responsibility and may end the engagement. The answers often expose the real structure.

Check the worker may perform the job

A Mauritian citizen’s identity can be checked against the National Identity Card presented for payroll details. A non-citizen raises separate employment and immigration questions. The Passport and Immigration Office states that employment ordinarily requires the relevant residence permission as well as a work permit issued through the labour authorities.

A visitor’s status, a spouse’s permit or an approval tied to another employer should never be treated as automatic authority for household work. The proposed job must match the permission actually held. The Ministry’s work-permit guidance also identifies material specifically relevant to personal recruitment of a domestic worker. A domestic-worker application may carry its own supporting-document list distinct from other work-permit categories, so the current checklist should be obtained before assuming standard documents suffice.

See the related guide to migrant worker rights in Mauritius. In practice, the costly mistake is allowing work to start while somebody is still “sorting out” the permit.

Write duties, hours, pay and accommodation

The agreement should name the parties, start date, place of work, duties, ordinary hours, rest arrangements, wage and pay interval. State whether cooking, childcare, driving, elder care, pet care or overnight presence is included. A broad phrase such as “general household duties” invites disagreement when the role expands.

For a live-in worker, distinguish wages from accommodation and meals. Record the room provided, privacy arrangements, keys, visitors, use of utilities and what happens to accommodation when employment ends. The home remains a workplace. The worker’s residence there does not create unlimited availability.

Changes should be agreed and recorded, especially where childcare becomes nursing care or a cleaner is asked to drive. A fuller treatment appears in what to include in a Mauritius employment contract.

Settle registration and payroll at the outset

The Mauritius Revenue Authority provides a dedicated contribution service for private household employers. Its guidance covers Social Contribution and National Savings Fund reporting, and requires household employers to include every employee. It also provides monthly and annual filing routes, with quarterly statements applying in the annual route.

Do not copy a contribution rate or deadline from an old payslip. Rates, ceilings and filing instructions change. Obtain an Employer Registration Number and current filing instructions directly from the MRA before the first return falls due. The return itself should carry the correct identity number for each employee, since a mismatched or outdated number is a common reason a payment is later queried.

Payroll should separate basic wage, overtime, allowances and any end-of-year payment. Record deductions and employer contributions distinctly. The question is not only what reaches the worker’s bank account, but how the gross entitlement was calculated.

Keep records that explain each payment

Retain the signed agreement, identity details used for filing, permits where applicable, wage calculations and proof of payment. Leave taken, public-holiday work, sickness notifications and agreed changes in hours also belong in the employment file. A handwritten receipt should identify the pay period and components, not merely state that money was received.

Messages can prove instructions or changed duties, but they are poor payroll records. Export any important exchange before changing phones. If a dispute reaches a labour office or court, contemporaneous records are usually clearer than reconstructed recollections. The site’s guide to evidence and witnesses in Mauritius explains that distinction.

The point most often missed is accumulated service. A worker who attends only certain days may still have a continuous relationship deserving an accurate start date and leave history.

Plan for relocation from Mauritius

An employer’s departure does not quietly dissolve the contract. Check the agreed notice, outstanding wages, untaken entitlements, contribution record and any retirement-related amount. The answer may differ if the household member staying in Mauritius will continue the employment.

Tell the worker what is proposed before flights and shipping dates make the decision irreversible. If employment will transfer to another person, document whether a new employer is taking over and whether prior service is recognised. Do not describe a termination as a resignation merely because relocation leaves no work.

Long service may raise questions considered in retirement gratuity and pensions in Mauritius. Those questions should be checked before a final payment is labelled complete.

End the arrangement without an informal dispute

A lawful ending depends on the reason, the agreement and the governing employment rules. Misconduct allegations should be put clearly to the worker and handled through a fair process. Poor performance should not first appear in a dismissal message after months without any stated concern.

Where the reason is relocation or the household no longer needs the role, say so accurately. Calculate the final pay by component and give written confirmation of the last working day. Recover keys and property through an inventory rather than withholding earned wages as informal security.

Employment disputes rarely improve through hurried voice notes. A short, reasoned letter can distinguish notice, final pay, return of property and any reference. The employment and workers’ rights practice sets out the chambers’ work in this field.

Frequently asked questions

Can an expat employ a nanny directly in Mauritius?

Yes, a foreign resident may generally employ a nanny directly, but must assume the responsibilities of an employer. The worker must also hold any permission required for that particular employment. This is general information; advice on your facts should address both employment and immigration status.

Do I have to register as an employer if my cleaner works part-time?

Part-time status does not by itself remove contribution duties. The MRA has a specific filing route for private household employers, and its current instructions require all household employees to be included. This is general information; obtain advice on the cleaner’s true status and your filing position.

May I bring my existing domestic worker with me when relocating to Mauritius?

Do not assume that an overseas contract or your own residence permission authorises the worker to take employment in Mauritius. The Ministry responsible for labour and the Passport and Immigration Office publish separate work and residence requirements. This is general information; specific advice should be taken before travel or work begins.
