When should a marriage contract be made in Mauritius?

A marriage contract in Mauritius should be discussed, drafted and executed before the civil marriage is celebrated. It records the matrimonial regime chosen through a notarial deed. Leave enough time for disclosure and reflection. A rushed signature shortly before the ceremony invites avoidable doubt about understanding and consent.

A marriage contract should be settled before the civil marriage is celebrated

The Civil Status Officer asks the intending spouses which matrimonial regime they choose and whether a marriage settlement exists. If it does, the officer records the answer and the notary with whom it is deposited. The Code Civil Mauricien lets the spouses marry under the matrimonial regime of their choice, and every matrimonial convention is drawn up as a deed before a notary.

Set the notarial appointment before the final wedding arrangements close in. A venue booking does not reserve legal drafting time. If a translation, company record or foreign-law opinion is needed, it should be obtained before the deed is approved.

The contract chooses a matrimonial regime rather than predicting a divorce award

A Mauritian marriage contract organises ownership and financial relations during marriage. It is not simply a private promise about what a judge must award after a future divorce. The Code Civil Mauricien supplies the matrimonial-regime framework, while divorce legislation may raise distinct financial questions.

Ask how the proposed regime treats existing property, later income, debt and gifts. A family home may require separate title analysis despite the contract. The practical issues are explored further in dividing the family home on divorce.

The notary's role in advising and preparing the deed

The Notaries Act 2008 defines a notarial deed as an authentic document drawn by a notary in the exercise of the profession. It also recognises the notary's role as counsellor. The notary advises, drafts the deed, establishes its date, keeps the original and may issue certified copies.

This is substantive work. Both parties should explain the result they want, not merely ask for a familiar label. If interests differ sharply, separate advice can help each person understand the consequences before returning to the notary.

Assets, debts, businesses and expected inheritances to disclose

Prepare a schedule of land, accounts, investments, vehicles, shares and interests in a partnership or trust. State how each item was acquired and whether it is charged. Existing loans, personal security obligations and tax liabilities belong beside the assets.

For a business, bring the constitution, current share register, recent accounts and any shareholder agreement. Expected inheritances should be described as expectations, not owned property. The drafting must distinguish a present legal interest from a hoped-for transfer.

In practice, unclear debt is the common blind spot. A contract built from asset values alone may not identify who gave personal security or which property secures the borrowing.

What happens if the couple signs too late or not at all?

A deed signed after the ceremony is not the pre-marriage settlement the Civil Status Officer was asked to record. By then, the marriage already operates under the regime entered in the civil-status record. Do not backdate a document or assume later signatures repair the sequence.

Spouses considering a later alteration need separate advice on changing matrimonial regime in Mauritius. If no contract was made, obtain the marriage certificate and establish what was declared at celebration before planning any transaction.

Cross-border couples should compare the contract with foreign rules

Nationality, residence and property abroad can bring more than one legal system into view. A Mauritian deed may not be classified or enforced elsewhere in the same way. Foreign counsel should review its effect on land, pensions, companies and succession in that country.

Record where the couple plans to live and where each asset is situated. A move can change the practical importance of recognition, tax and enforcement questions. Families with children should also treat international parental issues separately; see child abduction and the Hague Convention.

Independent advice, drafting cost and time for reflection

The notary can explain and draw the deed, but one intended spouse may need independent advice where the bargain is complex or unequal. A barrister advises, drafts and litigates. The structure of the Mauritian profession is explained in the Mauritian legal system.

Ask the notary what information is missing and how professional charges will be confirmed. Do not sign a French deed that one party cannot follow. Translation or a careful explanation should come before execution, with enough time to raise questions without wedding-day pressure.

Documents to take to the notary before the wedding

Bring current identity and civil-status records, the intended marriage details and a clear asset-and-debt schedule. Add title deeds, loan statements, company papers, prior marriage records and any existing foreign contract. Foreign documents may need authentication and an accurate translation.

The notary may request further material after reviewing the proposed arrangement. Keep the approved copy with the later marriage certificate. Those two records should tell the same story about the chosen regime.

Frequently asked questions

How soon before my wedding should I make a marriage contract in Mauritius?

Begin while the wedding date still leaves time to identify assets, obtain records and consider the draft without pressure. The deed must be settled before the civil marriage if it is to operate as the couple's pre-marriage settlement. This is general information; a notary should confirm the sequence and documents for your intended ceremony.

Is a prenup done by a notary or a lawyer in Mauritius?

A Mauritian marriage settlement is embodied in a notarial deed, and a notary advises and draws that instrument. A barrister may separately advise one party on legal consequences or a cross-border issue. That division is general information; obtain advice on which professionals your facts require.

Can a marriage contract protect a business I owned before marriage?

The chosen regime can define how property and later financial dealings are treated, but the deed should describe the business and its ownership accurately. Company law, security obligations and later use of marital funds may still matter. This is general information, and advice should be based on the company's records and proposed clauses.
