A foreign executor can deal with assets in Mauritius, but the appointment made abroad is not a universal pass. The executor must prove who appointed them, that the appointment remains effective and what local step each bank, company, notary or registry requires. Authentication answers only part of that problem.
A foreign appointment does not by itself complete administration in Mauritius
Probate terminology differs between legal systems. A foreign court may issue a grant naming a personal representative, while a Mauritian will may name an exécuteur testamentaire, or testamentary executor. The documents must be read for their actual legal effect. Similar labels cannot be assumed to confer identical powers.
The asset also matters. A foreign grant that satisfies one financial institution may not complete a transfer of Mauritian land. Registration Duty Act requirements, the land title and notarial formalities still have to be addressed. The related guide to successions with foreign assets explains why administration is divided by jurisdiction and asset type.
The will and overseas grant must establish the executor’s authority
Begin with the complete will, any codicil, the sealed or certified grant, the death record and proof that the grant is final and current. A court extract containing only the executor’s name may omit limits or later changes. The executor’s identity should match every document precisely.
A holographic or mystic will is not acted upon until it has passed through the steps the Code Civil Mauricien requires; it must be presented to the Master of the Supreme Court before it is put into execution. Distance alone does not exclude the person entitled to apply, who can generally act through a representative holding a properly framed authority. This does not mean that every overseas grant is automatically resealed or enforced through one standard route.
Any question about the deceased’s marriage property position should be separated from the executor’s appointment. The matrimonial regime and succession guide explains why ownership must be established before the estate share is calculated.
Authentication, translation and local presentation of foreign papers
Ask the intended recipient for its document checklist first. It may request the original or a court-certified copy, proof of finality, an apostille or other authentication, and a translation. A name discrepancy should be supported by civil-status evidence instead of being silently altered by the translator.
The Notaries Act 2008 requires a private-signature document, or a notarial deed drawn up in a foreign State, to be registered before a notary may base a notarial deed on it or receive it on deposit. This concrete local step is separate from obtaining the paper in its issuing country.
In practice, the weakest link is often the document chain. An informal scan may show what the order says yet fail to show the court seal, certification or finality. Sending it repeatedly will not cure the missing feature.
Managing Mauritian land, bank accounts and shares from abroad
For land, obtain the title deed, details of any mortgage and the succession documents required by the notary. The Registrar-General’s Department records deeds, titles and encumbrances. Its role should not be confused with deciding a disputed will. A sale or transfer must proceed through the form appropriate to the land and the parties’ rights.
A bank will protect confidential customer information until the claimant proves a recognised estate capacity. The Banking Act 2004 permits disclosure of succession information to an appointed personal representative or testamentary executor for the estate. It does not oblige every bank to treat an unauthenticated foreign grant as sufficient.
For shares, the company’s register, constitution and any shareholders’ agreement need review. The executor should ask whether the company requires a particular estate document, board process or indemnity. Ownership is not changed by forwarding the death certificate alone.
What happens when an institution refuses the foreign executor’s documents?
Request the refusal and missing requirements in writing. The useful question is whether the objection concerns authenticity, translation, the executor’s capacity, the document’s Mauritian effect or the institution’s internal release process. Each problem has a different answer.
A focused affidavit may assist with factual gaps, but it cannot rewrite the foreign order. See the affidavit of succession in Mauritius for the limits of a sworn account. Where the institution maintains a legal objection, advice should address that objection before anyone begins an unnecessary court application.
Local representation, travel and practical administration costs
An executor need not assume that every signature requires a flight to Mauritius. A power of attorney can be considered for defined acts, subject to the receiving professional’s and institution’s requirements. Under the Notaries Act 2008, a notary dealing with an agent must verify that the power authorises the transaction.
Remote work still produces original-document, courier, certification, translation and registration costs. Ask who will hold each original and how it will be returned. The point most often missed is that a broad foreign power of attorney may use language that does not identify the Mauritian asset or act clearly enough.
A barrister, attorney and notary have distinct roles. Barristers advise, draft and litigate. Attorneys also advise and draft pleadings, besides conducting procedure, filing and service. Notaries advise and draft deeds and other instruments. The overview of the Mauritian legal system sets those branches in context.
Establishing usable authority before collecting or transferring assets
Create a separate requirements sheet for each asset-holder. Record the person who supplied the checklist, the form of copy accepted, translation language, authentication route, signing method and any local filing. This prevents the executor from ordering several expensive versions of the same paper without knowing which one is usable.
Do not collect estate money into a personal account or promise a distribution while authority remains contested. Once every recipient has accepted the necessary capacity, the executor can arrange collection, settle proper estate liabilities and document the eventual transfer. For Mauritian advice and representation, the property, estates and wills practice is the relevant starting point.
Frequently asked questions
Can an executor living abroad deal with a Mauritius estate?
Yes, residence abroad is not by itself the end of the appointment, but usable authority must be established for each Mauritian asset. Local filings, a notarial deed or a representative may still be needed. This is general information; the will, overseas grant and asset-holder's requirements need individual review.
Will a Mauritian bank accept probate granted in another country?
A bank will examine the issuing court, finality, authentication, translation and its own succession requirements before releasing information or funds. An apostille proves origin where the Convention applies, but does not decide the grant's effect in Mauritius. This is general information; ask the particular bank for its written checklist and obtain advice on any refusal.
Does a foreign executor need someone locally to sign documents?
Sometimes. A properly framed power of attorney may permit specified acts. A notary must verify that the authority covers the transaction, and some steps may require another form of local authority. This is general information; the proposed document and act should be checked before a proxy signs.
