A limitation period is the time within which a claim must be brought. In Mauritian civil law, the related concept is prescription, which can bar an action after the applicable period runs. The answer depends on the right asserted, the event that started time and any legally effective interruption or suspension.
A claim may be lost if the applicable limitation period expires
Delay can turn an arguable claim into one that cannot be pursued. Evidence may also disappear before the legal deadline arrives. The first review should therefore address time, even while the parties are still discussing payment or repair.
The Code Civil Mauricien contains general rules on extinctive prescription. Other enactments create special periods for particular claims or procedures. A general rule must not be applied before checking whether a more specific one governs. The Mauritius legal glossary helps distinguish prescription from court deadlines and procedural terms.
In practice, the greatest risk is false reassurance from one familiar period. A debt, employment demand, land right and statutory challenge may not share a clock. Even claims arising from the same facts can be legally different.
Different causes of action can carry different time limits
Describe the legal complaint before counting. Non-payment under a contract may support a personal action. Damage to property may raise contractual and non-contractual issues. A challenge to a public decision can involve a distinct procedure. The remedy sought also matters.
One event may produce several possible claims with different elements and starting points. That does not allow a claimant to rename an expired claim. It means the documents and relief must be analysed accurately. The structure of the Mauritian courts is a separate question from the period itself.
Special regimes need their own text. Insolvency notices, employment remedies, claims involving public bodies and particular land procedures can carry rules unlike an ordinary contractual action. This overview therefore gives no universal number. The right period comes from the legal basis in force when the claim is considered.
Identifying when the relevant event or damage occurred
Counting cannot begin until the starting event is identified. Under the general civil framework, attention falls on when the right of action arose. That may be the missed contractual due date, refusal to perform, damaging event or another legally significant act. It is not automatically the date when the claimant first consulted counsel.
For instalments, each due date may need separate treatment. A clause making the whole balance payable after default may affect the analysis, but only if its conditions were met. For defective work, completion, handover, later repair promises and the first physical signs should all be located precisely.
Use calendar dates. “Several years ago” is unsafe. If an event date is disputed, record both versions and the evidence for each. The limitation opinion may then need a cautious earliest-date calculation.
Contract documents, notices and court papers that fix the chronology
The signed agreement is only the beginning. Gather purchase orders, delivery notes, certificates, invoices, statements, payment records, variations and termination correspondence. For property damage, add plans, handover records, photographs, expert inspections and repair invoices.
Formal papers may change the legal position. Keep every demand, acknowledgement, plaint with summons, return of service, settlement document and order. A debtor's clear recognition of a creditor's right can have consequences under the Code Civil Mauricien, but the wording and authority of the person making it require examination.
Do not confuse an internal complaint reference with court filing. If proceedings are said to have started, obtain the stamped originating document and proof of service. Guidance on instructing a barrister through an attorney explains the roles involved in Supreme Court litigation.
Does negotiation or a demand letter stop time running?
Usually, you should proceed on the basis that negotiation alone does not protect the deadline. A mise en demeure, meaning formal notice before proceedings, may establish demand or default. It should not be assumed to interrupt prescription merely because it is firmly worded.
The Code Civil Mauricien identifies acts that can interrupt prescription, including specified formal legal steps and recognition by the debtor. Whether a particular act qualifies depends on its substance and validity. A promise to “look into the account” may not amount to an unequivocal acknowledgement of the claimed right.
Settlement discussions can continue while protective proceedings are prepared. Tell the other side if authority is needed for a standstill or other arrangement, and have any agreement reviewed. Informal courtesy is not a safe substitute for a legally effective step.
What happens when the claimant discovered the problem later?
Late discovery is factually important, but it does not create one general discovery rule for all Mauritius claims. The court must still identify when the particular right of action arose under the applicable law. The date of visible damage, the date of an expert report and the date of legal awareness can differ.
Ask why the problem was not known. A hidden defect, continuing performance, reassurance after inspection or alleged concealment may affect the factual and legal analysis. None should be treated as an automatic extension. Preserve what was said and what a reasonable inspection could reveal.
Property files often contain several competing dates. The first crack, water entry, engineer's report and failed repair are not interchangeable. Advice should address each pleaded wrong rather than select the latest event because it is convenient.
Protective filing and urgent advice before the deadline is calculated
If the earliest credible deadline is close, seek advice before every factual issue is resolved. A practitioner can identify the claim, forum, parties and step capable of protecting time. Filing the wrong proceeding or failing to serve it correctly may not produce the intended effect.
Bring originals or complete copies. Mention prior proceedings, insolvency, the claimant's age or incapacity, any period abroad that may be legally relevant, and every written acknowledgement. Confidential communications made for legal advice should be handled with the care described in the guide to legal privilege in Mauritius.
Do not wait for an exact calculation if documents are still missing. Counsel can work from the earliest adverse date and refine the opinion. The Mauritian legal system practice overview is a starting point for advice on civil claims and court procedure.
Frequently asked questions
Is it too late to sue for an old debt in Mauritius?
Possibly, but the age of the invoice alone does not answer the question. The debt's legal basis, due date, later acknowledgements, payments and any proceedings must be examined under the applicable rule. This is general information; a practitioner should calculate the period from the documents before you decide that recovery is still available or already barred.
Does sending a formal notice extend the limitation period?
Do not assume so. A formal notice may prove demand, default or the amount asserted, but interruption of prescription depends on the act recognised by the governing law and its validity. This is general information; obtain advice on the precise notice and claim while there is still time to issue protective proceedings.
Which date matters if I discovered property damage years later?
The answer may turn on when the relevant right of action arose, which is not always the inspection date or the date damage became obvious. Construction, contract, ownership and alleged concealment can raise different questions. This is general information; the agreement, works history, expert findings and first signs of damage need individual legal review.
