Changing employer in Mauritius requires more than signing a new contract. An ordinary work permit is tied to the employment for which it was issued, while a professional Occupation Permit has its own statutory change route. The new job must be authorised before the employee begins it.
A work permit is not automatically transferable
Government guidance for migrant workers states that a work permit authorises work solely for the employer named on it. It is not ordinarily transferable, apart from exceptional circumstances approved by the competent authorities. A resignation does not turn it into a general right to work.
A professional Occupation Permit needs separate treatment. Under current Economic Development Board legislation, a professional can change employment without being treated as ceasing to meet the registration conditions if the new job meets the applicable criteria, the EDB and immigration officer are informed, and required information is supplied.
That is not a shortcut for a holder of an ordinary work permit. Identify the document first. The practical differences between the professions involved in advice and filing are also set out in barrister, attorney and notary roles in Mauritius.
Check the old permit and new role before resigning
Read the permit, current contract and proposed offer together. Check the authorised employer and occupation, the permit's conditions, contractual notice, repayment terms, restrictive covenants and the proposed start date. A good offer is expressly conditional on the required approval or notification.
The new role may use the same commercial title but fall on a different regulatory basis. Salary, duties, qualifications and work location may affect eligibility. Current thresholds and criteria should be confirmed on the authority's published guidance rather than copied from an earlier application.
Resignation can trigger cancellation steps before the replacement route is settled. It can also end employer-provided housing or insurance. The Mauritius employment contract checklist identifies the clauses that should be read before notice is served.
The new employer's application and worker's documents
For an ordinary work permit, the incoming employer normally takes responsibility for the application through the National Electronic Licensing System. The worker must supply accurate supporting material. The Work Permit Unit may require employer records as well as passport, qualification, medical and role documents.
For a professional Occupation Permit, the change must fit the Immigration Act 2022 and the EDB's current registration requirements. The new employer should prepare a signed offer and a detailed occupation description. The holder should obtain evidence that the EDB and immigration officer received the change information.
In practice, a copied job description causes trouble when it does not match the work offered. Titles, reporting lines and salary should be consistent across the contract and authority submission. Any discrepancy should be corrected before approval, not explained after the employee starts.
Avoid unauthorised work between approvals
Do not treat the notice period as permission to overlap jobs. Work for the old employer remains governed by the old employment and permit. Work for the new business needs authority covering that new employment.
“Work” is broader than sitting at a new desk after payroll begins. Delivering services, managing staff, meeting clients or performing productive induction can show that employment has started. The new employer should postpone those tasks until permission is effective.
A garden-leave arrangement, paid waiting period or overseas preparatory task needs contractual and legal review. The Workers' Rights Act 2019 may affect the employment relationship, but it does not grant immigration permission. See the Workers' Rights Act 2019 guide for the distinct statutory framework.
If the former employer delays paperwork
Ask the former employer for the termination acknowledgement, certificate of employment and copies of any permit cancellation submission. Set out the effective date accurately. If there is disagreement about notice or money, do not let that dispute produce a false cessation date.
The point most often missed is that the former employer does not decide whether the new job is authorised. The responsible authority does. A delay by the old company should be documented and raised through the official channel for the relevant permit.
Keep the new employer informed without disclosing irrelevant confidential material. If wages, passport retention or contract rights are also disputed, the Ministry's Special Migrant Workers Unit can receive labour-related complaints. Permit regularisation and the employment claim should still be handled as separate files.
Salary, occupation and dependant status
The incoming terms must satisfy the current criteria for the chosen category. Do not assume that an old salary level, professional label or eligibility decision carries across. The EDB publishes current Occupation Permit criteria, and the Ministry publishes the ordinary work-permit route.
A spouse or child's dependant status may be linked to the principal holder's permission. Check whether notification, reissue or a separate application is required. The family should not rely on the expiry date printed on a document if the basis supporting it has changed.
Relocation promises also need revision. A new employer may agree to housing, travel or school costs, but it does not inherit the former contract's promises automatically. Those terms belong in the new agreement, including what happens if the authority does not accept the change.
Sequence resignation, application and start date
The safest sequence begins with a conditional offer and a permit-category check. Next comes the application or formal change process, coordinated with accurate notice to the former employer. The new start date follows only after the required permission is issued or confirmed.
Reality may require overlap between notice and processing. Put that timing in writing, with a mechanism to defer commencement. The employee should not be penalised for refusing to start work before the State has authorised it.
If the old job ends first, obtain written advice on the right to remain during the gap. A professional Occupation Permit holder may fall within the Economic Development Board Act's specific unemployment provisions, but the conditions must be satisfied. For related contract terms, read relocation clauses in Mauritius expat contracts and the employment and workers' rights practice.
Frequently asked questions
Can I transfer my Mauritius work permit to another company?
An ordinary work permit is not generally a portable permission to work for any company. A new employer will usually need to follow the applicable work-permit route, while a professional Occupation Permit holder may use the statutory change-of-employment process if its conditions are met. This is general information; the authorities should confirm the route for the permit you hold.
Do I have to leave Mauritius while changing employers?
Not necessarily, but remaining in Mauritius and working are distinct permissions. The answer depends on the existing permit, its cancellation or lapse, the new process and any valid independent residence status. This is general information; obtain written direction from the Work Permit Unit, EDB and Passport and Immigration Office as applicable before relying on continued stay.
When can I legally start work for my new employer?
Start only when the authority has issued or confirmed the permission that covers the new employment and all stated conditions are met. A job offer, application receipt or old employer's permit is not enough by itself. This is general information; ask the responsible authority to confirm the lawful start date shown by your documents.
