Urgent preservation of evidence in Mauritius disputes

The Supreme Court of Mauritius may grant urgent relief to preserve specific evidence that faces a real risk of destruction, alteration or concealment. A search or preservation order is exceptional. Its purpose is to secure known material for a genuine dispute, not to let one party search broadly for a case it has not yet established.

An urgent order can preserve evidence at real risk of destruction or alteration

Mauritian courts exercise equitable jurisdiction to grant interim commercial relief, including search orders often described as Anton Piller orders. The Judicial Committee of the Privy Council has recognised that jurisdiction. The form of order depends on the material, risk and underlying claim.

The danger must be concrete. An announced mailbox deletion, expiring CCTV cycle, threatened destruction of files or attempted wiping of a device may support urgency when tied to relevant evidence. A strained business relationship alone does not.

Preservation differs from disclosure. The first prevents loss. The second determines what material must be produced and inspected in the litigation. Keeping those stages separate protects both parties and the integrity of the future case.

Identifying the specific devices, records or premises involved

The application should identify evidence by source and subject. For email, name the accounts, date range, correspondents and transaction. For CCTV, state the camera location and relevant period. For a device, explain its user, function and connection to the alleged conduct.

Physical records require the same discipline. A signed ledger kept in a named office is different from “all documents at the premises”. The proposed order should distinguish originals that need secure custody from records that can be imaged or copied.

In practice, overbreadth often begins with technical language. A request for every server, backup and phone may capture years of unrelated business and personal information. A forensic specialist can translate the legal issue into targeted search parameters before the order is drafted.

Showing urgency without turning preservation into premature disclosure

The affidavit should explain why ordinary disclosure later would be ineffective. That requires evidence of the retention cycle or threatened act, control of the material and the likely timing of loss. It should also explain why a less intrusive preservation notice or agreement will not work.

The claimant does not obtain a private inspection right merely by alleging urgency. A court can secure an image or place documents in custody without allowing immediate review by the applicant. Access can await directions after privilege and relevance are addressed.

Do not use self-help. Logging into another person’s account, copying a former employee’s device without authority or removing files from premises can create separate legal problems. The guide to an injunction or interim order in Mauritius explains the broader protective framework.

Affidavit evidence and full disclosure on a without-notice request

Surprise may be necessary where notice would trigger deletion. A without-notice application asks the judge to act before hearing the respondent. The applicant must therefore present the material facts fairly, including points that weaken urgency or relevance.

The affidavit should exhibit the threatened message, retention policy, technical evidence or witness account relied upon. It should identify delays and prior warnings. It must also describe the intended main proceedings and explain how the evidence supports that pleaded or proposed case.

A vague fear does not improve by repetition. The strongest application connects a particular file to a particular issue and a particular risk event. If the dispute arises within a company, the factual background may also be considered under shareholder disputes in Mauritius.

What happens when confidential or privileged material is found?

A business device can contain legal advice, employee records, customer data, trade secrets and private messages. Preservation does not erase those protections. The order should anticipate segregation before the claimant sees any disputed material.

Potentially privileged files can be isolated for independent review or further court directions. Irrelevant personal data should not be disclosed simply because it sits on the same drive. Search terms, date limits and named custodians reduce unnecessary capture.

The respondent should identify privilege claims precisely rather than withholding the entire image. The applicant should not read material marked for protected review while the issue is unresolved. Confidentiality safeguards must operate during collection, transport, storage and eventual deletion.

Independent supervision, copying and secure custody arrangements

An intrusive order needs a controlled method of execution. The court may define who attends, what may be copied, where the material is held and when a report must be made. Independent supervision helps prevent the applicant from turning preservation into an unsupervised search.

Digital collection should preserve metadata and record each step. The custodian can document the device identifier, imaging method, hash values where used, sealed copies and every transfer of custody. Paper files can be numbered, copied and sealed with a matching inventory.

Business continuity matters. If a live server or work laptop is involved, imaging may preserve evidence with less disruption than removal. The order should state what happens to working copies and who bears responsibility for secure storage pending directions.

Using the preserved material in the underlying Mauritius dispute

Preservation does not prove admissibility, authenticity or the underlying allegation. The material must still be introduced through the applicable court process and linked to a witness or reliable technical foundation. The respondent may challenge collection, context and interpretation.

Where the preserved record supports a monetary claim, the claimant still needs a judgment and, if necessary, enforcement. See enforcing a Mauritius judgment. If the evidence concerns an urgent transfer of assets, a separate freezing application may be needed.

The point most often missed is return and deletion. When the court no longer requires material, sealed copies, working images and extracted data should be dealt with under the order or later directions. A basic account of courts and legal roles appears in the Mauritian legal system explained.

Frequently asked questions

Can a Mauritius court stop a company deleting evidence?

The Supreme Court may grant urgent injunctive or preservation relief where specific evidence faces a real risk of destruction or concealment. The applicant must identify the material and justify the restraint rather than ask for unrestricted access to company systems. Advice on the facts is needed to frame an order that is effective and proportionate.

What can I do if important emails or CCTV may disappear?

Record what exists, who controls it, the normal deletion cycle and any statement or event showing an immediate risk. A preservation request should identify the relevant accounts, cameras, dates and subjects as closely as possible. Legal advice can determine whether a written demand, agreed preservation or urgent court application fits the evidence.

Can an urgent order allow inspection of another party's computer?

A search or preservation order may permit controlled inspection or copying in an exceptional case, but it is not a general right to explore another party’s computer. The scope, supervision and treatment of privileged or irrelevant files require exact safeguards. Advice must address the known evidence and the risk of its loss in the particular dispute.
