An Indian civil decree may be enforced in Mauritius only after it has been given local legal effect. The usual analysis is an application to the Supreme Court of Mauritius for exequatur, meaning an order that makes the foreign judgment executable here. The Court examines the judgment's international regularity before any Mauritian asset is attached.

An Indian judgment needs the correct recognition route in Mauritius

Article 546 of the Code de Procédure Civile provides the general foundation used for recognition of foreign judgments. The statutory registration route for certain United Kingdom superior-court money judgments should not be transferred to an Indian decree by analogy. Country, court, subject matter and remedy must be identified first.

“Decree” can cover very different outcomes. A fixed debt, declaration, injunction, costs award or company order may require different treatment after recognition. An arbitral award made in India is not a court judgment at all for this purpose. The guide to foreign awards and arbitration in Mauritius addresses that separate route.

Court status, jurisdiction and finality must be established first

Record the Indian court's full name, place, case number and level, together with the legal character of its order. The Mauritian court must be satisfied that the decision is valid, final in the relevant sense and capable of execution in India. A decree sheet without the reasoned judgment may not show enough.

The Indian court's jurisdiction also needs a recognised basis. The defendant's residence, registered office, business connection, contractual submission or participation can matter. So can the location and subject of the dispute. A Mauritius company that appeared only under protest should preserve the order dealing with its jurisdiction objection.

Certified Indian orders and proof that the defendant was served

Obtain an authenticated or properly certified copy of the judgment and decree, not a search-result printout. Add the plaint or originating application, summons, service returns, appearance records and every order affecting execution. Where the Indian file uses electronic court records, ask Indian counsel which certified output proves authenticity for foreign use.

Service cannot be reduced to a postal receipt without context. The bundle should show the address used, permitted method, delivery event and time available to answer. If substitute service was ordered, include that order and proof of compliance. Documents in a language other than English or French may require a certified translation acceptable to the Mauritian court.

Commencing the Mauritian recognition or debt proceedings

The recognition case is initiated before the Supreme Court with motion papers and supporting affidavit evidence. A legal opinion from an Indian practitioner may be necessary because Indian law, including the decree's enforceability and appeal status, is a fact to be proved in Mauritius. The respondent receives the opportunity to contest the relief.

An attorney-at-law advises, drafts pleadings, conducts procedure, files and arranges service. Counsel advises, drafts and litigates. A foreign creditor should allow the Mauritian professionals to settle the evidential form before originals are dispatched. The process of instructing a barrister through an attorney explains that working relationship.

What happens when the Indian decision is under appeal?

Finality is assessed from the current Indian procedural position. A filed appeal, application for review or stay may mean the judgment cannot yet support exequatur. The title of the proceeding is not decisive by itself. The Mauritian court needs evidence explaining its legal effect and any operative suspension.

Do not omit an appeal because the creditor believes it has weak prospects. That creates a credibility problem and may expose the recognition order to challenge. In practice, the cleanest evidence is a current court certificate or opinion tied to the appeal docket and the exact stay order. If the impediment later ends, fresh evidence can address the changed position.

Defences based on fairness, fraud or public policy

The Mauritius respondent may dispute jurisdiction, proper notice, finality or compatibility with international public policy. Fraud can also defeat recognition where proved. These safeguards do not turn the hearing into a rehearing of the commercial merits, and ordinary disagreement with the Indian judge's conclusions is insufficient.

Default decrees require particular care. The absence of the defendant does not automatically invalidate the result, but the creditor must show fair notice and the court's acceptable jurisdiction. A company should keep board and officer records showing what arrived and who dealt with it. Related governance questions are discussed in director duties in Mauritius.

Converting recognition into execution against Mauritian assets

After recognition, choose an execution step that corresponds to verified property. A bank relationship, shareholding, parcel of land or debt owed by a customer each demands different evidence and procedure. The recognised decree binds the debtor named in it. It does not, without another legal basis, move liability to an affiliate, director or shareholder.

Prepare a precise balance in the judgment currency, showing principal, awarded costs, lawful interest and credits. Then compare the likely return against existing security, ownership disputes and insolvency risk. The point of the exercise is recovery, not recognition in isolation. The Mauritius civil litigation guide explains the wider court setting, while the civil and commercial practice page identifies the relevant chambers work.

Can I enforce an Indian money judgment against a Mauritius company?

Potentially, if that Mauritius company is the judgment debtor and the Indian decision is first made executable here. Its local assets and any competing security then determine the recovery options. That is general information; the company's identity and the decree need individual review.

Do I have to wait for an Indian appeal before enforcing in Mauritius?

A pending appeal can prevent the finality needed for exequatur, particularly where execution has been stayed. The effect must be proved under Indian law rather than assumed from the word appeal alone. This is general information; advice requires the appeal papers and current orders.
