A property deposit in Mauritius may be recoverable when the transaction ends, but the label “deposit” does not decide the result. Recovery depends on the agreement, the reason the sale failed, the capacity of the person holding the money and the evidence of payment. The first task is to identify the bargain actually made.

Recovery depends on why and how the deposit was paid

A buyer may pay money under a reservation form, a preliminary sale document or a separate receipt. Those documents can serve different purposes. One payment may reserve a unit while checks continue. Another may count towards the price under a binding commitment. A transfer made before any document was signed presents a different evidential problem again.

Establish the event that stopped the purchase. It might be refusal of finance, failure of a non-citizen approval, an adverse title issue, the seller's withdrawal or the buyer's change of mind. The contractual consequence may differ for each event. The legal guide for expatriates in Mauritius explains why immigration and property permissions should not be treated as one approval.

In practice, deposit disputes often begin with imprecise language. The receipt says “booking fee”, the bank reference says “deposit”, and the reservation form uses another expression. The legal character comes from the whole arrangement, not the shortest label.

Reservation form, receipt and bank trail as evidence

Preserve the version signed by every party. Marketing pages and unsigned drafts may explain context, but they do not replace the executed terms. Keep the payment instruction, bank debit advice, recipient account name, receipt and the message acknowledging arrival of the funds. A cash payment needs especially careful proof.

The surrounding correspondence can show what the recipient said the money was for. Save messages about an approval, finance application, completion date or promised refund in their original form. Exporting a chat without its date, sender or attachments can strip away the detail that makes it useful.

If an estate agent received the money, ask whether the agent took it as agent for the seller or into a separately identified holding arrangement. The Real Estate Agent Authority Act 2020 establishes the Real Estate Agent Authority and gives it regulatory and complaint functions. A regulatory complaint, however, is not automatically a civil repayment order.

Was the payment conditional or non-refundable?

Read the refund wording beside the condition that allegedly failed. A finance condition may specify the type of application, a date or evidence of refusal. An approval condition may say who must apply and what happens while it is pending. If the buyer did not follow the agreed process, the seller may contest reliance on the condition.

“Non-refundable” is significant wording, but it should not be read alone. The enquiry remains whether the clause formed part of the bargain, what event triggered it and whether the party relying on it performed its own obligations. A cancellation charge, agreed deposit and advance part-payment are not necessarily interchangeable.

The Code Civil Mauricien draws its own version of this line. Article 1590 addresses a promise of sale made with arrhes: either side may withdraw, the buyer losing the sum paid or the seller returning double. A payment treated instead as a firm part-payment does not carry that right of withdrawal. Which arrangement the parties actually agreed matters more than the word used on the receipt.

Foreign purchasers also need to separate a failed regulatory condition from a voluntary withdrawal. The guide to defects in a Mauritius new build addresses a different question: what happens when the property delivered does not match what was promised.

Demand for repayment and the correct recipient

A repayment demand should identify the payment, the agreement, the event relied upon and the basis for release. It should also state where the money is believed to be held. A formal notice before proceedings is known as a mise en demeure. Its wording should match the actual obligation rather than accuse every participant in the transaction.

The agent who introduced the sale may have passed the money to the seller. A developer may have used a sales company. The receipt and account details help identify who received value, while the contracts show who promised repayment. Demanding from the visible intermediary alone can lose time if another person is legally responsible.

The point most often missed is capacity. Ask whether the recipient took the money for itself, for the seller or as a neutral holder. The answer affects both the demand and any later claim.

What happens if the money is held by a stakeholder?

A stakeholder holds money on stated terms pending an event or joint direction. That role is distinct from owning the deposit. A notary may hold funds connected with a proposed transfer, but the notary's receipt or written instructions should show the basis on which release can occur.

If seller and buyer give conflicting instructions, a neutral holder may decline to choose between them without agreement or a court direction. That does not by itself decide which party is right. It means the underlying entitlement must first be resolved.

Ask for confirmation that the fund remains held and whether any deduction has been made. Do not assume that a notary, agent and seller can be sued on the same basis. The separate advisory, drafting and litigation roles in a property matter are set out in the guide to barristers, attorneys and notaries in Mauritius.

From negotiated refund to a Mauritian court claim

A negotiated outcome may include full repayment, an agreed deduction or release against cancellation of the transaction. Record what the settlement covers and who will give the payment instruction. If there is a live sale document, a refund should not be treated as closing every obligation unless the settlement says so.

Proceedings require a pleaded legal basis, the correct parties and evidence of the amount claimed. The appropriate Mauritian court depends on the nature and value of the claim. Interest, costs and any urgent request to preserve funds also need individual assessment. These points should not be guessed from the deposit figure alone.

A buyer abroad can usually begin document review without treating travel as the first step. The expat legal matters hub gives the broader cross-border context. Other family issues, including cross-border child custody in Mauritius, follow their own rules and should remain separate from the property claim.

Frequently asked questions

Can a seller keep my property deposit if finance falls through?

That depends on whether obtaining finance was an agreed condition, whether you complied with its wording and what the contract says follows if the condition fails. A finance refusal does not create an automatic refund in every transaction. This is general information; advice on your position requires the signed documents and the lender's evidence.

How do I recover a reservation deposit from a Mauritius agent?

Ask the agent in writing to identify the legal recipient, the account used and the clause said to permit retention. Send any formal demand to the person legally obliged to repay, which may not be the agent. This is general information; a barrister must examine the reservation form, receipt and agency role before advising whom to claim against.

Who should I claim against if the notary holds the deposit?

First establish the notary's written holding terms and whether the seller disputes release. The proper defendant, if proceedings are needed, depends on who owes repayment and why the stakeholder cannot release the fund. This is general information; the receipt, preliminary agreement and correspondence are needed for advice on parties and relief.
