Which form of will should you use in Mauritius?

The right will form in Mauritius is the one you can execute correctly and your estate can prove after death. The Code Civil Mauricien recognises holographic, public-instrument and mystic forms. Most choices turn on the evidence each form creates, not convenience alone.

The right will form depends on risk, assets and the testator's circumstances

Start with the likely points of disagreement. Is authorship likely to be questioned? Does the testator have difficulty writing or signing? Are family expectations sharply divided? Does another country hold property or an earlier will? Each answer changes the value of a particular form.

A simple estate can still produce a difficult dispute. Conversely, a substantial estate may be orderly where ownership records, execution and custody are clear. The useful comparison is between the testator's actual risks and the formal proof available after death.

The Code also prohibits two people from making a will in the same instrument. Spouses who want matching outcomes therefore need separate wills. Their documents can be coordinated without becoming a joint will.

Handwritten and notarial wills solve different evidential problems

A holographic will must be entirely written, dated and signed by the testator's hand. It needs no further form under Article 970. That gives privacy and direct evidence of handwriting. It also leaves the original vulnerable to loss, damage and disputes over changes.

A public-instrument will is read to and signed by the testator before two notaries, or one notary and two witnesses. The text is prepared from the testator's instructions and read aloud, and understanding of its language is confirmed. The deed records its formal execution. This can matter where capacity, pressure or the origin of the wording may later be challenged.

The mystic form is a separate sealed-will procedure involving a notary and witnesses. Its formal steps are exacting and should not be attempted from an informal summary. A person considering it should ask a notary how the current Code applies to their circumstances.

Notaries advise and draft documents. Barristers advise, draft and litigate, while attorneys also advise, draft pleadings and conduct procedure, filing and service. The fuller distinction appears in Mauritius's three legal professions.

Forced heirship must be considered whichever form is chosen

Execution form does not expand the disposable portion. The Code protects children through réserve héréditaire, or forced heirship. A perfectly executed will may therefore give a beneficiary less than its words suggest if protected shares are exceeded.

The calculation starts with the estate actually owned by the deceased. Matrimonial property, lifetime gifts, co-owned assets and debts can alter that base. Form and substance must be reviewed separately. A notary's authentic deed is not an exemption from succession limits.

An estate-planning review for Mauritius should connect the will to ownership records and beneficiary arrangements. It should also identify assets that pass under another contract or legal mechanism.

Choosing a form for age, illness, literacy or mobility concerns

A person who cannot write the entire text should not use the holographic form. For a public-instrument will, the Code allows the deed to state that a testator cannot sign and why. The notarial process includes reading the deed aloud and checking understanding.

Illness does not answer capacity by itself. The question is whether the testator understands and expresses the testamentary decision when the will is made. A formal setting can record instructions, but it cannot manufacture understanding. Where doubt is foreseeable, contemporaneous evidence may be important.

Mobility needs early discussion with the notary. Do not arrange informal witnesses and assume the result can later be converted into a notarial deed. The place, attendees, language and method of execution must fit the chosen form from the outset.

What changes when property or heirs are outside Mauritius?

A will validly made in Mauritius may still need proof and administration abroad. Foreign immovable property is particularly likely to require local formalities. A foreign adviser should confirm whether the proposed Mauritian form will be accepted for that asset.

The reverse problem also occurs. A person abroad may sign a will affecting Mauritius. The Code addresses wills made overseas and requires registration before they are carried into effect against Mauritian assets. The process is explained in recognition of a foreign will in Mauritius.

Foreign heirs are not merely addresses on a distribution list. Identity evidence, powers of attorney and local property restrictions may require separate attention. Read the guide for foreign heirs inheriting in Mauritius before assuming nationality decides succession rights.

Storage, access and the danger of conflicting originals

A carefully drafted will fails practically if nobody can locate it. A holographic will can be deposited with a notary, who records the deposit in a Register of Wills without recording its contents. After death, information supplied for registration also supports the Registrar-General's Register of Testamentary Dispositions.

Keep one clear custody record. A beneficiary should know whom to contact, but need not hold the only original. If a will is replaced, deal with the earlier original consistently with legal advice. Secretly retaining competing originals creates an avoidable factual contest.

In practice, discovery is often the first dispute. A sealed envelope in a desk, a scan on a phone and a deed held by a notary may tell different stories. All should be preserved until their legal relationship is assessed.

A will review should follow major family and ownership changes

Review the instrument after marriage, divorce, a birth, a death, a substantial sale or a move to another country. Also review it when a business changes form or an asset moves into joint ownership. The original gift may no longer describe anything the testator owns.

A later will can revoke an earlier one expressly. Without express revocation, incompatible later provisions displace conflicting earlier terms under the Code. Careful drafting matters when only the Mauritius assets should be affected.

The final choice should be documented and then executed, not left as an unsigned draft. The property, estates and wills practice covers both planning and disputes. Form is the beginning of validity, not the whole enquiry.

Frequently asked questions

Which type of will is safest in Mauritius?

No form is safest for every testator. A notarial will supplies a formal execution record, while a holographic will can be valid through the testator's handwriting, date and signature. That is general information; safety depends on your capacity, family risk, assets and storage arrangements.

Can I replace a handwritten will with a notarial will later?

Yes, a later will can revoke an earlier will, either expressly or through incompatible provisions. The new deed should identify the intended scope clearly, especially where another country is involved. General information cannot determine the effect of two particular instruments.

Do spouses need separate wills in Mauritius?

Yes. The Code Civil Mauricien does not permit two people to make a will in the same instrument, including reciprocal or mutual dispositions. This is general information; each spouse should obtain advice on ownership, forced heirship and the terms of a separate will.
