Crypto assets are addressed in a Mauritius divorce by identifying the holding, proving who controls it and placing a reasoned value on it. A token may sit outside a bank, but it can still represent wealth relevant to a financial claim. The difficult questions are usually evidence, access and safe implementation.
Crypto interests still require disclosure and proof
The Divorce and Judicial Separation Act tells the Supreme Court to consider income, property and other financial resources when exercising specified financial powers after a decree. It also defines property broadly as movable or immovable property and money. Whether a particular token attracts a particular order remains a legal question, but its economic value should not disappear from the factual account.
Disclosure should distinguish the token from the technology. State the asset, quantity, network, wallet or exchange, acquisition dates and the source of purchase funds. Screenshots without an address, timestamp or transaction identifier are weak. The treatment of pensions and other divorce assets provides the wider financial context.
Identify exchanges, wallets, tokens and control of the keys
An exchange account is different from a self-custody wallet. The exchange may hold customer identity records and transaction statements. With self-custody, control generally follows the seed phrase or private key, although one device can display several wallets and one wallet can require more than one signer.
Record the full token name and network. The same ticker may appear on different chains, and a token contract may matter. Note hardware wallets, authenticator applications and recovery arrangements without copying secrets into an ordinary evidence bundle. Control is the issue. A phone photograph of a wallet application may show access on one day, not sole ownership for all time.
Transaction histories and bank transfers help trace holdings
Public blockchain records can show movement between addresses, but addresses do not carry a person's name. Attribution often begins elsewhere. Bank payments to an exchange, exchange onboarding records, withdrawal confirmations, emailed trade receipts and device backups can connect an identified person to a public address.
Trace the sequence, not isolated transfers. A purchase in rupees may become a stablecoin, move to a private wallet and then be exchanged for several tokens. Internal exchange transfers may never appear on a public chain. For ordinary bank evidence surrounding the purchase, see bank records and disclosure in divorce.
Valuing volatile assets at a defensible date
Value is time-sensitive. A useful report names the valuation date, quantity, price source, currency conversion and any assumption about liquidity. It should also distinguish a quoted market price from what could actually be realised after spreads, fees or limits.
Thinly traded tokens, locked staking positions and assets tied to a failing platform need more than a website price. A court or negotiating party may also need values at acquisition, separation and the proposed settlement date to understand movement. In practice, the point most often missed is quantity: an exact price cannot repair an uncertain token balance.
A lost wallet or third-party claim must be tested
A claim that a seed phrase is lost may be true. Test it against later outgoing transactions, replacement-wallet activity, exchange withdrawals and messages about recovery. Nobody should be ordered to reveal a private key merely to prove that a wallet exists. A signed test message or small agreed transaction may prove control more safely.
If the wallet is said to belong to a relative, company or trust, obtain the purchase record, custody arrangement and evidence of who gave instructions. Nominee language does not settle beneficial ownership. Nor does control alone. The task is to assemble documents showing acquisition, funding, intention and use, then seek findings supported by that chain.
Preserve digital assets without exposing private keys
Private keys and seed phrases should never appear in pleadings, correspondence circulated between parties or an expert's open report. Record public addresses and transaction identifiers instead. If assets must be preserved, consider a regulated custodian, multi-signature arrangement or other controlled mechanism after technical and legal advice.
Mauritius regulates defined virtual-asset services under the Virtual Asset and Initial Token Offering Services Act 2021. The Financial Services Commission supervises licensed providers in or from Mauritius. That regime does not make every overseas exchange safe or recover a mistaken transfer. Where disclosure creates a personal-safety risk or coercive control is present, the immediate issue may require separate protection-order advice.
Tax, liquidity and transfer risks affect settlement terms
A settlement expressed as “half the crypto” is incomplete. It should identify the token, network, quantity or valuation formula, transfer date, wallet verification method, transaction fee and what happens if the exchange blocks withdrawal. Stablecoins carry issuer and platform risk as well as price risk.
Disposal or transfer may have tax consequences in Mauritius or another country. Mauritius has committed to international tax-transparency standards for virtual-asset transactions, and the reporting position for a given provider should be checked before it is relied on. Obtain current tax advice before choosing between a token transfer, sale or offset. Similar cross-border coordination issues arise with foreign pensions in divorce.
Gather specialist evidence before seeking a court order
Preserve exchange statements in their original format, bank funding records, wallet public addresses, transaction hashes, token contracts and contemporaneous messages. Note the device and application used, but do not access an account without authority. An expert should explain methods, assumptions and gaps in language the court can test.
Counsel can then define the order sought: disclosure by the spouse, preservation pending determination, evidence from an exchange or a transfer within final relief. Each has different proof. Frequently asked questions
Does cryptocurrency have to be disclosed in a Mauritius divorce?
Crypto holdings should be identified where financial resources or property are in issue, together with evidence of ownership and a defensible value. Leaving them out can distort the financial picture presented to the other spouse or the court. This is general information; advice on your case should address the matrimonial regime, source of funds and relief sought.
How can I prove my spouse owns a crypto wallet?
Exchange statements, bank transfers, device records and a small signed transaction may connect a person to an address, but a public address alone may not prove ownership. Evidence should be preserved lawfully and assessed as a chain. General information cannot determine attribution; obtain advice before seeking an order or alleging concealment.
Can crypto be transferred to satisfy a divorce settlement in Mauritius?
A consensual settlement may provide for a token transfer if the parties can lawfully complete it and define the asset, network, timing and costs. Price movement, tax, exchange checks and an incorrect wallet address can change the result. This is general information; legal and tax advice should test the proposed mechanics before the settlement is signed.
