A donation between spouses in Mauritius is a transfer intended as a gift, but that label must be established rather than assumed during divorce. A house, bank transfer or shareholding may instead reflect a loan, a purchase arrangement or ordinary matrimonial funding. The deed, intention and completed transfer shape the answer.
Gift, loan or matrimonial arrangement
The word used in a family message is not always decisive. “This is for you” may describe a gift, while regular repayments may point towards a loan. Money placed in a joint account could fund household costs without transferring the entire beneficial interest to one spouse.
Set out who provided the asset, what each person understood, and whether anything was expected in return. Compare that account with the documents created at the time. Divorce can sharpen competing recollections, so contemporary material carries particular weight.
Deed, intention and delivery
Immovable property calls for formality. The Registration Duty Act requires a transfer of immovable property to be drawn up by authentic deed. The Notaries Act also prescribes formal execution for a notarial donation between husband and wife during marriage.
The notary’s deed should therefore be obtained in full, with the registered title and any later rectification or revocation deed. For movables, delivery and control may matter. A promise to give jewellery later is factually different from handing it over without reservation.
Land, money, shares and company routes
A donated house changes registered ownership through the deed process. A cash gift leaves a bank trail, but its meaning may remain disputed. Shares require the company’s register, transfer instrument and any board or shareholder approval demanded by the constitution.
Company-funded transfers need extra care. A director cannot turn company money into a personal gift merely by calling it one. The ledger may show salary, dividend, director’s loan or unauthorised withdrawal. The legal owner and source of value should be identified before the matrimonial consequences are discussed.
The matrimonial regime affects the result
A valid gift does not exist outside the spouses’ property regime. Ask whether the marriage is governed by communauté de biens, or community of property, or séparation de biens, meaning separation of property. The marriage certificate and any marriage contract provide the starting documents.
The source asset may have been personal, common or itself received by inheritance. The recipient’s title after the transfer and the eventual matrimonial account need not be identical questions. Similar care is required for less visible assets, including those discussed in divorce and pension assets in Mauritius.
Revocation or recovery needs a legal basis
Separation alone should not be treated as a self-help right to retake property. The Code Civil Mauricien and the deed must be considered to determine whether revocation is available and on what ground. Completed title cannot safely be reversed through a lock change, account withdrawal or private declaration.
A claimant may instead dispute whether any gift was completed, allege a condition was not met, or rely on a recognised ground affecting the deed. Each route asks a different question. In practice, the first useful step is obtaining the notarial original or certified copy, not drafting accusations from memory.
Pressure, concealment and timing
A gift made close to separation often receives close factual scrutiny. Timing is evidence, not automatic proof. The enquiry may cover independent advice, language, health, access to records and whether the donor understood that title would pass.
Claims of pressure should identify who said what, where, and what consequence was threatened. Concealment may appear through an incomplete deed explanation or a transfer routed through a company. Preserve messages and drafts. If the dispute reaches a further court stage, the distinction between factual disagreement and legal error also matters; see appeals in Mauritius.
Third parties, registration and tax checks
A later purchaser, lender or company may hold rights that cannot be ignored in a dispute between spouses. Search the registered title and any mortgage or charge. The Registrar-General’s Department maintains registered documents and records relating to land transactions and encumbrances.
Registration duties and other fiscal treatment should be confirmed for the actual transaction before a deed is signed or unwound. Do not infer today’s position from an old family transfer. Cross-border gifts may also require advice in the other country. That is particularly relevant where the parties later rely on a French process described in recognition of a French divorce without a judge.
Evidence to preserve before settlement
Keep the deed, title search, bank statements, transfer references, valuation, share register and company ledger. Retain messages that show the stated purpose and any repayment discussion. For a family loan, record the lender’s account and locate evidence of earlier instalments or demands.
Do not edit messages or annotate the only original deed. A clean chronology should distinguish the promise, transfer, later use and first demand for return. Where children or travel disputes are also present, keep those facts apart from the property claim; international child abduction guidance addresses that separate, urgent field. The family law and divorce practice covers the matrimonial dispute itself.
Frequently asked questions
Can I take back a house I donated to my spouse in Mauritius?
Not simply by changing your mind or taking possession. The notarial deed, title registration, terms of the donation and any legally recognised ground for challenge or revocation must be examined. This is general information; a notary and barrister should review the deed before steps are taken against the house.
Is money transferred between spouses treated as a gift in divorce?
A transfer may be a gift, a loan, household funding, repayment or money held for a stated purpose. The payment reference, messages, accounts and later conduct help identify the parties' intention. This is general information, and advice on classification depends on the evidence surrounding the transfer.
What if my spouse says a family loan was really a donation?
The court may need evidence from the family lender, bank records and any repayment terms or demands. A document created only after separation may carry less weight than records made when the money changed hands. This is general information; the particular lender and documents require individual advice.
