Can an employee be put on garden leave in Mauritius?

An employee can be placed on garden leave in Mauritius where the contract and circumstances permit a paid absence during notice. The employee remains employed but is told not to perform normal duties, attend the workplace or contact specified business connections. Without clear wording, imposing that arrangement can produce a contractual dispute.

Garden leave keeps the employment contract alive during notice

Garden leave is not an early termination payment. Notice continues to run and the contractual relationship remains in place. Salary, applicable benefits and continuing employee duties must therefore be addressed for the whole period.

The employee usually remains available for reasonable requests permitted by the contract. That may include answering a handover question, returning equipment or attending a meeting. It does not necessarily mean performing the former role from home.

Dates must be exact. The instruction should identify the notice start, proposed end and whether accrued leave will be taken within that period. Confusion between garden leave, annual leave and immediate termination commonly causes the later pay dispute.

Is there an express garden-leave power in the contract?

The clearest clause permits the employer to withdraw duties and exclude the employee from premises while continuing the employment relationship. It can also address availability, contact, equipment and benefit treatment. A general management power may not answer every point.

Without an express term, the employer should consider whether the employee has a material contractual interest in continuing to work. Professional visibility, commission generation or maintenance of a current skill can make removal of duties more significant. The answer is not the same for every role.

A letter cannot quietly expand the original bargain after notice is given. Check variations, policies and any collective terms before issuing it. For an expatriate employee, the governing-law clause and local work arrangement may add another layer, as explained in expatriate employment rights.

Pay, benefits and duties while the employee stays away from work

Basic salary should be distinguished from commission, allowances, insurance, accommodation and the use of a vehicle or telephone. Each item may have its own contractual condition. Removal of a tool needed only for work is different from withdrawal of an agreed personal benefit.

Variable pay needs particular care. A sale may have been negotiated before garden leave but invoiced later. A bonus scheme may require active employment, performance or presence on a payment date. The guide to bonus and commission disputes explains why those words must be read before calculating the final account.

Employment duties continue too. The employee should remain contactable as reasonably required, protect confidential information and comply with lawful instructions. The employer should not manufacture impossible availability demands merely to create a breach.

Access to clients, systems and the workplace during garden leave

An employer may remove system access to reduce information and customer risk. That step should be coordinated with payroll, expense and personal-record access. Blocking every channel can prevent the employee from obtaining documents needed to check final remuneration.

Client communication should be planned. The employer may announce a new contact without suggesting misconduct. The employee should not send a private farewell campaign if the instruction prohibits business contact. Social contact with a genuine friend needs separate judgement from discussion of a live account.

Company property should be itemised. Record the return of laptop, keys, files, access cards and authentication devices. Personal data should be removed through an agreed process, not by wiping the machine immediately before handover.

What happens if the employee starts a new job before notice expires?

Starting elsewhere can conflict with the continuing contract. Exclusivity, fidelity and conflict terms may still apply, even though no ordinary duties are being performed. The proposed new employer should know the actual end date rather than assume garden leave means freedom to start.

The parties can agree an earlier release. That agreement should state the revised termination date and deal with pay, benefits, property and any continuing restrictions. An informal message from a line manager may not have authority to bind the employer entity.

A foreign worker must also consider employment authorisation and the employer named on it. The contractual release does not itself amend an immigration or work permission. Advice should join those two questions before a start date is promised.

Garden leave alongside confidentiality and restrictive covenants

Garden leave protects a business while the employee is still employed. A post-termination covenant begins, or continues, after employment ends according to its wording. The periods should be mapped on a calendar rather than treated as one undifferentiated ban.

The contract may provide that time on garden leave reduces a later non-compete period. It may not. Do not assume a deduction that is absent from the text. The employer should also ask whether confidentiality and non-solicitation terms adequately address the concern without seeking a broader restriction.

In practice, vague instructions create avoidable breaches. “No contact” should say whether it covers clients, suppliers, employees and social communications. The employee needs to know what remains permitted before an accidental conversation becomes evidence in a restraint claim.

Challenging or enforcing a garden-leave instruction

The employee should request the contractual basis, dates, payment arrangements and expectations in writing. A refusal to comply can carry risk, so disagreement should be raised promptly and precisely. The unfair dismissal guide addresses the separate question of a terminated relationship.

An employer seeking compliance should show that it is performing its side of the contract. Continue agreed payments, answer expense and benefit questions, and give a workable route for required communication. If urgent court relief is considered, the evidence should identify the actual threatened breach.

Barristers advise, draft and litigate, while attorneys also advise and draft pleadings, besides conducting procedure, filing and service. The guide to barristers, attorneys and notaries explains those roles. The employment and workers’ rights practice describes the chambers’ related work for employers and workers.

Frequently asked questions

Can my employer put me on garden leave without my agreement in Mauritius?

An express contractual power gives the employer a clearer basis to require paid absence during notice. Without it, the employer must consider the employee’s contractual right to work and all surrounding terms. Advice on the particular contract is needed before either side treats the instruction as valid or refuses it.

Do I still receive commission and benefits on garden leave?

Garden leave normally keeps employment alive, so the contract remains the starting point for salary and benefits. Commission may depend on when it is earned and on the scheme’s wording. Individual advice is required before a benefit or variable payment is withheld.

Can I contact customers while I am on garden leave in Mauritius?

A garden-leave instruction may prohibit business contact with customers while the employment continues. Confidentiality, fidelity and express non-solicitation terms may also matter. Ask for advice on the wording before making contact, even if a customer approaches first.
