Redundancy affecting an expat in Mauritius

Redundancy affecting an expat in Mauritius is a termination based on the employer’s operational needs, not the employee’s nationality or a disguised disciplinary reason. It can engage the Workers’ Rights Act 2019, the Redundancy Board and an employment-based immigration permission. The employment and permit questions must be handled together, but they are not the same decision.

An expat role must be genuinely redundant rather than simply relabelled

The starting question is what work has ceased or changed. A genuine reduction may follow closure, loss of a business line, restructuring or removal of a position. It is harder to reconcile with a vacancy carrying substantially the same reporting line, duties and responsibilities soon after termination.

Job titles can mislead. Compare the signed job description with organisational charts, recruitment advertisements and the work allocated after departure. A local replacement is not prohibited merely because the former holder was foreign, but nationality cannot turn a continuing role into a redundant one. The broader statutory framework is introduced in the guide to the Workers’ Rights Act 2019.

Which Mauritius entity is responsible for the redundancy process?

An international assignment may involve a foreign parent, a Mauritian subsidiary, a payroll provider and a mobility team. The responsible employer is identified from the contract, payslips, permit application, reporting arrangements and the entity directing the work. A group logo is not an answer.

This distinction affects who gives notice, makes final payments and answers any statutory process. A foreign parent may have promised tax equalisation or repatriation without becoming the local employer. Conversely, the Mauritian entity cannot assume that an overseas human-resources letter completes its obligations. The point most often missed is that a package signed with one group company may not release another.

Consultation, selection and alternatives to terminating the assignment

Consultation should occur while alternatives remain real. The employer should explain the operational reason, the affected pool and the criteria used if several employees perform comparable work. The employee can then correct errors about skills, mobility, cost or availability.

Possible alternatives depend on the business. They may include a suitable local vacancy, transfer within the group, changed duties, reduced hours or an agreed return to the home entity. None should be presented as available unless the relevant company and immigration route support it. The original Mauritius employment contract remains central because it identifies mobility, notice and benefit terms.

The role of the Redundancy Board in an expat redundancy

The Redundancy Board is established under the Workers’ Rights Act 2019. Its official description says it deals with workforce reduction and enterprise closure for economic, financial, structural, technological or similar reasons. The statutory route can require employer notification and supporting reasons before the intended reduction.

Coverage and procedure must be checked against the current consolidated Act for the particular employer and proposal. Do not assume that an individual settlement makes the Board irrelevant, or that every termination described as redundancy follows an identical route. The Board can examine documents and make orders. In practice, the quality of the business explanation and the chronology matter more than a polished dismissal label.

Repatriation, immigration status and family arrangements after job loss

A professional Occupation Permit combines permission to work and reside. The Economic Development Board administers registration, while the Passport and Immigration Office deals with the permit. The permit is issued in relation to the employment declared in the application, so taking up a different position after job loss is a permit question in its own right rather than an automatic consequence of finding new work.

Act promptly. Ask the EDB to confirm the present position in writing before assuming that any grace period applies. A spouse’s or child’s residence may be linked to the main holder, so each family member’s document needs checking. School terms, tenancy dates and medical insurance do not extend immigration status.

Return travel is separate. The contract, assignment letter and mobility policy may allocate flights, temporary accommodation, visa cancellation and shipment. Where the job involved a different permit, consult the authority responsible for that permission rather than applying Occupation Permit guidance by analogy.

Calculating contractual payments without overlooking overseas benefits

Final pay is not confined to basic monthly salary. The review should separate statutory entitlements from contractual sums and any discretionary proposal. Accrued pay, notice, leave, bonus wording, commissions and retirement contributions may each use a different calculation basis.

Expat packages add another layer. Housing, school fees, private medical cover, tax preparation, home leave, exchange-rate protection, equity awards and pension contributions may sit in separate documents. Identify when each benefit ends and whether the employer can substitute cash. The phrase “full and final” should not be accepted until those items have been traced.

Documents to review before accepting a redundancy package

Collect the local contract, assignment letter, amendments, mobility policy, permit records, payslips and benefit statements. Add the redundancy letter, consultation notes, selection material and any vacancy descriptions. If the proposal includes a release, record which entity signs it and which claims it covers.

A compromise should be read before payment or departure makes correction difficult. The article on instructing a barrister through an attorney explains the professional roles if proceedings become necessary. For comparison with household employment documentation, see employment contracts for domestic workers. The employment and workers’ rights practice sets out the wider area.

Frequently asked questions

Can my company replace me with a local employee after making me redundant?

A replacement does not automatically prove an unlawful dismissal, but the duties, timing and stated reason deserve close comparison. If substantially the same job continues under a new label, the employer may struggle to show that the expat role genuinely disappeared. That is general information; advice on your facts requires the old and new job descriptions, the selection material and the employer’s explanation.

What happens to my Occupation Permit if I am made redundant in Mauritius?

Loss of the job can affect an employment-based Occupation Permit, which is issued in relation to the declared employment, and whether new employment can be taken up depends on the permit framework and the authorities’ present rules. Contact the Economic Development Board and Passport and Immigration Office at once, and check every dependant’s status. This is general information, not advice that a particular permit remains valid.

Should an expat redundancy package include flights home and shipping costs?

It may, if the employment contract, assignment letter, mobility policy or recruitment documents provide those benefits. The legal minimum and the contractual package are separate questions, so repatriation language should identify tickets, family travel, temporary housing and shipment limits. General information cannot decide what your documents require; the complete contract set must be reviewed.
