A live-in domestic worker in Mauritius is an employee whose accommodation is connected to work in a private household. Living at the workplace does not erase agreed hours, rest, leave, dignity or control over personal documents. The contract should separate employment duties from the practical rules of sharing a home.

Living at work does not remove a domestic worker’s employment rights

Domestic service falls within the employment framework even when the worker eats and sleeps at the employer’s address. The Workers’ Rights Act 2019 and applicable remuneration regulations remain relevant. The home has two functions, and neither should obscure the other.

A worker can be present without working. Equally, repeated calls during nominal rest may be work in substance. The household should not measure the day from the first sound in the kitchen to the last family member returning home. The Workers’ Rights Act 2019 guide gives the wider statutory setting.

The contract should separate accommodation from working time

The document should state ordinary duty periods, meal breaks, weekly rest and any specific night responsibility. It should also describe the room, shared facilities, keys and what accommodation costs, if anything, are lawfully attributed. Silence invites the assumption that residence equals availability.

Night care requires particular precision. A sleeping worker who must respond repeatedly is not in the same position as one contacted only for an exceptional emergency. Record actual interruptions and review a pattern that becomes regular. Short entries made at the time are more reliable than a monthly estimate.

Privacy, access to belongings and reasonable use of the home

A private sleeping space should be treated as such. State when the employer may enter, how maintenance is arranged and whether any area is shared. A house rule about security should not become unrestricted access to bags, telephones or personal correspondence.

The worker needs ordinary access to clothes, medicine and identity papers. The Ministry’s published model contract for migrant domestic service says the employer shall not hold the worker’s passport or identification documents. It also states that the passport remains in the worker’s possession. That official model should inform migrant arrangements, while the exact contract and permit conditions still require review.

Rest, leave and interruptions outside agreed duties

Rest must be capable of being used. If the worker cannot leave the home, make a personal call or sleep because tasks continue, the label “off duty” does not settle the issue. Households should identify who covers children, older relatives or pets during the worker’s rest and leave.

Travel with the family also needs prior agreement. Destination, duties, hours, accommodation, documents and return arrangements should be confirmed before departure. For a non-citizen, permission to work in Mauritius does not itself authorise work in another country. The related expat employment rights guide explains why status and contract should be read together.

Food, accommodation and deductions must be recorded clearly

The contract should distinguish cash wages from meals, accommodation or allowances. Never invent a deduction after payday because the worker used more electricity or ate with the household. Any deduction needs a lawful basis, an intelligible calculation and a record.

Migrant lodging may also engage the Occupational Safety and Health (Employees’ Lodging Accommodation) Regulations 2011. The Ministry’s official guidance describes standards for sleeping facilities, sanitation, water, cooking, storage, ventilation and fire safety. Whether those lodging rules apply to a particular household arrangement should be checked rather than assumed. Current wage and deduction rules also need verification when pay is calculated.

What happens to housing when the employment relationship ends?

Plan the employment decision and the departure as connected but separate steps. Review notice, final pay, the accommodation clause, return travel where applicable and the time needed to collect possessions. Do not use retention of wages or a passport to compel a rapid exit.

A serious safety concern may require immediate protective arrangements. In an ordinary termination, however, a written departure plan reduces conflict about keys, rooms and property. If court proceedings later arise, the structure of the Mauritian courts gives general orientation, but the correct employment route depends on the claim.

Raising concerns without losing essential documents or possessions

A worker who anticipates conflict should keep copies of the contract, payslips, permit, passport identification page and important messages in a place controlled by the worker. A simple list of personal items can help if access is later disputed. Immediate danger calls for safety first, not document collection.

Concerns about pay or employment terms may be reported to the Ministry responsible for labour. The Ministry maintains labour offices and a specialist migrant-worker service. Harassment or unsafe conduct may require a different or additional report, as explained in the guide to domestic-worker harassment and safety. The employment and workers’ rights practice sets out the chambers’ work in this area.

Frequently asked questions

Does a live-in helper have to be available all night in Mauritius?

No general assumption of all-night availability should arise merely because the worker sleeps at the workplace. The agreement should identify any genuine night duty, emergency arrangement, rest and how time worked is recorded and paid under the applicable rules. This is general information; advice on a particular schedule requires the contract and actual pattern of interruptions.

Can an employer keep a domestic worker’s passport for safekeeping?

The worker should retain control of the passport and identity documents. The Ministry’s model contract for migrant domestic service expressly states that the employer shall not hold them and that the passport remains with the worker. That is general information; urgent advice may be needed if documents are withheld or access is refused.

Must a live-in domestic worker leave the house as soon as the job ends?

The end of employment can also end contractual accommodation, but immediate departure should not be assumed without checking the agreement, dismissal process and safety circumstances. The parties should arrange access to belongings and a clear departure unless a serious risk requires a different lawful response. General information cannot decide the required timing for an individual housing and employment arrangement.
