An English money judgment from a superior court may be registered in the Supreme Court of Mauritius under the Reciprocal Enforcement of Judgments Act. Registration gives the order local force for execution. Other English judgments, including orders from a court outside the Act's scope or relief that is not a money award, require a different recognition analysis.

An English judgment must qualify for the available Mauritius route

The Act applies to a judgment obtained in a superior court in the United Kingdom which makes a sum of money payable. Its official text directs an application to the Supreme Court. It also requires the request within 12 months of the judgment, or a longer period allowed by that Court. Delay should therefore be addressed at once.

The label “UK judgment” is too broad. Scotland and Northern Ireland form part of the United Kingdom but are not England. A county court and the High Court also occupy different positions for this Act. Identify the court, division, order type and exact debtor before deciding that registration is available.

Registration and ordinary recognition routes require different checks

For a qualifying English High Court money judgment, registration is the purpose-built statutory route. The Supreme Court considers whether enforcement is just and convenient and whether any refusal ground applies. Those grounds include lack of jurisdiction, absence of due service where the debtor did not appear, fraud, an appeal and public policy.

An order outside the Act may still need examination under the ordinary Mauritian rules for foreign judgments. That is not a device for avoiding the statute. The relief, court and cause of action have to be mapped carefully, especially where the English proceedings concerned insolvency, family property or a non-money injunction. Cross-border contract planning is discussed in contract disputes with a foreign party.

Sealed orders, finality evidence and proof of English service

Ask the English court for a sealed, certified copy fit for use abroad. Add the claim form and particulars, the service certificate or order for alternative service, and every order that varies, stays or explains the judgment. A short costs order may depend on a later assessment, so the complete procedural chain matters.

Evidence should also show what remains payable and whether an appeal is pending. If the creditor is an assignee, include the assignment and notice. Company names and numbers should match the English order and Mauritian records exactly. In practice, registration work slows when the creditor holds a downloaded judgment but cannot produce the initiating process or proof of service.

Applying to the Mauritian court before execution begins

The registration request is filed in the Supreme Court with evidence meeting the Act and the applicable Rules of Court. Notice of registration is served on the judgment debtor. The statutory scheme allows the debtor to ask for registration to be set aside, and execution is suspended during the period provided for that challenge.

A barrister advises, drafts and litigates. An attorney-at-law also advises and drafts pleadings, while conducting procedure, filing and service. The distinction matters when papers must move between English solicitors and the Mauritian registry. The guide to barristers, attorneys and notaries in Mauritius explains the roles.

What happens when the English judgment was entered by default?

A default order needs more, not less, documentary context. The Act prevents registration where the debtor was not duly served and did not appear. Jurisdiction is separate. If the debtor was neither ordinarily resident nor carrying on business within the English jurisdiction, voluntary appearance, submission or an agreement to submit may become central.

The Mauritian process is not a fresh defence to the English claim. It does allow the debtor to invoke the statutory safeguards. Fraud, public policy and a pending appeal must be treated as evidential issues rather than labels. Where asset preservation is genuinely urgent, the separate requirements for an injunction or interim order in Mauritius should be considered before assuming registration alone freezes property.

Interest, costs and currency issues in the recoverable sum

Separate the judgment principal from interest, assessed costs, registration expenses and payments received. The Act permits reasonable registration costs to be recovered in the same manner as sums payable under the judgment. It does not justify adding an estimated English costs figure which has not become payable.

Sterling and Mauritian rupees must not be blended without a stated basis. Counsel should identify the legally supportable conversion date and how post-judgment interest is proved. A transparent schedule lets the debtor, Court and enforcing officer see the sum claimed on registration and any later balance. It also prevents double recovery after a partial English payment.

Locating local assets and choosing the effective execution step

Registration turns the judgment into an executable Mauritian obligation, but it does not reveal property. Verify land ownership, company shareholdings, receivables or other assets through lawful material. A debtor's position as director does not make corporate funds personal property. A trading address is not proof of an attachable account.

Priority can decide whether execution is commercially sensible. Mortgages, pledges, co-ownership and insolvency claims may stand ahead of an unsecured creditor. The practical question is not merely whether the English order can be registered, but what a registered order could reach after those interests. Frequently asked questions

Can a UK county court judgment be enforced in Mauritius?

It may be capable of recognition, but a county court judgment does not fall within the Act's wording for a judgment obtained in a superior court in the United Kingdom. A different Mauritian route therefore needs analysis. This is general information; advice requires the sealed order, claim and procedural history.

How do I register an English High Court judgment in Mauritius?

An application is made to the Supreme Court under the Reciprocal Enforcement of Judgments Act, supported by the certified judgment and prescribed evidence. The statutory period is short, although the Court has power to allow longer. This is general information; counsel should confirm eligibility and timing for the specific High Court order.

Will Mauritius enforce an English judgment if the debtor did not appear?

Non-appearance is not an automatic bar, but due service and the basis of the English court's jurisdiction must be proved. A pending or intended appeal can also affect registration. That is general information; the result turns on the service evidence and the debtor's connection or submission to England.
