Who can occupy the Mauritius family home during divorce?

Either spouse may remain in the Mauritius family home by agreement, or one may ask the court for temporary sole use and occupation during divorce. The title deed is relevant but not always decisive for this interim question. Safety, children's daily lives, housing alternatives and payment obligations can all affect the order sought.

Ownership alone does not always decide who stays

A sole-name title proves registered ownership. A joint title records both owners. Neither document, by itself, answers who should physically occupy the home while matrimonial proceedings continue. Temporary occupation regulates present use; it does not necessarily determine the ultimate proprietary result.

The legal basis must still be identified. A spouse may occupy as owner, co-owner, tenant or family member under an arrangement that has never been written down. Matrimonial property questions also depend on the marriage certificate and any marriage contract. The guide to pensions and assets in divorce addresses the separate final financial enquiry.

Safety, children and practical housing needs shape the request

Where there is violence, threatened harm or coercive conduct, safety comes first. Police assistance and an application to the District Court for an exclusion order under the Domestic Abuse Act 2026 may be relevant rather than waiting for an ordinary divorce hearing; that order can require the other spouse to leave and grant exclusive occupation of the home, with an interim order available where the risk cannot wait. Immediate risk should be stated plainly, with dates and available supporting material.

Without a safety allegation, the court may still need evidence about children, school travel, caregiving and realistic alternative accommodation. Avoid presenting children as property attached to the house. Their arrangements are a distinct question. If a move could take a child out of Mauritius, the issues described in the international child-abduction guide may also require prompt advice.

Collect the title, lease, mortgage and household evidence

For an owned home, obtain the title deed, mortgage offer, current loan statement, insurance schedule and proof of repayments. For rented property, keep the lease, deposit record, rent receipts and correspondence with the landlord. Utility accounts may help show occupation but do not replace title or a lease.

Household evidence should match the reason for the application. School records may establish the children's routine. Medical material may explain a need for adapted accommodation. Photographs, messages and police records may support a safety account if lawfully obtained. The rules of proof are discussed in evidence and witnesses in Mauritius courts.

Seeking temporary exclusive occupation through the court

The Family Division of the Supreme Court hears divorce and related matrimonial matters. The Divorce and Judicial Separation Act provides that an application incidental to a divorce petition is made by motion. The precise pleading for sole use and occupation should be settled from the relief, stage of proceedings and existing orders.

State the property accurately and explain who lives there, why shared occupation is no longer workable and what order is requested. Address duration and necessary exceptions, such as supervised collection of belongings. In practice, applications become harder when “exclusive occupation” is used as shorthand without a proposed rule for access, children or household payments.

Belongings and access need workable directions

An excluded spouse does not lose ownership of clothes, records, work equipment or other possessions merely because access is restricted. Agree an inventory, collection date and neutral handover if it is safe. Valuable or disputed items should be photographed in place and listed before removal.

Keys, alarm codes and access by relatives or contractors also need attention. No one should use a child to carry messages or retrieve contested property. Where direct contact is unsafe, collection may need third-party or official arrangements. The order itself must be read closely; neither spouse should invent broader restrictions than its wording supports.

Mortgage, rent and utility payments continue

The lender's rights arise from the loan and security documents. If both spouses borrowed, sole occupation will not usually release one from the bank's contract. Missed instalments can affect both borrowers and the property, regardless of who sleeps there. The lender should receive accurate information, not an assumption about what the divorce court has changed.

Between the spouses, responsibility for mortgage, rent, rates, insurance and utilities can be addressed by agreement or within the appropriate financial application. Record payments by date and purpose. A spouse meeting the whole mortgage should not assume that each payment automatically creates the final property adjustment they prefer.

Occupation does not finally divide the home

A temporary order preserves living arrangements while wider questions remain open. Sale, transfer, co-ownership, mortgage discharge and the effect of the matrimonial regime require separate determination or agreement. Furniture and personal possessions may also follow a different ownership analysis from the land.

Do not sign a transfer or accept an offset merely to settle who stays this month. Obtain a current loan balance and a defensible property value first. If there is concern about sale, refinancing or dissipation during proceedings, see preserving assets before divorce.

Urgency determines the correct first application

A person facing immediate harm should not wait for routine correspondence between lawyers. The first route may involve the police and an urgent protection application in the District Court. An occupation dispute without that risk may instead be addressed within the Supreme Court matrimonial proceedings. They are not interchangeable simply because both can affect the home.

Bring the existing petition and orders, title or lease, a short incident chronology and the next immediate question. Counsel can then identify jurisdiction and relief before papers are filed. The family law and divorce practice covers occupation, protection and related financial issues during separation.

Frequently asked questions

Can I make my spouse leave the family home during divorce in Mauritius?

You should not use force or self-help. A court may be asked for temporary sole use and occupation, with the route depending on the pending divorce, safety allegations and the precise relief required. This is general information; urgent advice is needed on the evidence and the correct court application for your facts.

Do I have to leave because the house is in my spouse's name?

Title is relevant, but it does not by itself answer every temporary occupation question during a marriage and pending proceedings. Safety, children, alternative housing and the legal basis of occupation may also matter. This is general information; do not leave or remain in defiance of an order without advice on your position.

Who pays the mortgage if only one spouse stays in the house?

Exclusive occupation does not automatically rewrite the loan contract, so the lender may continue to look to each borrower named in it. Between spouses, temporary payment responsibility can be agreed or raised with related financial relief. This is general information; the mortgage, income evidence and any court order require individual advice.
