What happens to a work permit after dismissal in Mauritius?

Dismissal can remove the employment basis on which a foreign worker was authorised to work or reside in Mauritius. It does not, however, answer every immigration question on the day the dismissal letter arrives. The permit type, its conditions and any separate residence status must be checked at once.

Dismissal can end the permit's employment basis

An ordinary work permit is connected to the employment for which it was issued. Government guidance tells migrant workers that such a permit authorises work for the named employer and is not ordinarily transferable. Once that job ends, neither party should treat the document as open authority to take another job.

The Non-Citizens (Employment Restriction) Act allows a permit to be varied or cancelled. Continued stay is a separate matter under immigration law: it generally depends on a valid permission to remain, unless another basis exists. For ordinary employment, the residence permission issued by the Passport and Immigration Office must be considered beside the Ministry of Labour and Industrial Relations work permit.

An Occupation Permit as a professional follows a different statutory route. Current Economic Development Board legislation contains provisions for a professional who changes employment or is temporarily without employment, subject to stated conditions and notification. Do not apply that rule to every work permit. The overview of work permits for foreign employees explains the categories.

Identify the permit, sponsor and status immediately

Read the actual document. Record whether it is an ordinary work permit with a related residence permit, a professional Occupation Permit, or another status allowing work. Note the employer, occupation, issue and expiry details, and every condition printed on the approval.

Then ask what has already been notified. An employer may have submitted a cancellation or cessation report before giving the worker a copy. A screenshot of an old permit does not show its current administrative status.

In practice, the first uncertainty is often ownership of the online record. The employer may control the National Electronic Licensing System account, while the employee holds only a PDF. Request the reference, submission receipt and authority response in writing.

Employer notifications and documents to request

The worker should ask for a dated termination letter identifying the effective date and reason. The Workers' Rights Act 2019 generally requires a certificate of employment when employment ends, but its application and the precise entitlements must be checked for the worker concerned. Final pay records should show salary, leave and deductions separately.

Permit documents matter just as much. Request the work or Occupation Permit, residence permission, cancellation request, acknowledgement, and any communication from the Work Permit Unit, EDB or Passport and Immigration Office. If the employer arranged accommodation, insurance or a return ticket, ask when each benefit stops.

Keep personal originals. A passport should remain with its holder, not be held to pressure someone over clearance or repayment. The Ministry's Special Migrant Workers Unit registers complaints about labour rights and contract terms, including non-payment of wages.

Employment rights and immigration are separate

A dismissal may be lawful or unlawful under Mauritian employment law. That issue concerns the contract, reason, process, notice and statutory rights. Immigration status concerns permission to work and remain. One decision does not silently decide the other.

This separation prevents two dangerous assumptions. An employer cannot make a disputed wage disappear by referring to permit cancellation. A worker cannot continue working without authority merely because salary or dismissal proceedings remain unresolved.

The Workers' Rights Act 2019 and the competent labour forum may govern aspects of termination. The permit authorities administer the separate immigration record. The structure of the Mauritian courts helps place a court claim, but it is not a substitute for an authority status check.

If the dismissal is disputed as unfair

Preserve the contract, disciplinary correspondence, attendance records, payslips, performance material and termination notice. Dates can affect employment remedies, so prompt advice matters. The merits should be assessed independently of the employer's immigration notification.

Filing or preparing an unfair dismissal claim does not itself renew a permit. If the worker seeks reinstatement or compensation, counsel must consider what relief is legally available and whether the person could lawfully resume work. The two tracks may move at different speeds.

Economic dismissal raises further statutory questions about the stated business reason and applicable process. See redundancy and economic dismissal in Mauritius for that employment analysis.

Residence, dependants and departure planning

A spouse or child may hold status connected to the principal permit. Their documents should be checked individually rather than assumed to survive or lapse together. School attendance, a residential lease or a pending claim does not itself create immigration permission.

Departure planning should cover the last lawful date, flights, housing, shipment, bank access and medical insurance. The contract may allocate return costs, but the authority determines status. If another basis of residence may apply, it should be raised with the Passport and Immigration Office before the existing basis fails.

A new job also needs lawful authority. The order is explained in changing employer on a Mauritius work permit. Working for the replacement employer first and correcting the record later creates avoidable risk.

Urgent steps with both advisers and authorities

Contact the authority responsible for the precise permit, not a general visa forum. For an ordinary work permit, that will usually involve the Work Permit Unit and the Passport and Immigration Office. For a professional Occupation Permit, contact the EDB and immigration authority about the current statutory route.

Give the employment adviser the permit file as well as the dismissal papers. Give the authority the accurate cessation date and new-employment information it requests. Inconsistent accounts can damage both processes.

Ask for written confirmation of present status and the action required. A verbal assurance from a manager or recruiter is not an immigration decision. The employment and workers' rights practice addresses the labour consequences while keeping the permit question distinct.

Frequently asked questions

Can I stay in Mauritius after my employer dismisses me?

Do not assume that the employment-based permission continues unchanged. The answer depends on the permit category, its current status and any separate permission to remain; a professional Occupation Permit has rules that differ from an ordinary work permit. This is general information, so obtain written confirmation from the responsible permit and immigration authorities for your case.

Does an unfair dismissal claim keep my work permit valid?

No automatic extension follows merely because a dismissal is challenged. The employment dispute and the permission to work or remain are decided under different legal routes. This is general information; take advice on the claim while separately confirming your immigration position with the authority.

What papers should my employer give me when sponsored employment ends?

Ask for the termination letter, certificate of employment, final payslip and leave or benefit calculation, together with copies of permit cancellation or notification documents. Keep the contract, permit and any return-travel or accommodation terms as well. This is general information; the papers due in a particular case depend on the contract, statutory coverage and permit route.
