An off-plan developer dispute in Mauritius is governed first by the transaction the buyer actually signed, not by the brochure alone. Delay, an altered apartment and an unfinished project raise different remedies. The reservation papers, notarial deed, plans, payment calls and completion security must be read together before the buyer chooses cancellation, delivery or compensation.

The reservation agreement and deed determine an off-plan buyer’s remedies

An early reservation may identify the unit, proposed price, deposit arrangements and conditions for proceeding. The later deed may contain a fuller description of the property, payment stages, delivery terms and the formal off-plan sale structure. A buyer should not assume that every reservation promise survived unchanged into the deed.

The Code Civil Mauricien regulates sales before completion, including vente en l’état futur d’achèvement, meaning a sale in a future state of completion. Its framework addresses the building description, technical characteristics, price, delivery and the guarantee of completion of the building or of repayment of the sums paid, the garantie d’achèvement, in the formal contract. The exact deed still controls the factual analysis.

Read every annex referred to but not physically attached to the buyer’s copy. Plans or technical schedules may instead have been deposited with the notary. In practice, the argument often turns on a small annex that neither side included in the first exchange of correspondence.

Delayed completion, specification changes and abandoned projects are different disputes

A delayed project requires a contractual chronology. Identify the original delivery term, any extension clause, notices of delay and the developer’s stated cause. A revised marketing estimate is not necessarily a contractual amendment. The consequences of delay also differ from a refusal or apparent inability to complete.

Changed specifications call for comparison rather than speculation. Measure the delivered area and record substituted finishes, moved walls or altered services against the deed materials. An incomplete scheme raises a broader question about funding, construction progress and the security available to buyers. Those categories should not be collapsed into one complaint letter.

If formal proceedings are needed, their pace and stages should be understood before urgent and final relief are combined. The guide to civil litigation in Mauritius explains the general route.

The notarial sale record and completion guarantee require close review

The notary advises and draws the deed and other instruments. Ask for the executed deed, all referenced plans, the technical description, any co-ownership documents and the security itself. The Registrar-General’s Department maintains the repository of registered documents, including immovable property transactions, and provides searches and certified copies.

A heading alone is not enough. Identify the guarantor, beneficiary, covered obligation, expiry language and conditions for a demand. Determine whether the instrument secures completion of the building or repayment following failure to complete. These are materially different protections.

The Code Civil Mauricien requires the formal off-plan contract, in the relevant form, to state the completion or repayment protection. That does not make every payment dispute automatic. The deed, security text and project status must be placed before the adviser who is asked to invoke it.

Payment calls, plans and developer communications buyers should preserve

Keep every payment request with the bank proof of payment and the milestone it claimed had been reached. Retain the version of the floor plan supplied at reservation, the version annexed or referenced by the deed, and all later change sheets. Date-stamped site photographs can show physical progress at each call.

Sales emails may record promises about views, parking, storage, furniture or common facilities. Preserve them in their original format. A screenshot is useful, but the underlying message and attachments give better context. If a foreign sales agent made the statement, identify the company and the capacity in which it acted.

Cross-border buyers may also have governing-law, service or enforcement questions in related agreements. Those issues are treated separately in contract disputes with a foreign party.

What happens if promised amenities or finishes are missing?

First decide whether the missing item was part of the legal bargain. A swimming pool shown only in an artist’s impression presents a different evidential issue from a parking bay described in the deed. A substitution clause may allow some change, but its wording and use need careful examination.

Record the position at handover. List each disputed item, photograph it and state whether the keys are accepted with reservations. An architect or quantity surveyor can explain the cost and practical consequence of a deviation. For workmanship failures rather than missing promises, see construction defect claims in Mauritius.

Minor snagging, substantial non-conformity and loss of an agreed facility do not call for the same response. The point most often missed is proportionality. A demand for replacement, a price adjustment and a claim to unwind the transaction each require a different legal and evidential foundation.

Cancellation, completion and compensation as competing outcomes

Cancellation aims to bring the transaction to an end and recover what should follow from that result. Completion seeks delivery of the promised property. Compensation addresses loss caused by breach. A buyer cannot choose intelligently without asking whether the project can still finish, whether the security responds and whether the completed unit remains useful.

The seller’s solvency and the property’s title position may affect practical value. A court order for money offers little comfort if recovery is doubtful. Equally, cancelling too quickly may surrender an asset that can be completed under functioning security. The guide on enforcing a Mauritius property sale considers when completion itself may be sought.

Any settlement should deal expressly with the deposit, accrued payment calls, interest or contractual charges, release of claims and return of original instruments. An informal promise of a refund at resale can leave both timing and security unresolved.

Coordinating the notary, technical expert and litigation team

The notary’s record establishes the formal transaction. The technical expert establishes what exists on site and how it compares with the promised state. The barrister advises, drafts and litigates the dispute, while the attorney also advises, drafts pleadings, conducts procedure, files and arranges service.

Give all three professionals the same indexed set of documents and the same requested outcome. Contradictory instructions waste time. If interim protection is considered, counsel must know what asset, payment or site position requires protection and what evidence supports urgency.

Readers who need the institutional context can consult the structure of the courts of Mauritius. The chambers’ civil and commercial practice covers advice and litigation arising from property contracts and developer disputes.

Frequently asked questions

Can I get my deposit back if an off-plan project in Mauritius is late?

Delay alone does not produce the same result under every reservation agreement or deed. The contractual completion terms, any permitted extension, the seriousness of default and the chosen remedy all matter. This is general information; advice on repayment requires the signed documents and payment history.

What can I do if the apartment delivered is different from the plans?

Compare the executed deed and annexed plans with the finished apartment, then have material differences recorded before accepting disputed work without reservation. An expert can distinguish a measurable defect from a permissible substitution. This is general information, and your remedies depend on the contractual specification and the significance of the change.

Does an off-plan developer have to provide a completion guarantee in Mauritius?

The Code Civil Mauricien’s off-plan sale framework requires the relevant formal sale contract to address completion or repayment security in the circumstances stated there. The security instrument, issuing institution and triggering terms still need examination. That is general information; a notary or barrister should advise on the actual deed before funds are committed.
