Can a foreign witness give evidence in Mauritius?

Yes. A foreign witness can give relevant evidence in a Mauritius civil case, but the method must be accepted by the court and fair to every party. A signed account from abroad is not automatically a substitute for oral evidence. Attendance, advance evidence, documents, language and cross-examination should be resolved before the hearing.

A foreign witness can assist if their evidence is relevant and properly presented

Nationality does not make a witness useful or inadmissible. Relevance does. An overseas accountant may explain records they prepared, a supplier may prove delivery instructions, and a director may describe the approval of a transaction. Each should speak to facts within their knowledge.

Begin by identifying the disputed fact and why this person can prove it. A witness who merely repeats what colleagues said may add delay without resolving the point. The broader sequence of pleadings, disclosure and trial is explained in the Mauritius civil litigation guide.

Foreign location affects logistics, not the obligation to be accurate. Dates, emails and contract versions should be checked with the witness. If the testimony concerns board authority, compare it with the company's resolutions and the legal issues discussed in director duties in Mauritius.

Witness statements and affidavits prepared outside Mauritius

A witness statement sets out evidence in the witness's own words and should distinguish recollection from information found in records. An affidavit adds an oath or affirmation before a person authorised to administer it. The required form depends on the proceeding, the document and the order governing evidence.

Before an affidavit is signed abroad, confirm the proposed oath-taker's name, office and authority. Ask what certification or authentication the Mauritian filing will require. A notarial stamp, consular act and apostille perform different functions. None repairs evidence that is irrelevant or based on unidentified sources.

The Courts Act permits cross-examination about a previous written statement and allows the court to require its production. Drafts should therefore not be treated casually. Corrections belong in a clean, explained final document, not in silent changes after signature.

Permission and practical arrangements for remote testimony

A civil litigant should not assume that a video call can replace attendance. The Courts Act contains express live-link provisions for identified proceedings, including criminal proceedings. That does not create a general automatic entitlement for an overseas witness in every civil dispute.

Any request for remote evidence should be made early and supported by the real reason. Travel difficulty, health, location and proportionality can be described with evidence. The proposal should state the platform, location, time difference, connection test and person responsible for the documents.

The court may require another route. Under the Courts Act, a party intending to call a witness who will not be in Mauritius on the trial day may apply for an advance de bene esse hearing, meaning evidence taken for use at the later trial. The application is made before a Judge in Chambers, and the resulting order is served on the other parties.

Identity, oath and document handling across borders

The witness's identity should be capable of verification without placing unnecessary passport data in the public file. The person administering an overseas oath must be properly identified. For remote testimony, counsel should propose how the court can see who is present with the witness and whether unauthorised material is being consulted.

Exhibits need one numbering system. Send the agreed hearing bundle through an approved route and ensure every participant sees the same pagination. If a new document appears during testimony, the court should direct how it is shown, marked and retained. Private messaging with the witness during evidence should be prohibited.

Commercial files often contain personal or confidential material. Redaction must not obscure the fact being proved or alter context. The party relying on a foreign record should preserve its native file and metadata where authenticity may become contested.

What happens if cross-examination requires the witness in person?

Cross-examination tests the witness's account against documents and competing evidence. If credibility is central, the court may consider physical attendance necessary. Cost or inconvenience alone does not decide fairness. The party should keep travel available until the court accepts another arrangement.

An affidavit may introduce evidence, but it does not neutralise a proper request to question the maker. The Courts Act also allows certain out-of-court statements in civil proceedings subject to its conditions and Rules of Court. Admissibility and weight remain distinct questions.

In practice, the problem often appears late. A party discloses a strong written statement, then discovers the witness cannot attend and no direction was obtained. That risk should be raised when witness lists and hearing dates are discussed, not after tickets or video facilities become unavailable.

Translation and interpretation for an overseas witness

The Courts Act states that English is used in the Supreme Court, while a witness lacking sufficient English may give evidence in the language with which they are most familiar. Evidence in another language is generally translated into English and recorded, subject to the Act's civil exceptions. Interpreter arrangements belong in the hearing plan.

A witness should not memorise an English translation they do not understand. Prepare the statement through a competent interpreter, record which language was used and have the witness confirm the final meaning. Technical terms in invoices or engineering reports may require a separate document translation.

The interpreter must remain neutral. Their task is to convey questions and answers, not explain the case or improve an answer. Readers unfamiliar with the courts and legal professions may also consult the Mauritian legal system explained.

Preparing travel or video arrangements before the hearing date

For travel, confirm entry requirements, the witness's availability and the original documents they must bring. Build flexibility around the court's listing without promising the witness a fixed finishing time. Decide who pays initially and obtain approval before booking non-refundable travel.

For a proposed video hearing, test sound, camera, lighting and access to the bundle from the exact location. A backup telephone number helps with a broken connection but does not authorise evidence by telephone. The court must control the method.

A witness abroad may not yet know that related documents must be served on another overseas party. That is a different procedural question. See serving Mauritius commercial proceedings abroad. Frequently asked questions

Can my witness testify by video in a Mauritius civil case?

Possibly, but a party should seek a case-specific direction and should not present remote testimony as an automatic right. The court will need workable arrangements that preserve the oath, documents and cross-examination. This is general information; the forum, existing orders and reason for remote evidence require individual advice.

Does an affidavit signed abroad need to be notarised for Mauritius?

Not every overseas document has the same form, so notarisation should not be assumed or rejected without checking the intended filing. The identity and authority of the person administering the oath, and any authentication requirement, must be established. This is general information; the affidavit and the court in which it will be used need specific review.

Who pays for an overseas witness to attend court in Mauritius?

The party calling the witness will usually need to arrange and fund attendance in the first instance, subject to any agreement, direction or later costs decision. Recoverability is not the same as the amount actually spent. This is general information; obtain advice before incurring travel or accommodation costs on the facts of the case.
