Yes, a foreign national may face removal from Mauritius after a criminal conviction, but deportation is not an automatic part of every sentence. The criminal court decides conviction and sentence. Immigration status and removal are governed through separate statutory decisions, notices and procedures.

A criminal sentence and immigration removal are distinct processes

A fine, community order or imprisonment is imposed in the criminal case. It does not itself operate as a plane ticket or immigration notice. The criminal court process in Mauritius must therefore be read separately from any later status decision.

The Immigration Act 2022 permits the Minister to deprive a resident of that status on stated grounds. One concerns conviction for a criminal offence carrying the term of imprisonment specified by the Act. The provision uses “may”, which signals a decision rather than an automatic consequence.

The Act then treats a person deprived of resident status as a prohibited immigrant, subject to an exception the Minister may apply. It directs the Director-General of Immigration to make removal arrangements. The Deportation Act supplies a distinct order-making procedure for a prohibited immigrant.

Nationality and immigration status shape the risk after conviction

Start with nationality. A Mauritian citizen is not in the same position as a non-citizen holding a visa or residence permit. Keep the citizenship certificate, passport and any evidence of dual nationality available for counsel.

Next identify the current status document. The Immigration Act 2022 covers temporary residence permits, residence permits, permanent residence permits and several occupation-permit categories. A visitor's visa is governed differently. Permit expiry, conditions and dependant status may affect the route even before conviction is considered.

Marriage to a Mauritian citizen is relevant but should not be treated as a complete answer. The current status and any notice under the immigration legislation must be examined. Long residence likewise belongs in the evidence, not in an assumption that removal is legally impossible.

When does the immigration authority consider removal?

The relevant bodies need an accurate final court record. Obtain the charge, judgment, sentence, appeal notice and any order concerning bail pending appeal. The exact offence and sentence matter because immigration legislation uses defined statutory grounds.

If the Minister deprives a non-citizen of resident status under the Immigration Act 2022, a notice must be served. For a person who otherwise ceases to hold status, the Director-General of Immigration serves notice ordering departure within the time considered reasonable under the Act, and the person may apply to the Minister to continue resident status.

A Deportation Act proposal usually involves stated grounds and a show-cause process before a Magistrate in Chambers, followed by a report to the Minister. The Act also contains a different written-representations route for the circumstances it specifies. The document received decides which response is required.

Family life, residence history and medical evidence to assemble

Prepare civil-status records for a spouse, children and dependent relatives in Mauritius. Add proof of the household, schooling, care responsibilities and the length and lawfulness of residence. If a family member depends on you financially or physically, state the dependence with records.

Medical evidence should identify the condition, treatment, prescribing practitioner and practical consequence of interruption. It should not merely say that removal would be stressful. Where treatment exists abroad, explain any material issue of access, continuity or support without exaggeration.

Evidence must be capable of use. Original certificates, reliable translations and a clear witness account are preferable to unsourced messages. The guide on evidence and witnesses in Mauritius courts explains the distinction between an assertion and proof.

What happens while an appeal against conviction is pending?

A criminal appeal challenges the conviction, sentence or both. It does not merge with the immigration file. Notice of appeal, the order about execution of sentence and any bail decision should be sent promptly to the lawyer dealing with status.

Do not assume that filing an appeal automatically suspends every immigration step. The authority should be told what is under appeal and when the court will address it. Counsel must decide whether representations, a stay or another interim remedy is needed before removal occurs.

The timetable for a criminal appeal is short and statutory. Current guidance is set out in the Mauritius criminal appeal guide. The point most often missed is that a strong appeal ground has little protective value if the immigration decision-maker never receives the filed notice.

Detention, travel documents and arrangements for departure

The Immigration Act 2022 gives immigration officers powers of arrest and detention concerning prohibited immigrants and treats custody for removal as lawful custody. The Deportation Act also regulates detention connected with its decision and execution stages. Those powers are separate from imprisonment under the sentence.

Removal requires a destination and usable travel documentation. Identity, nationality and admissibility to the receiving country may need confirmation. A consulate may address passport or emergency-document questions, but it does not decide the validity of the Mauritian order.

Under the Deportation Act, a sentence of imprisonment is generally served before a deportation order is carried into effect unless the Minister directs otherwise. Extradition follows another legal route again. That distinction is explained in the guide to extradition from Mauritius.

Coordinating criminal and immigration representation

Use one chronology covering arrest, charge, conviction, sentence, appeal, permit history and every immigration notice. Mark who served each document and when. A missed status notice cannot be repaired by argument confined to the criminal record.

The criminal lawyer supplies the certified court material and explains what remains under challenge. The immigration response addresses statutory status, family and residence evidence, the decision-maker's grounds and any urgent relief. Each side needs the other's documents.

In practice, the dangerous gap is after sentence, when the criminal hearing appears finished but immigration action has just begun. Immediate document exchange reduces that gap. Information on the chambers' work appears on the criminal law practice page.

Frequently asked questions

Will I automatically be deported if convicted in Mauritius?

No. Conviction, loss of resident status, removal arrangements and a deportation order are legally distinct steps. The Immigration Act 2022 gives the Minister powers that may be exercised on specified grounds, so advice must consider your nationality, permit, conviction and every notice actually issued.

Can a Permanent Residence Permit be lost after a criminal conviction?

Yes, potentially. A permanent residence permit gives resident status, and the Immigration Act 2022 permits the Minister to deprive a resident of that status where its stated conviction ground is met. It is not described as an automatic consequence, and individual advice should examine the offence, sentence, permit and notice.

Can I appeal deportation separately from my criminal case in Mauritius?

The criminal appeal and any challenge to an immigration or deportation decision are separate matters with different records and possible remedies. The legislation does not create one combined appeal. A lawyer must identify the decision, decision-maker and available route on your facts, including whether urgent interim protection should be sought.
