There is no single published price for “a lawyer” in Mauritius. Legal fees depend on the professional instructed, the work required, the papers, urgency, court attendances and whether the matter settles or becomes contested. The practical answer is to ask for a clear scope and fee basis before work starts, then review it as the case develops.
How Mauritian legal fees are structured
A fee may be quoted for an initial consultation, written advice, drafting, a court appearance or a defined transaction. In litigation, fees can also reflect preparation for hearings, the volume of documents and applications made by either side. A responsible estimate identifies the work currently anticipated; it cannot guarantee the final cost of an unpredictable dispute.
Ask what is included, what is excluded and who may approve further work. Do not compare two figures without comparing their scope.
Consultation and advice fees
The first meeting is usually a working appointment, not a free evaluation of the whole case. Counsel reads what is available, tests the account, identifies missing facts and discusses options. Send a short chronology and the key documents in advance if requested; time spent sorting a disordered file may add little value.
At the end, ask whether advice will be confirmed in writing, what the immediate next step is and whether another professional must be instructed.
Brief fees and refreshers for court work
For advocacy, a brief fee commonly covers preparation and an initial hearing or defined stage; a refresher is a further fee for continued hearing work. The terminology does not replace a written discussion of the actual arrangement. Ask how adjournments, additional evidence, expert work and further dates will be treated.
Do not assume that a case listed for one day will finish that day. Court timetables and the other party’s conduct can affect preparation and attendance.
Attorney and notary costs
An attorney and a barrister can have separate roles in a case, so each may have separate fees. A notary’s work is different again: authentic deeds, registration steps and transaction formalities may involve professional charges as well as taxes and registry payments. Our guide to the three professions explains why the choice affects the work and cost.
For property or succession work, obtain a breakdown that distinguishes the professional fee from statutory dues and third-party charges.
Disbursements and court fees
Disbursements are out-of-pocket expenses incurred for the case, such as filing, service, copies, reports or records. They are not the same as counsel’s or an attorney’s fee. Ask which are likely, whether money is requested in advance and whether receipts or an account will be supplied.
Some court fees are prescribed, but rules can change and the correct amount depends on the process. Do not rely on old online figures when budgeting a filing.
Recovering costs from the other side
Winning does not necessarily mean recovering every sum paid. A court may make a costs order under the applicable rules, but the amount recoverable and the route to assessment are separate questions. Costs are therefore a litigation risk to discuss at the outset, not an afterthought once judgment is given.
Settlement proposals should also be read against their costs implications, rather than judged only by the headline payment.
Controlling your legal spend
Give complete instructions, preserve original documents, respond promptly to information requests and focus on the legal issue. Ask for a written scope, a staged estimate where possible and notice before non-routine work. These steps cannot remove risk, but they help you make informed decisions.

Practical preparation
For how much do lawyers cost, the quality of the first instructions often affects the quality of the next decision. Keep the original documents, make a dated note of significant events and identify the person who can confirm each important fact. Do not alter messages, remove files or ask a witness to change their account. If there is an order, notice or appointment, record the exact date and take it seriously.
Before authorising a stage of legal work, ask what it will cover, how the fee is calculated and which court, attorney, expert or other disbursements are separate. Request notice if the scope or estimate changes, and keep instructions focused on the agreed objective. A cost discussion becomes more reliable once the lawyer has seen the principal papers and understands whether the matter is advisory, urgent or contested.
Frequently asked questions
Do lawyers in Mauritius charge by the hour?
Fee arrangements vary. Ask whether the fee is for a consultation, a defined piece of work, an appearance, time spent or a combination of these.
Will I get my costs back if I win?
A costs order is not automatic and recovery may be less than the amount paid to your own legal team. The court’s power, the result and the applicable rules matter.
Are consultation fees charged separately?
Often they are, but this should be confirmed before the appointment. Ask whether the meeting fee will be credited against later work.
