Working in Mauritius for an overseas employer

You can work from Mauritius for an overseas employer only if the arrangement fits your immigration permission and the legal consequences of working here have been addressed. Keeping a foreign contract or foreign bank account does not settle employment protection, tax, payroll or company registration. Each question uses a different legal test.

Residence does not settle who the employer is

Start with the contract and the facts. Identify the entity that hires, pays, supervises and can dismiss the worker. A group brand, payroll provider or foreign parent may appear in correspondence without being the contractual employer.

Next, record where the employee actually performs duties and who benefits from them. Authority to negotiate contracts, manage Mauritian clients or hire staff can create issues beyond personal remote work. The answer may change as the role develops.

In practice, the label “digital nomad” often conceals an ordinary employment relationship. The contract, payslips, reporting line and day-to-day control give a better account. The guide to governing law in a Mauritius expat contract explains why a foreign-law clause is relevant but not conclusive.

Which immigration permission allows remote work?

The Economic Development Board's Premium Visa guidance expressly contemplates eligible professionals working remotely from Mauritius with their families. Its published conditions include remaining outside the Mauritian labour market and keeping the main place of business or source of income and profits outside Mauritius. Current eligibility and required documents must be checked before travel.

A visitor status should not be assumed to authorise an ongoing work arrangement merely because payment comes from abroad. Nor should a Premium Visa be used for a role that has become employment in the local labour market. The activity must match the permission.

If a Mauritian company hires the worker, an Occupation Permit or other employment authorisation may be the relevant route instead. The Immigration Act 2022 governs Occupation Permits, while the Passport and Immigration Office and EDB administer the applicable processes.

Does Mauritian employment law protect the worker?

The Workers' Rights Act 2019 is part of the Mauritian employment framework. Whether and how its protections apply to a person hired abroad requires examination of the agreement, the work performed in Mauritius, the nature of the relationship and any statutory exclusions. Citizenship alone does not answer it.

A governing-law clause cannot safely be read as removing every mandatory rule of the country where work is performed. Equally, living in Mauritius does not automatically make every contractual dispute a Mauritian claim. Jurisdiction, applicable law and enforceability must be analysed rather than assumed.

The distinction between an employee and an independent contractor also matters. The invoice label is not decisive if the reality shows personal service and employer control. Related protections for non-citizens are discussed in migrant worker rights in Mauritius.

Terms for pay, hours, leave and equipment

The contract should state the salary currency, payment account, pay date and responsibility for transfer charges. It should explain how exchange-rate changes affect any Mauritius expenses. A gross foreign salary should not be described as net of every possible Mauritian liability.

Working hours need a time zone. Set the core availability, rest days, public-holiday treatment, overtime approval and how local power or connectivity failures are reported. The employee should know which country's holiday calendar the employer applies and whether Mauritian mandatory rights alter it.

Equipment terms should cover ownership, delivery, insurance, cybersecurity, repair and return. If the employee uses a Mauritius home as a regular workplace, address safety, confidential calls and data access. Do not grant the employer an unrestricted right to enter the home.

Payroll, tax and social contributions

The Mauritius Revenue Authority publishes separate guidance on foreign income, PAYE and social contributions. Tax residence, the source and remittance of income, treaty relief and employer obligations require current advice. The rules should be checked before arrival and whenever the length or nature of the stay changes.

MRA guidance says an employer includes a person responsible for paying employment income and explains registration and monthly filing obligations. That does not mean every overseas payroll has the same answer. A foreign employer may need a local payroll arrangement or other compliance response after professional assessment.

Do not use an old remote-work article to calculate tax. Rates, thresholds and administrative practice change. Ask the MRA or a Mauritius tax adviser to confirm the worker's position, and obtain advice in the employer's country to identify double exposure or relief.

If the employer has no Mauritius entity

No local subsidiary does not mean no Mauritius issue. Under the Companies Act 2001, a foreign company that establishes a place of business or commences to carry on business in Mauritius enters the foreign-company registration framework. Whether one home-based employee crosses that line depends on the company's actual activity.

The employee's authority is central. Signing contracts, maintaining a local office, habitually securing business or representing a permanent Mauritian operation may point differently from internal work for customers abroad. Company registration and tax presence are also distinct analyses.

The parties may consider a local employing entity or an employer-of-record arrangement, but the documents must reflect reality. The worker should know who owes salary and leave, who directs work and who can terminate. Commercial convenience cannot leave the identity of the employer uncertain.

Evidence if pay stops or the role ends

Preserve the signed contract, amendments, job description, payslips, bank records and messages about missed pay. Export work logs and performance records lawfully before access is closed. Do not take customer data or material the worker has no right to retain.

If termination is described as redundancy, ask which entity made the decision and what business reason is relied upon. The Mauritius redundancy and economic dismissal guide addresses the local employment questions, but foreign procedure and enforcement may remain relevant.

Before filing, identify the proposed defendant, governing law, forum clause, service address and assets against which a judgement could be enforced. A Mauritian order is not useful merely because the worker is here. The guide to instructing a barrister through an attorney explains the professional roles if local proceedings are appropriate, and the employment and workers' rights practice provides the starting point.

Frequently asked questions

Can I live in Mauritius and keep working for my UK employer?

Potentially, if your immigration permission permits the arrangement and the employment, tax and payroll position has been addressed. A Premium Visa is designed for eligible remote workers whose business or income source remains outside Mauritius, but its current conditions must be checked. This is general information; obtain Mauritius and UK advice on your actual residence, duties and contract.

Does my foreign company need to register in Mauritius if I work remotely here?

One employee's presence does not produce a safe universal answer. Registration can depend on whether the company establishes a place of business or carries on business in Mauritius, while tax and employer-registration tests raise separate questions. This is general information; the company's activities, authority given to the worker and local footprint require professional review.

Where do I claim if an overseas employer stops paying me in Mauritius?

The proper forum depends on the contract, governing-law and jurisdiction clauses, where the work was performed, the employer's presence and the remedy sought. Mauritian mandatory rights may be relevant, but a foreign defendant creates service and enforcement questions. This is general information; a barrister should review the documents and facts before proceedings are chosen.
