A South African moving to Mauritius should match the intended work, investment or retirement to a Mauritian permission before signing long-term commitments. The move also needs a usable document file, lawful housing, coordinated tax advice and clear arrangements for children and estates. Entry as a visitor does not settle those separate questions.
Match the planned move to the correct Mauritius immigration permission
The Immigration Act 2022 provides the current statutory setting for entry and residence. The Passport and Immigration Office states that an Occupation Permit allows a foreign national to work and reside in Mauritius. Investor, professional and self-employed routes reflect different activities. Residence routes also exist for categories such as retired non-citizens, dependants and students. The Premium Visa serves a different purpose and should not be treated as a general work permit.
Start with what each adult will actually do. An employee’s application, an owner managing a company and a person working remotely for an overseas business are not the same case. The Economic Development Board publishes current occupation and residence information, while the Passport and Immigration Office administers immigration functions. Thresholds and evidence change. Check the live criteria before paying a deposit or resigning from employment.
South African civil-status and police documents to prepare before departure
Obtain recent official copies of birth and marriage records, divorce orders, adoption papers and any change-of-name document relevant to the family. Keep the full order where parental rights or guardianship are addressed. A shortened certificate or an informal scan may not show the relationship that a Mauritian authority needs to verify.
The South African Police Service issues Police Clearance Certificates through its Criminal Record and Crime Scene Management division. The Department of International Relations and Cooperation handles South African authentications and apostilles. Ask the Mauritian recipient which documents need an apostille, certification or translation. Do that before departure where possible. Original records are slower to replace from abroad, and a notarial copy is not automatically an apostille.
Renting or buying a home without confusing occupation rights and ownership approval
A residential lease provides contractual occupation. It does not give permanent residence or ownership. Read the inventory, deposit clause, repair allocation, early termination terms and authority of the person claiming to be landlord. If a company pays the rent, identify whether the employee or company is liable when the employment ends.
For a purchase, the Non-Citizens (Property Restriction) Act controls acquisition by non-citizens. The permitted routes and approving body depend on the property and transaction. The EDB operates the approved investment schemes, and the routes available outside those schemes are narrow, conditional and amended from time to time, so they must be checked on the transaction date. Approval should be a condition where required. The broader legal guide to living in Mauritius explains how residence and property rights remain distinct.
Working, starting a company and dealing with the EDB
Incorporating a Mauritian company does not itself authorise a South African director or shareholder to work in Mauritius. The business must be registered, the activity lawfully licensed and the individual’s immigration position aligned with the actual role. A spouse or dependant should not assume that another family member’s status permits employment.
The EDB facilitates investment and publishes permit material, but sector regulators retain their own functions. Check licences for tourism, education, financial services under the Financial Services Act 2007, health, food or other controlled activities with the relevant issuer. Separate company capital from personal living funds. If two businesses or owners will combine resources, the guide to cross-border joint ventures in Mauritius covers control, funding and exit provisions.
Tax residence and South African obligations require coordinated advice
Physical relocation does not by itself settle tax residence. The Mauritius Revenue Authority and South African Revenue Service apply their own domestic rules, and the countries have a double taxation agreement. Treaty language should be applied to the facts, not used as a slogan that tax disappears.
SARS states that ceasing South African tax residence is a factual enquiry for an ordinarily resident person and must be declared where applicable. The consequences can extend beyond the annual return. Obtain advice before changing asset ownership, drawing company income or making international transfers. Keep residence permissions, travel information, home arrangements and business interests available to both advisers. Each should see the same facts.
Medical cover, schooling and parental-consent records for families
Check whether medical insurance covers treatment in Mauritius, evacuation, existing conditions and the intended residence status. An employer plan may end with the job that supported the move. Ask schools which birth records, prior reports, health records and custody documents they require before accepting a place.
Where a child travels with one parent, keep the birth certificate, the other parent’s consent and any court order defining parental responsibilities. South Africa’s Department of Home Affairs publishes guidance and a suggested parental-consent format, but the required documents depend on the circumstances and current travel rules. A move can also raise questions beyond airport paperwork. Read the guide to cross-border child custody in Mauritius before assuming consent to a holiday also permits relocation.
Wills, matrimonial property and succession across both countries
A South African will may remain relevant after the move, but new Mauritian land, bank accounts or company interests change the estate map. Review how each asset is titled, which will covers it and whether one document revokes another. Mauritius also has protected-heirship rules that can affect descendants. Do not promise a beneficiary an outcome from the will’s wording alone.
Matrimonial property is a separate enquiry. The marriage certificate, any antenuptial contract and the law connected to the marriage all matter. A move does not silently rewrite the spouses’ property arrangements. If a Mauritian dispute later requires proceedings, the explanation of instructing a barrister through an attorney sets out how those professional roles fit together.
A practical order for applications, contracts and the physical move
First settle the activity and likely permit category. Next obtain the official records and authentications that the application calls for. Review proposed employment, business and housing contracts while permission remains a condition, not an assumption. Only then fix the irreversible parts of the move.
Families should align school admission, insurance commencement and travel authority with the permit timetable. Business owners should align incorporation, banking and sector approval. In practice, delay often sits with one record issued in South Africa or one contract signed without a regulatory condition. A comparable document exercise for another civil-law connection appears in the French nationals’ Mauritius checklist. The expat legal matters hub brings the Mauritian strands together.
Frequently asked questions
What visa or permit does a South African need to live in Mauritius?
The answer depends on the proposed activity. An investor, professional or self-employed person may need the relevant Occupation Permit, while retirement, dependency, study or remote work can involve another residence or visa route. This is general information; confirm the current category and evidence with the EDB or Passport and Immigration Office before committing to the move.
Can South Africans buy a house when relocating to Mauritius?
A South African is a non-citizen for Mauritian property law and may buy only through an available route with the required approval. The permitted route depends on the property and the buyer’s status; a residence right and ownership approval are not interchangeable. This is general information, and the proposed property and contract need review before signature.
Should I change my South African will after moving to Mauritius?
Have it reviewed rather than cancelling it automatically. Mauritian assets, residence, family rights and local succession formalities may require coordinated planning, while a replacement will can accidentally revoke provisions intended for South African property. This is general information; advisers in both countries should examine the existing will and asset ownership before any new document is signed.
