How can assets be preserved in a Mauritius divorce?

Assets may be preserved during a Mauritius divorce by seeking focused court relief before a threatened sale, withdrawal or transfer occurs. The application needs identified property and evidence of a genuine disposal risk. Separation alone does not justify freezing everything a spouse owns. Speed matters, but accuracy matters more.

Asset preservation is justified by evidence of a real disposal risk

A court is asked to restrain conduct, not punish suspicion. Useful evidence may include a signed sale mandate, instructions to a bank, a proposed share transfer or messages announcing an intended disposal. A sudden unexplained withdrawal can also matter. A general fear that money might disappear is weaker.

The matrimonial regime and ownership history remain central. They help explain why the asset may matter when the marriage is dissolved. The wider framework is set out in the guide to matrimonial property regimes in Mauritius. Preservation does not decide the final division.

Identify the property, account or shares that need protection

Name the asset precisely. For land, use the title details and the parcel or survey reference shown on the deed. For an account, record the institution, branch, holders and last four digits. For shares, identify the company, registered holder, class and number shown in the share register.

Overbreadth can obscure a sound request. An order directed at one house should not casually capture unrelated personal spending. Likewise, a business account used for wages and suppliers requires different treatment from an investment account holding sale proceeds.

Urgent court relief and the duty to present the position fairly

Divorce proceedings under the Divorce and Judicial Separation Act 1981 are entered by petition to a Judge in Chambers. The Family Division of the Supreme Court hears divorce, matrimonial and family matters. Its published jurisdiction also places interim family applications before a Family Division judge.

An urgent request may be made before the other spouse has answered, depending on the procedure and facts. That makes candour especially significant. The applicant should put forward documents that weaken the request as well as those supporting it. The court determines the form, scope and duration of any relief.

Title records, bank evidence and communications that support the request

The Registrar-General's Department records land transactions, titles and encumbrances. A current search can show ownership, mortgages and registered burdens. Keep the deed and earlier acquisition papers too. A social-media listing is useful evidence, but it does not replace the registered record.

Bank statements should show the pattern before and after separation. Preserve complete pages, not cropped screenshots. Company material may include the constitution, share register, resolutions and recent filings. Communications should retain dates, participants and attachments in their original form.

In practice, the weak point is often identification. A request framed around “all assets” may leave the judge without a workable description of what must remain untouched.

What happens after a temporary restriction is granted?

A temporary order is not the final property decision. It may be followed by service on the affected spouse, a return hearing and evidence in answer. Banks, notaries or company officers may also need clear notice if the order concerns property they control.

Compliance must be exact. Ordinary expenditure permitted by the order should be documented. If circumstances change, seek a variation rather than privately treating the order as obsolete. Financial support is a separate issue, explained in the guide to enforcing a maintenance order.

Protecting a trading business without paralysing ordinary operations

A trading company is not simply a bank balance. It has employees, tax obligations, customers and contractual payments. The request should distinguish value-destroying acts, such as an unusual share disposal, from payments required for normal business.

Possible controls may focus on changes to shareholding, exceptional payments or transactions outside the ordinary course. The precise relief depends on the company structure and the spouse's legal interest. The Corporate and Business Registration Department keeps company filings, while the company maintains its share register under the Companies Act 2001.

The point most often missed is continuity. Preserving business value can require carefully permitted operations, not a total stoppage that damages both spouses.

Cross-border assets and the limits of a Mauritius order

A Mauritius order does not automatically control a foreign bank, registry or company. The location of the asset, governing documents and foreign enforcement rules must be checked. Local counsel may be needed before the asset moves further.

Start with proof connecting the spouse to the overseas asset. Account statements, corporate registers and purchase documents are stronger than an unparticularised allegation. Privacy and disclosure concerns in financially complex cases are addressed in privacy in high-value family proceedings.

Urgency, undertakings, cost exposure and the next safe step

Urgent relief can carry conditions. The court may require commitments from the applicant and can address costs when a request is unjustified or materially incomplete. Do not threaten a bank or notary with an order that has not been made.

Send counsel the marriage certificate, marriage contract, draft or filed divorce papers, asset records and the clearest evidence of the threatened act. An attorney-at-law advises, drafts pleadings and conducts filing and service. A barrister advises, drafts and litigates; the instruction route is explained in instructing a barrister through an attorney.

Frequently asked questions

Can I freeze our joint account before divorce in Mauritius?

Do not assume that a joint holder may lawfully block or empty the account without consequence. A court restriction may be available where evidence shows a real risk to property in issue, but the account mandate and intended living expenses matter. That is general information; obtain advice on the account and proposed application before acting.

How do I stop my spouse selling the house during separation?

Obtain the title deed and a current land-registry search, then preserve any sale advertisement, notary correspondence or signed offer. Counsel can assess whether urgent relief should be sought before a transfer occurs. This is general information, and the proper step depends on ownership, the matrimonial regime and the evidence.

What if assets have already been transferred to a relative?

The transfer, consideration, timing and relative's knowledge all require examination. Secure the deed, payment trail and communications, because a completed transfer raises different issues from a threatened one. General information cannot determine whether a challenge is available on your facts; take advice before contacting the recipient.
