A foreign parent can ask for urgent protection in Mauritius when a child here faces harm or an imminent removal risk. The first response depends on the danger: police and child-protection intervention for immediate safety, followed by a focused court application where orders are needed. Nationality alone does not decide parental rights or jurisdiction.

Immediate danger calls for protection before the wider parenting dispute

If violence, abandonment or an attempted removal is happening now, call the Mauritius Police Force on 999 or 112. Child abuse or a child in distress can also be reported to the Child Development Unit on 113. Give the child's location, the immediate risk, the adults present and any medical need.

Do not wait to assemble a perfect affidavit before seeking emergency help. Ask the attending officer how the report is recorded and note the reference. If the child needs treatment, tell the clinician what happened in direct terms. The medical record should serve care first, then evidence.

A violent incident and a custody disagreement are not interchangeable. Police address suspected offences and immediate safety. A court determines residence, contact or other parental arrangements. The guide to the structure of the Mauritian courts explains why separate issues may move through different forums.

When a foreign parent can ask a Mauritian court to intervene

A parent's foreign citizenship does not itself close the courthouse door. The child's presence, ordinary life, parental status, any existing order and the remedy sought all matter. So does the way the child came to Mauritius.

Produce the full birth certificate, marriage or recognition documents, passports and every custody or protection order. A foreign order should be supplied in complete form, with proof of finality and a reliable translation where needed. Do not describe an overseas order as binding here before its Mauritian effect has been assessed.

Where violence comes from a spouse, a partner or another related person, the Domestic Abuse Act 2026 allows an application for a protection order or an exclusion order in the relevant District Court, with interim relief where the risk is immediate. A child-residence application may require a different route. Counsel should identify the narrow interim relief needed rather than asking one court to solve every dispute.

Police reports, medical notes and messages for an urgent application

Urgency is proved with detail. Record the words used in a threat, the place, time, witnesses and what happened next. Keep police acknowledgements, discharge notes, photographs in their original form and messages with their surrounding conversation.

Explain delay rather than hiding it. A parent may have feared retaliation, lacked independent transport or believed a promise that the conduct would stop. Those facts need a truthful account. They should not be replaced by speculation about a diagnosis or motive.

In practice, the most useful urgent exhibit is often modest: a complete message thread linked to a booked flight, or a clinic note made before litigation began. A long bundle of repeated screenshots can obscure that connection.

Emergency arrangements for the child's residence and contact

Temporary arrangements should match the identified risk. The court may be asked to address where the child stays, how handovers occur and whether contact needs conditions while evidence is gathered. The exact application depends on parental status and existing proceedings.

Offer a workable proposal. Name the address, responsible adult, school transport and safe method for exchanging the child. If supervision is proposed, identify a suitable person or setting and explain why it protects the child without ending the relationship unnecessarily.

Housing and money can complicate safety decisions. Ownership of the family home does not answer the short-term protection question, and emergency occupation relief has its own requirements. Longer-term property issues are introduced in the guides to dividing the family home and Mauritian matrimonial property regimes.

What happens if the child's passport or departure is the risk?

A passport is only one part of the risk. Check every nationality the child holds, whether another travel document exists, the proposed route and any booking or school withdrawal. Preserve messages about departure and supply accurate names and dates of birth to the authorities.

Seek urgent advice on court measures before the flight. Do not assume that an oral objection at the airport, possession of one passport or an informal promise will prevent travel. If the threat is immediate, inform the police and the Child Development Unit's child-abduction service as well as counsel.

If a child is removed across a border, the Convention on the Civil Aspects of International Child Abduction Act may be relevant where the Convention operates between the countries concerned. The Supreme Court and the designated Central Authority have roles under that Act. The remedy is a return process, not a final decision about which parent is better.

Keeping overseas authorities and parallel cases properly disclosed

Tell Mauritian counsel about every foreign case, even an application that failed or was withdrawn. Supply the initiating papers, proof of service, orders, undertakings and the next hearing date. Courts should not be given a partial impression that no other process exists.

Contact with an embassy or overseas child agency may provide consular or local assistance. It does not replace a Mauritian order concerning a child here. Keep a record of what the overseas body was told so that inconsistent accounts can be corrected early.

A grandparent may become a proposed supervisor or temporary support person. Their separate relationship with the child is addressed in contact for grandparents living abroad.

From temporary protection to a workable child arrangement

An emergency order is built for the immediate problem. The next stage may require fuller evidence about the child's welfare, schooling, care and relationship with each parent. A short-term safe address should not quietly become a final arrangement without review.

Comply precisely with every interim direction. Record handovers and missed contact factually, without drawing the child into adult messages. If circumstances change, seek a variation through the proper route rather than improvising a new regime.

The point most often missed is practical continuity. A proposal gains force when it explains Monday morning as clearly as the alleged danger. The family law and divorce practice sets out the chambers' work in child and cross-border family matters.

Frequently asked questions

Who do I call if my child is in immediate danger in Mauritius?

Call the Mauritius Police Force on 999 or 112 for an immediate emergency, and the Child Development Unit on 113 to report child abuse or a child in distress. Obtain medical attention where needed and keep the reference given for your report. This is general information; advice on the protective application must address the child's actual circumstances.

Can a foreign mother apply urgently for custody in Mauritius?

Foreign nationality does not by itself prevent a mother from asking a Mauritian court to protect a child who is here. Jurisdiction, parental status, existing orders and the relief required must still be established. That is general information; a barrister should advise on the correct application for her facts.

What can I do if the other parent is threatening to leave Mauritius with our child?

Preserve the threat and the travel details, then seek urgent Mauritian advice before the proposed departure. If danger is immediate, notify the police and the Child Development Unit; do not assume that holding one passport removes the risk. This is general information, and the available court or cross-border route depends on custody rights, existing orders and the countries involved.
